Dear Mr. Wrenn: The North Carolina Department of Transportation (NCDOT) received a request for additional information to supplement the 401 Modification for R-0210 (Vass Bypass) that was submitted on December 18, 2006. The items requested are listed below. Information addressing each item can be found on the attached documents. Requested Items: Item #1 Direct discharges of stormwater at Stations 29+10 L (Site AA) and 31+10 L (Site BB) NCDWQ Comment: The proposed corrective action places a rip-rap berm in the buffer of a stream relocation for which NCDOT was given mitigation credit. NCDWQ has concerns with placing hardening structures in the buffer of an on-site mitigation project. NCDWQ would like to discuss other options for correcting the direct discharge of stormwater. NCDOT Response: See Attachment titled: DWQ Inquiry from Brian Wrenn 03 January 2007 Item #2 Attachment B plan drawings NCDWQ Comment: NCDOT describes the structures to be installed in the narrative and provides typicals for the planned structures, but does not show the structures on the plan drawings. Please provide to scale drawings of the structures on the plans showing the fill and excavation limits in relation to the existing facility, stormwater management structures, and jurisdictional waters. However, it unclear if the available volumes are equivalent to the required 2,600 gallon storage volume plus the 2-year storm flow (per the March 15, 2005 guidance). Please provide the necessary calculation to show that the proposed storage volumes are adequate. The construction and installation will not encroach into the mitigation site. During construction the contractor installed silt fence barrier with washed stone along the edge of the mitigation site and 10'-12' from toe of fill slope. When project was stabilized, the contractor removed the silt fence barrier and spread the washed stone, in the open area between toe of slope and mitigation site limits. The installation of swale and berm is to be made in this gravel field zone and not in the mitigation floodplain. The scale of plan sheet 22 is so small that reference is made to sheet 3 Typical Section. Item 2 Attached are revised copies of plan sheets 9 & 13 that show excavated basins 1 & 5, respectively. At all other locations the construction limits are so small the scale on the sheets renders them not distinguishable. Therefore, Detail Sheets 26-3 8 are provided. It should be noted that on sheet 13, site CC, is a Preformed Scour Hole and the Standard Symbol is shown to assist the reviewer in locating the site and does, not represent the "to scale" construction limits on the plan sheet scale of 1" = 26.67 meters. Dear Mr. Rawls: The North Carolina Department of Transportation (NCDOT) was issued a 401 Water Quality Certification (WQC) by the North Carolina Division of Water (NCDWQ) on July 19, 2002 for the US 1 Vass Bypass in Moore/Lee Counties. Since issuance of this 401 WQC, numerous correspondence has been exchanged between the NCDOT and NCDWQ. Notable correspondence includes the Notice of Violation dated May 5, 2003 and an Assessment of Civil Penalties dated February 10, 2005. The purpose of this letter is to request a modification of the 401 WQC per the Settlement Agreement and Withdrawal Petition (SAWP) dated October 15, 2006. There are no changes to jurisdictional impacts as a result of the new design changes. Please find enclosed Attachments A - Summary of Emergency Spill Control Measures and Devices, B - Plan sheets, and C- Storage Volume and Calculations of Storage Volumes. The NCDOT made its payment of $12,284.28 to the North Carolina Department of Environment and Natural Resources. Additionally, the NCDOT provided a list of items in the spill kit to NCDWQ. Item #4 of the Settlement Agreement and Withdrawal Petition In accordance with Item #4 of the SWAP, the NCDOT submits this 401 WQC modification request. In Item #4a of the SWAP, the 401 WQC modification request had to include a complete list of station numbers where emergency spill control measures and devices will be constructed. This information is found in Attachment A of this letter. In this attachment, the NCDOT lists all emergency control devices referencing the list from Attachment A of the SWAP with the location of the sheet number and reference identification on the plan sheet plan view. This information complies with Item #4a of the SWAP. The following summarizes how NCDOT has resolved the direct discharge of stormwater that NCDWQ raised in the settlement: • At Station No. 29+10 Left (Site AA) and 31+10 Left (Site BB) on Sheet 22 TIP No. R-210 WM, the NCDOT will construct an energy dissipation pad at the pipe outlet which will flow into a grassed swale. Notes have been included on the plan sheet to describe this work. A