STORM WATER DIVISION CODING SHEET NCG PERMITS PERMIT NO. NCGNE O L) DOC TYPE El HISTORICAL FILE DOC DATE ❑ V) O I I YYYYMMDD RECEIVED SEP 11 2018 Environmental Quality C' DrNR-LAND QUALITY T Division of Energy,cMiHW.iRarid,.il?!ig ,Resources Land Quality Section National Pollutant Discharge Elimination System NO EXPOSURE CERTIFICATION for Exclusion NCGNE0000 FOR AGENCY USE ONLY Dale Received Year Month Day LNIl:!(;IIC1VT `I-t" .i,. National Pollutant Discharge Elimination System application for exclusion from a Ttor on NO EXPOSURE: SEP.112013 Submission of this No Exposure Certification constitutes notification that your facility does not require a permit for stormwater discharges associated with industrial activity in the State of North Carolina because it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt and/or runoff. For permitted facilities in North Carolina, DEMLR must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide by the terms and conditions of the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are lightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you certify that a condition of no exposure exists at this facility or site and are obligated to comply with the terms and conditions of 40 CFR 1 22.26(g). If approved, your conditional No Exposure Exclusion has no expiration date BUT MUST BE self re -certified at least annually. Please look for information about re -certification under the No Exposure section on this page: httpsaHdea. nc.gov/about/divisions/energy-mineral-land-resources/energy-mineral-land-perm itslstormwater- For questions, please contact the DEMLR Regional Office for your area. Industrial activities at the facility include laboratory product distribution and solution manufacturing. From the Mecklenburg County GIS system it was determined that.the facility discharges stormwater to an unnamed tributary to Kings Branch along the northern and western sides of the facility (manufacturing building). The facility had the following industrial materials outside and exposed to stormwater: • Two general waste dumpsters equipped with lids and drain plugs • Two cardboard dumpsters equipped with lids • Multiple empty 55-gallon drums that were sealed and did not show signs of leakage. However, there were signs of historical leakage on the asphalt near the "empty" drum storage area on the northwest side of the facility (behind manufacturing building). The staining was attributed to unauthorized cutting of drums on site by a drum recycler. The staining did not appear to be affecting stormwater discharges from the facility. This area drains to a vegetated area before reaching the unnamed tributary. Pictures of the staining were taken during the inspection and will be kept on file. The following requirements were conveyed to the facility contact during the inspection: • To obtain/maintain No -Exposure there shall be no cutting, opening, draining, or other manipulation of the "empty" drums while stored outside the facility. Any manipulation will nullify No -Exposure and the permittee would need to apply for coverage under an industrial stormwater permit. • The general waste dumpster near the main storm drain inlet should be replaced since there was a gap in the metal at the bottom weld seam. There was no liquid in the dumpster on the day of the inspection. If liquids were introduced into the dumpster they could exit the dumpster and cause exposure. This would nullify No -Exposure Certification. Page: 2 NCDENR North Carolina Department of Environment and Natural Resources Division of Water Quality Beverly Eaves Perdue Coleen H. Industrial activities at the facility include laboratory product distribution and solution manufacturing. From the Mecklenburg County GIS system it was determined that the facility discharges stormwater to an unnamed tributary to icings Branch along the northern and western sides of the facility (manufacturing building). Pictures of the staining were taken during the inspection and will be kept on file The following requirements were conveyed to the facility contact during the inspection: • To obtain/maintain No -Exposure there shall be no cutting, opening, draining, or other manipulation of the "empty" drums while stored outside the facility. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DWQ must approve your application for No Exposure Certification before this exclusion is effective. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual (outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you certify that a condition of no exposure exists at this facility or site and are obligated to comply with the terms and conditions of 40 CFR 122.26(g)..,:.:-.
