APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. and Ms. Harris:
You have our approval, in accordance with the attached conditions and those listed below, to dredge up to 14,310 square
feet of waters for the purpose of excavating a channel in the Bay River to Cedar Creek, as you described in your application dated
February 25, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Channel width shall be reduced to 30 feet in width rather than 53 feet as proposed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

John, back in the EA review phase of this they were requesting 53'. I required an EA amendment asking for
20'-they agreed. Upon further review with John Parker and other DCM staff I have agreed that 30' is a
better width.
They (applicants) have already reduced/minimized their impacts (30' vs. 53') so I think this letter is not
needed.
If possible (in between beers) write the 401 with the 30' width condition.

John, based on a review of the CAMA application (applicants), I recommend the
following be added to the 401:
1) This dredging is for access to the Bay River from Cedar creek. Bay River is classified
as SC Sw NSW and Cedar Creek is classified as Sc Sw NSW HQW and is a PNA.
The applicant currently owns a lot on Cedar Creek some 1000' from the confluence of
Cedar Creek from the confluence with Bay River. Shoaling in this area is restricting
access to Bay River and the applicants wish to dredge a 270' long by 53' wide by 5'
deep access channel (850 yds' ). An EA for this project initially requested a channel
width of 40'. DCM and I have consulted on the appropriate channel width for the area
and likely usage and have decided on 30'. Therefore I recommend {as per NCAC
15A 2H .0506 (b) (2)) that the applicants minimize/avoid impacts by reducing
the channel width from the proposed width of 53' to 30' (with an appropriate
corresponding change to the channel width at depth). Given that this proposed
project is for only a single family a 30' wide channel width seems more than
adequate.
Please let me know when the 401 is complete so that I can FAX it to John Parker who is
requesting our immediate comments.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own property adjacent Cedar Creek, off Dixon Road, within the
Town of Vandemere, in Pamlico County. Their high ground lot is located
approximately 1,000' up Cedar Creek and the shoreline is bulkheaded. There is a
mobile home and several storage sheds on the property. The applicants are currently
constructing a single family dwelling at the site and a short private pier extends out into
the creek. The proposed dredging project however is located out in Bay River at the
confluence of Cedar and Vandemere Creeks. The mouth of Cedar Creek is
approximately 350' wide and has shoaled up over the years. (Although the sandy shoal
can be seen in the 1995 aerial photographs, it is extremely prominent in the 1989
photos). The average water depth in Cedar Creek is approximately -5' below NWL,
while the water depth outside the mouth becomes extremely shallow and averages
approximately -2' below NWL for some 250'. At that point, the depths begin to drop
off and eventually reach -10' below NWL at the point where the USACOE dredging
project was undertaken years ago.
Bay River along this section is classified as SC Sw NSW. Cedar Creek is
classified as SC Sw NSW HQW and is a designated Primary Nursery Area. Vandemere
Creek is classified as SC Sw NSW and net trawling is prohibited. All the areas
described are closed to shellfishing. The applicants state that there are no SAVs in the
area where the dredging is proposed. None were noted during the site visit.
Project Description
The applicants propose to excavate a new 270' long X 53' wide X -5' deep channel
within Bay River at the entrance of Cedar Creek, near the Town of Vandemere, in
Pamlico County. The applicants propose to use a barge mounted backhoe to excavate
the channel. The sides of the channel would be cut on a 45 degree slope with the bottom
cut measuring 40' wide. Spoils from the project would be barged to the applicants'
property some 1000' up Cedar Creek and off loaded with a bobcat. Hay bales, silt fence
and a 40' vegetated buffer would be used for sedimentation and erosion control. The
material would later be used to raise the elevation of the lot.

Anticipated Impacts
Excavation of the access channel through the sandy shoal would directly impact
approximately 14,310 fe of Estuarine Waters and shallow water "Public Trust" bottom
of Bay River. Approximately 850 yds3 of sandy material would be removed from the
system and deposited on high ground. Approximately 7,500 ff of high ground would
be disturbed by the disposal site. Some localized increase in turbidity would be
expected, but given the nature of the material the impact should be minimal.