typical of the swale is included in Attachment B, Sheet 2, of this letter. At Station No. 77+20 Right (Site CC) on Sheet 13 of TIP No. R-21 OWM, the NCDOT will eliminate this direct discharge by constructing a pre-formed scour hole. There is restricted access at this location. This work will be by hand due to the high fill, guardrail and the adjacent wetlands. Notes have been included on the plan sheet to describe this work. At Station No. 81+90 Left (Site DD) on Sheet 15 of TIP No. R-210WM, the NCDOT will eliminate this direct discharge adding 20 feet of high density poly ethylene (HDPE) to the existing pipe. This will allow discharge outside the buffer. Notes have been included on the plan sheet to describe this work. • At Station No. 94+60 Left (Site EE) on Sheet 17 of TIP No. R-210WM, the NCDOT will place additional Class I rip rap at the outlet of the 36-inch RCP to deflect flow away from opposite stream bank. Notes have been included on the plan sheet to describe this work. In Item #4b of the SWAP, the NCDOT must include in the 401 WQC modification request to-scale drawings and designs of the proposed emergency spill control measures at each location including the storage volumes and calculations of the storage volumes where applicable. Attachment B of this letter includes to-scale drawings and designs of these emergency spill control measures and devices. 2 In Attachment C of this letter are the storage volumes and calculations of the storage volumes where applicable. This action brings NCDOT into compliance with Item #4 of the SWAP. Summary The NCDOT requests the NCDWQ to modify the 401 WQC for the Vass Bypass (TIP No. R-210). Attachment C - Storage Volumes and Calculations of the Storage Volumes has been updated and is attached. 2) Paragraph 42 of the modification. NCDOT would like the sentence "The number of sandbags at each location shall be adequate.." to be changed to match the wording in the paragraph entitled " Sandbag Stockpile" from Attachment A of the Settlement Agreement. The sentence from Attachment A reads as follows: " The number of sandbags at each location should be adequate...." and not shall be. The construction and installation will not encroach into the mitigation site. During construction the contractor installed silt fence barrier with washed stone along the edge of the mitigation site and 10'-12' from toe of fill slope. When project was stabilized, the contractor removed the silt fence barrier and spread the washed stone. in the open area between toe of slope and mitigation site limits. The installation of swale and berm is to be made in this gravel field zone and not in the mitigation floodplain. The scale of plan sheet 22 is so small that reference is made to sheet 3 Typical Section. Item 2 Attached ate revised copies of plan sheets 9 & 13 that show excavated basins 1 & 5, respectively. At all other locations the construction limits are so small the scale on the sheets renders them not distinguishable. Therefore, Detail Sheets 26-3 8 are provided. This matter aorose out of DENR's assessment of civil penalties and costs totaling nineteen thousand two hundred eighty-four dollars and twenty eight cents ($19,284.28), imposed upon Petitioner on February 10, 2005 for alleged violations of North Carolina General Statutes § 143-215.1 et seq. Petitioner filed a Petition challenging the issuance of the penalty on March 22, 2005. DENR and the Petitioner have reached the following settlement agreement in this matter: 1. The Petitioner will pay twelve thousand, two hundred eighty-four dollars and twenty-eight cents ($12,284.28) ("Settlement Amount") to DENR for settlement in the manner hereinafter described. The Settlement Amount shall be made in a lump sum payment payable within thirty days of the execution of this Agreement. 2. The payment shall be by check made payable to the North Carolina Department of Environment and Natural Resources (or to "DENR") at the following address: Ms. Sharlene Moses Attorney General's Office Environmental Protection Division 9001 Mail Service Center Raleigh, NC 27699-9001 3. The Petitioner expressly agrees that all emergency spill control measures and devices will be installed as listed in Attachment A. 4. The Petitioner expressly agrees that within 60 days of signing of this Agreement, a request for a modification of the Water Quality Certification for the Vass Bypass, Water Quality Certification No. 3344, shall be submitted to the Division of Water Quality, Transportation Permitting Unit. The modification request will propose installation, operation, and maintenance of the emergency spill control measures and devices as described in Attachment A. This modification shall include the following components: a. A complete list of station numbers where emergency spill control measures and devices shall be constructed; and b. To-scale drawings and designs of the proposed emergency spill control measures at each location including storage volumes and calculations for the storage volumes where applicable. 