Robeson County Dear Mr. Toth: The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No Exposure Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal and signed certification of no exposure at the above referenced facility as well as observations made by Melissa Joyner with the Fayetteville Regional Office on March 8, 2019 and April 15, 2019. The Division is granting your conditional exclusion from permitting as provided for under 40 CFR.122.26(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your No Exposure Certification, you are obligated to maintain no exposure conditions at your facility. if conditions change such that your facility can no longer qualify for the No Exposure Certification, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. You must self re -certify annually using the enclosed form or obtain NPDES permit coverage for any Stormwater discharges from your facility. The annual self re -certification does not need to be submitted unless requested. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. The SIC code that you had emailed me earlier is actually the NAICS code, not the SIC 4-digit code. We would like to speak with you on about the product which is being produced by the company, as well as about the possible permit for the site and the No Exposure Certification via telephone this Friday, March 23rd, at 10:30 am, if this is workable. Also, since the plant will not be operational until July 2018, an inspection will not be necessary until the plant is actually in operation. In my previous email I had incorrectly stated that if the facility meets the criteria for the No Exposure Certification, a Stormwater Pollution Prevention Plan would be required. A Stormwater Pollution Prevention Plan does not need to be developed if your facility has a No Exposure Certification. If the industrial activity in regards to the production of the expandable graphite is indoors, it is possible that the facility could qualify for No Exposure Certification. Please see the attached document which provides information in making this determination. If the facility did qualify for the No Exposure Certification, a Stormwater Pollution Prevention Plan would still be required, but not the Analytical and Qualitative Monitoring at the two outfalls on the site. if you did feel that the facility does qualify forthis Certification, I would plan an inspection on Monday, March 26`h, at 10 am, to verify that current conditions at the facility do qualify it for the No Exposure Certification. PF .t We investigated the "dark discharge from the drains / roof' and found that it does not come from the roof or the drains, it is merely black algae that grows on the blacktop from it continually being wet and having a food source like concentrated tree pollen as the drains discharge dew water from roofs almost daily. While it appears ugly, it is completely natural and harmless, and poses no threat to the environment. The dark areas were quite wet this morning from dew drainage, and I was able to scrape up clumps of the algae with my hands, and it was obvious from the texture and odor that it was simple algae growth. I was also able to find more about it black algae growing in front of roof drain discharges on the internet as confirmation. Non -Compliance Exposure Inspection Response Good afternoon, Travis, I relayed to Mike Lawyer the observations made earlier today during the inspection at your facility, Asbury Graphite of North Carolina, Inc. There is a concern about the roof drains and the dark discharge evident from the drainage pipes. We are requesting that you do further investigation of the top of the roof to determine the specific cause of this discharge. Also, the discharge from all the drains should be cleaned up. It is not advised to use water to wash it off but rather to sweep up these residues. The work should be completed by April 12, 2019 and I will plan a reinspection of the facility on Monday, April 151h. Do you know if the white boxes on the building roofs are air vents?
