Dear Ms. Cartwright-Smith:
I am in receipt of you public records requests to my client, the Division of Water Quality.
I am aware of three separate requests to the Division, including (1) a request to the Fayetteville
Regional Office, (2) a request to the Wetlands/401 Water Quality Certification Unit and (3) a
request to the Wetlands Restoration Program. If there are other outstanding public records
requests to the Division of Water Quality or another division within the Department of
Environment and Natural Resources, I would like to coordinate the responses in the interests of
efficiency, and would ask that you send me copies of the other requests.
In a brief overview of the files and your requests, the employees of the Division identified
a large number of responsive documents that would exceed your monetary limit for copying. For
example, the Wetlands/401 Water Quality Certification Unit file includes a multi-volume
Environmental Impact Statement and public comments generated during the notice and comment
period. These may be unnecessary for you to copy. With this in mind, I suggest that you review
the Division's files first and request copies of documents pertinent to and within the budget for
your search. If you choose to pursue your public records request in this manner, I will work with
your schedule to make the documents and a copier available during your review.