5. The Petitioner must obtain approval of the Water Quality Certification modification for the proposed emergency spill control measures prior to installation of the measures. Failure to obtain approval of the modification may result in additional enforcement actions. DENR will process the modification in keeping with its normal business practices. 6. The Petitioner expressly agrees that within 30 days of receipt of notification of the approval of the Water Quality Certification modification by the Division of Water Quality, Transportation Permitting Unit, the Petitioner will advertise for bids to construct the modified hazardous spill catchment basins and modified hazardous spill catchment basins for use in a lateral ditch, and to eliminate direct discharges of stormwater, as listed in Attachment A. A contract will 'be awarded in accordance with typical NCDOT contracting practices. The provisions of the contract will be in accordance with standard NCDOT construction contract terms and conditions, and will include a completion date of 180 days from the award of the contract. The sandbag stockpiles required by Attachment A will also be installed and operational within this time frame. 7. The Petitioner expressly agrees that Emergency Management, local fire departments, and other first responder programs (hereinafter, "first responders") that have jurisdiction within/overlapping the subject R-210 corridor (Vass Bypass project) in Lee and Moore Counties will be provided spill kits and maps of the road corridor with the locations of the emergency spill control measures and devices, as described more particularly in Attachments A and B. The spill kits and maps will be provided to the first responders within 30 days after all emergency spill control measures and devices are installed and operational. Petitioner agrees to inform the first responders of any change in location or operation of any of the emergency spill control measures or devices. 8. The Petitioner expressly agrees that within 60 days after the emergency spill control measures and devices listed in Attachment A are installed and operational, pursuant to Aaragraph 6 of this Agreement, NCDOT will provide: a. To the Fayetteville Regional Office, Division of Water Quality, 225 Green Street, Suite 714, Systel Building, Fayetteville, NC 228301-5043 and to the Division of Water Quality, NPS Assistance and Compliance Oversight Unit at 1617 Mail Service Center, Raleigh, NC 27699-1617 a report that explains that all of the emergency spill control measures and devices as listed in Attachment A were installed and are operational; and b. A list of which first responders received spill kits and maps (as defined in Attachments A and B) and how many they received, and a brief accounting of.how the information was communicated, i.e., time and date of distribution and 'method of distribution, such as through personal communication or memorandum. 9. ' The Petitioner agrees that during constructionlinstallation of the emergency spill control measures and devices required by Attachment A, Petitioner will: a. Use erosion and sediment control practices in full compliance with all specifications governing the proper design, installation, and operation and maintenance of erosion and sedimentation control structures, and will follow the requirements of 15A NCAC 04B .0124 (Design Standards in Sensitive Watersheds). This requirement will apply only to the construction/installation of the emergency spill control measures and devices required by Attachment A, and will not bind NCDOT or set a precedent for NCDOT to use these standards in the future in non-high; quality water zones. b. Fully comply with its National Pollutant Discharge Elimination System stormwater discharge permit (No. NCS000250), effective March 18, 2005, as amended; and c. Ensure that no unauthorized waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, streams or riparian areas, and that all construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, will be performed such that no violations of state water quality standards, statutes, or rules occur. Petitioner will apply for the proper certifications and permits, as necessary, and comply with all applicable statutes and regulations, for any additional work in the R-210 corridor. 10. Petitioner and DENR expressly stipulate and acknowledge that, by entering into this Agreement, Petitioner neither admits nor denies the allegations contained in the Findings and Decisions and Assessment of Civil Penalties. 