N1 -TIA-r(OPJ Compensation - Wetlands. The total wetland impacts from Table 3 is 41.5 acres. Aside from the ephemeral wetland (Section B - Site 4), all impacts are essentially riverine impacts. NCDOT is proposing to offset the 4.7 acres of high quality impact at the Little River by offering 4.7 acres of on-site restoration (1:1 ratio) and 8.4 acres of on-site preservation, as described in Appendix C. This on-site mitigation effort will be packaged with the entire SALT (Sandhills Area Land Trust) Mitigation Site. The SALT Mitigation Site is an approximately 327-acre site located near Lobelia in Moore County that is being offered, in total, to offset wetland impacts associated with the project. The SALT Site represents an ecosystem approach towards mitigation since it not only has restoration, enhancement, and preservation of wetlands, but it also contains upland restoration of long-leaf pine forests in an effort to restore the ecosystem to its historic assemblage. As mandated by Section 401 regulations, a minimum of 1:1 wetland restoration or creation must be provided for every acre of wetland impact. As stated above, NCDOT proposes to meet the 1:1 requirement for the 4.7 acres of high quality impact at the Little River by providing 4.7 acres of high quality restoration on-site. NCDOT proposed to mitigate for the remaining 36.8 acres through the SALT Site. Based on groundwater models, the SALT Site currently has 49 acres of wetlands that will be restored to its historic hydrology by methods outlined in the mitigation plan. In addition, including the 10 acres of upland long-leaf restoration, approximately 82 acres will be planted with native vegetation in an effort to restore the ecosystem. The details of these plantings and the mitigation plan are in the Wetland Mitigation Plan - Salt Mitigation Site, dated August 2000 and provided to the resource agencies in a letter dated August 16, 2000. Condition 7 in the WQC states "hazardous Spill Catch Basins shall be required for all stream crossings..." For good or bad, pursuant to letting the project to construction in October 2002, the right of way acquisition for this project was completed in advance of DWQ's issuance of the 401 WQC. Hydraulic design decisions were based, in part, on the guidance paper, "Guidelines for the Location and Design of Hazardous Spill Basins", which was developed in 1996 in consultation with the DWQ. The Department of Transportation (DOT) now understands that special circumstances may have led the DWQ to require a more extensive deployment of hazardous spill catch basins in the project area. The presence of impaired waters, water supply watersheds and vigorous comments from the public are among the reasons that were given for the basin requirement at all stream crossings. The DOT would like to propose the deployment of hazardous spill basins only within the HQW watershed associated with the Little River. Furthermore, the Department strongly recommends that these basins be installed only where storm water will be channeled through devices such as shoulder berm gutters. This will provide the opportunity for capturing spills should they occur. Where sheet flow across grassed shoulders is the predominant method of dispersing storm water, there is little or no opportunity for interdicting spills. Positioning of hazardous spill basins to maximize the opportunity for mitigating spills should be our goal. Ms. Van Der Wiele advised Mr. Wood to use the appeal process detailed in the Water Quality Certification. NCDWQ realizes that right-of-way acquisition often takes place prior to the issuance of a §401 Water Quality Certification. It seems to me that DOT lost their opportunity for change when they failed to appeal within the prescribed timeframe. I don't know what legal implications making a change by not going through the appeals process has are there any? It seems to me that since there doesn't appear to be a definition for "spill catchment basin" there is room for interpretation as to how to appropriately catch a spill- W/o relinquishing catchment devices on the stream crossings as recommended I wonder if there is a way to address their right of way acquisition concerns and our/my concerns for catching spills? I'm willing to entertain appropriate measures for spill containment.
