project was on hold since there was no application form included. To date, we have not
received the mentioned information regarding this project.
If we do not hear anything from you within two weeks of the date of this letter, we
will be forced to withdraw the project.

The Division of Water Quality has reviewed your submittal for a FERC to
rebuild the Mountain Shores 10 boatslip facility in Catawba County. Your application
was not complete since the enclosed application form was included. Please provide
information regarding the location of your project. This information is needed by DWQ
in order for us to decide whether this project is approvable.
I can be reached at 919-733-1786 if you have any questions. Until this
information is received, I will request (by copy of this letter) that the Corps of Engineers
place this project on hold. Also, the project will be placed on hold for our processing due
to incomplete information (15A NCAC 2H.0507(a)(4)).

REFERENCE: MOUNTAIN CREEK SHORES 10 BOATSLIP FACILITY REBUILD
This structure was properly permitted under our Private Facilities Program in 1987 as a
"Community Use" facility of 10 slips or less. The users of this access lot have requested
authorization to rebuild this facility. As a result of changes to our Shoreline Management
Guidelines effective June 1, 1996, we no longer permit any facilities for off-water access
under our Private Facilities Program. This type of facility is now permitted under our
Commercial/Residential Program.
Lake Management is requiring Mountain Creek Shores Association to rebuild under the
Commercial/Residential Program. They will have to complete the proper application,
obtain applicable local, state and federal permits from agencies that issue them and notify
each agency as a courtesy of their intent.