11. DENR agrees to accept the payment of twelve thousand two hundred eighty-four dollars and twenty-eight cents ($12,284.28), in complete satisfaction of the civil penalty assessment subject to the terms of this Agreement. 12. This Agreement shall be binding upon the parties and is entered into knowingly, intelligently, and voluntarily. 13. Upon a breach of any condition of this Agreement by Petitioner, the sole issue in any action by DENR will be whether Petitioner has complied with the terms of the Agreement, and DENR's remedy will be to collect the difference between the original civil penalty assessment and the amount paid by Petitioner pursuant to paragraph 1, i.e. seven thousand dollars ($7,000.00). 14. Nothing in this Agreement shall restrict the right of the DWQ to inspect or take enforcement action against the Petitioner for any new or subsequent violations of the water quality statutes and the relevant rules promulgated thereunder arising outside of the actions addressed within this Agreement; i.e., violations occurring after the last date in the assessment period. Similarly, nothing in this Agreement shall restrict the right of Petitioner to contest and defend against any future action by DWQ for any (alleged) future or subsequent violati6n(s) of applicable laws or rules. 15. Petitioner expressly agrees that by entering into this Agreement, it waives, for purposes of collection of the Settlement Amount listed in paragraph 1, any and all defenses to the underlying civil penalty assessments, and that the issue in any action to collect said penalty will be limited to issues of compliance with this Agreement. 16. The parties agree that the consideration for this settlement is the promises contained herein and that this Agreement contains the whole agreement between them. 17. Q Attachment A Table 1 below includes a list of sites where emergency spill control measures and devices shall be located. In addition, modifications will be needed to eliminate direct discharges of stormwater to surface waters at several locations. These station numbers are included in the table below. Finally, four (4) spill kits will be provided to the first responders listed in Attachment B that have jurisdiction within/overlapping the subject R-210 corridor (Vass Bypass project) in Lee and Moore Counties. Emergency spill control measures and devices are defined by the following terms: Spill Kit Equipment and materials provided to the first responders to control and contain hazardous material spills. The North Carolina Department of Transportation ("NCDOT") shall provide a list of equipment and materials to be included in the spill kits to the North Carolina Division of Water Quality ("NCDWQ") for approval within thirty (30) days of signing of this Agreement. The spill kits should include (1) grate/drain cover mats; (2) absorbent materials for both oil and acid/base spills, such as absorbent socks, mats, pillows, and booms; (3) rough surface portable dikes; (4) sump skimmers; (5) temporary disposal bags; and, (6) keys to unlock any secured sluice gates. In addition, the kit should include waterproof maps of the road corridor with the locations of the emergency spill control measures and devices. Sandbag Stockpile Sand-filled bags used to block the flow of hazardous materials in ditches and swales to ` prevent discharge to waters of the State. The number of sandbags at each location should be adequate to block the flow of hazardous materials in the ditch or Swale by utilizing the full storage capacity of the ditch or Swale. HSCB Hazardous Spill Catchment Basins ("HSCB"). These are earthen basins designed to control and contain a 10,000-gallon spill plus the estimated runoff from a 2-year storm event. Control structures on the outlets of the HSCBs should be mechanical control gates or minimum control sections in.the outlet channel that can be readily blocked with earthen material or stacked sandbags. A sign will be placed to mark the location of each HSCB. mHSCB Modified Hazardous Spill Catchment Basins ("mHSCB"). These basins serve the same purpose as the HSCB but have a modified storage capacity. mHSCB must have the storage capacity to handle a 2,600-gallon spill plus the estimated runoff from a 2-year storm event as detailed in Attachment 1 of the March 15, 2005 letter from NCDWQ to NCDOT (see attached). A sign will be placed to mark the location of each mHSCB. mHSCB for Lateral Ditch Modified Hazardous Spill Catchment Basins for use in a lateral ditch. These basins serve the same purpose as the HSCB but would be constructed in existing lateral ditches and would have the same design standards as the mHSCBs (2,600 gallons plus runoff from the 2-year storm event)_ A_sign will be placed to mark the location of each- mHSCB for a lateral ditch. NCDOT