Based on your submittal and signed certification of no exposure at the above referenced facility and the site visit of September 2, 2011, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North Carolina regulations. We are also hereby rescinding your current permit Certificate of Coverage, NCG190004. Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no - exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a No - Exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your Stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Industrial activities performed at the facility include marina operations. The facility discharges storrnwater to Lake Norman via one drop inlet (near the two storage buildings) and sheet flow over the impervious surfaces (concrete/asphalt). The facility conducts the following industrial activities: "� ---- - - • Boat fueling: there was no evidence of spills during inspection. Fuel is stored in a 10,000-gallon underground storage tank. Booms are located at the docks to contain any petroleum releases from docked boats or the fueling operations. • Forklift maintenance: is performed on site but within a secondary containment unit as noted by the facility contact (B. Young) • Boat pump -out services: the marina is equipped with two separate units. One unit is for commercial tenant (large "party/charter" boat) and a second unit is reserved for any other boat owners needing this service. Maintenance on the pump -out facilities is performed by Kings Point marina personnel. Facility contact believes wastes are conveyed to CMUD collection system. • Boat maintenance - Talley Pier 77 Marine: tenant performs most of the vessel maintenance at the site in a stand-alone building. A used -oil tank and its containment structure are located on the east side of building. There was no evidence of spills from the maintenance activities from Talley Pier 77 Marine on the concrete in front of the maintenance building during the inspection. • Boat maintenance/washing — boater owners have the option of hiring their own contractor(s) to perform maintenance on their boats. All outside contractors must be checked in at the marina office before performing work. They are directed to perform maintenance in the gravel area across from the two dry storage buildings. The gravel area is adjacent to the ,Talley Pier 77 Marine building. There was no staining on the gravel or concrete in this area. This area is designed to allow infiltration of stormwater. The following requirements are required to maintain No -Exposure: • The No -Exposure Certification is being issued to the marina. Therefore, the marina will be responsible for ensuring that No -Exposure conditions are met by Talley Pier 77 Marine (tenant) and any other contracted personnel hired by boat owners using the marina. • Detergents used to wash boats shall have a neutral pH and shall be biodegradable. Only cold water shall be used to clean the boats; heating of the water is prohibited. No engine cleaning shall occur in the gravel area. No chemicals shall be disposed of in the gravel maintenance area. • Facility personnel must ensure that stormwater from the gravel maintenance area does not migrate and discharge to the drop inlet between the dry storage buildings.