shall inspect and maintain the emergency spill control measures and devices in accordance with the requirements of its National Pollutant Discharge Elimination System stormwater discharge permit (No. NCS000250), effective March 18, 2005, as amended. Part II, Section BA of the permit requires NCDOT to develop and implement a stormwater BMP inspection and maintenance program. NCDOT must inspect the sandbag stockpiles annually and replace sandbags as needed, until such time as the BMP inspection and maintenance program is implemented in Moore County. Dear Dr. Thorpe: The purpose of this letter is to respond to comments and concerns raised during our February 1, 2005 site visit and to provide the NC Division of Water Quality's (DWQ) position based on the review of the final design plans for the referenced project. Conversion of Tyne "A" Silt Basins During our site visit NC Department of Transportation (DOT) requested a response to the letter dated November 8, 2004 in which DOT proposed to convert three type "A" silt basins into hazardous spill catchment basins (HSCBs). The three basins are located on Section A at 60+80 and 74+40, respectively, and Section B at 132+00. DWQ agrees with DOT that these basins could easily be converted to HSCBs and would comply with Condition 7. of the issued 401 Water Quality Certification. Conversion of the type "A" basins to HSCB should include adequate outlet structures that meet the design requirements of the Guidelines for thg Location and Design of Hazardous Spill Basins. Revised Design Standards for HSCBs in an effort to find a resolution to this situation, DWQ proposes a modification to the current design standards for HSCB. The modified design standard offers a smaller storage volume than the current 10,000 gallons plus the estimated runoff from a rainfall intensity equating to a two-year return period storm event. The modified standard requires a storage volume of 2,600 gallons plus the storage capacity for the estimated runoff from a rainfall . intensity equating to a two-year return period storm event. The rational for the smaller volume is presented in Attachment 1. Please note that the revised design standard applies only to the referenced project. Direct Storm Water Discharges During the site visit, DWQ identified areas of concern regarding direct storm water discharges. DWQ respectfully reminds DOT that regardless of the methodology used to comply with Condition 7. of the issued permit, compliance with Condition 4. must also be met. Condition 4. states that, "Storm water shall be directed to buffer areas or retention basins and shall not be routed directly into streams. Existing vegetated buffers shall not be mowed in order to utilize it for storm water diffuse flow." It appears that the following sites have direct storm water discharges: - Section A: Sheet 20, -L- 77+20 Rt. Sheet 22, -L- 81+90 Lt. Issues in Impact Areas Several impact areas were identified during the site visit where problems are presently related to pipe installation and stream relocation. These are presented below: Section B, Site II - When the rock check dam in the stream is removed at this site, there is a potential for headcutting back to the pipe resulting in a perched pipe. It was agreed in the field `that a rock cross vane would be installed to maintain the grade at the outlet of this pipe. Section B, Site IX - An erosional area has developed just upstream of the inlet to the pipe at this location. It was agreed to in the field that a rock/log vane would be installed at this location to maintain the grade and prevent further headcutting upstream. Section B, Site X - Bridge deck drains at this site were installed over Little Crane Creek. The proper locations for these drains were determined during the field visit. The drains should be installed at the proper locations. The problems listed above should be corrected as agreed to in the field. If alternative solutions to the problems are to be used, DOT should detail these in writing and submit them to DWQ for approval prior to modification. Determinations from Review of Final Design Plans Based on the February 1, 2005 site visit and the subsequent review of the final design plans, DWQ has identified stream crossing locations where alternative means other than HSCBs might be considered. These locations are presented in Attachment 2. For all other sites, DOT will need to provide design plans that demonstrate how the project will comply with the issued 401 Water Quality Certification and its modifications. DOT is respectfully reminded that any modifications to the final design plans as a result of complying with the 401 Water Quality Certification will require the submittal of an application for modification of the Water Quality Certification to DWQ.
