The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES Stormwater
Permitting form. Based on your submittal and signed certification of no exposure at the above referenced facility, the
site visit of April 13. 2009 by Ms. Allocco of this Office, and the repair of the sewer line at the rear of your facility, the
Division is granting your conditional exclusion from permitting as provided for under 40 CFR i26.22(g), which is
incorporated by reference in North Carolina regulations. -We are also hereby rescinding your current individual
stormwater permit, NCS000357.
Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -exposure
conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure
exclusion, you are obligated to immediately obtain N PDES permit coverage for your stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge Your conditional no -
exposure exclusion expires in five years (June 17, 2014). At that time you must re -certify with the Division, or
obtain NPDES permit coverage for any stormwater discharges from your facility.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

Inspection Summary:
The permittee notes that all stormwater discharges along two ditches on either side of the facility to a UT of Little Sugar Creek.
There was no evidence of staining or stormwater impact at the Loading docks/Shipping area and the adjoining cardboard dumpster
was covered The general trash dumpster was not covered but was under roof There were no ASTs that required secondary
containment.
During the site visit DWQ personnel observed an illicit sewer discharge to the asphalt area near the generai trash dumpster. The
discharged wastewater was running through residuals on the asphalt from the general trash dumpster and had stained the asphalt
leading to one of the two stormwater ditches on site.
The permittee was instructed to fix the sewer leak before a No Exposure Certification would be granted.
The permittee forwarded pictures of the repaired sewer pipe to M. Allocco on 4/15/09 to qualify for No Exposure.
Please note that if this pipe is broken in the future Monarch Color will need to have it repaired immediately to continue coverage under
the No Exposure Certificate (NCGNE0593). Failure to repair any future leaks in a timely manner will require Monarch Color to reapply
for a stormwater permit.

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity In the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
Industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DWQ must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.

Material handling activities Include the storage, loading and unloading, transportation, or conveyan CD of

I certify under penalty of law that I have read and understand the eligibility requirements for claiming a condition of "no
exposure" and obtaining an exclusion from NPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to submit a no exposure certification form once every five (5) ygars to the North Carolina
Division of Water Quality and, if requested, to the operator of the local municipal separate storm sewer system (M54) into
which the facility discharges (where applicable). l understand that I must allow the North Carolina Division of Water
Quality, or MS4 operator where the discharge is into the local MS4, to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of
law that this document and all attachments were prepared under my direction or supervision in accordance with a system

NCDENR Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, retard, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
(Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine
not to exceed ten thousand dollars ($10,000).

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the
inspection conducted at the subject facility on March 3, 2009, by Mr. Ron Eubanks of Charlotte -
Mecklenburg Storm Water Services (CMSWS). This inspection was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water Quality.
In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with
the City's NPDES Permit, NCS000240, Part II Section H. Thank you for your assistance and
cooperation during the inspection.
The inspection found that the permittee's Stormwater Pollution Prevention Plan had been
developed and implemented but no semi-annual Qualitative monitoring had been performed in
violation of your individual stormwater permit. Pursuant to G.S. 143-215.6A, a civil penalty of not
more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who
violates or fails to act in accordance with the terms, conditions, or requirements of any permit
issued pursuant to G.S. 143-215.1. However, since the permittee has requested and will be
granted No Exposure the inspection was not issued as a Notice of Violation. Further information
regarding your No Exposure Certification request wilt be forwarded under separate cover.

Your facility is currently covered for stormwater discharge under NPDES Permit NCS000357. This permit expires
on December 31. 2001. North Carolina Administrative Coe (15A NCAC 2H.0105(e)) requires that an application
for permit renewal be filed at least 180 days prior to expiration of the current permit. In order to assure your
continued coverage under your permit, you must apply to the Division of Water Quality (DWQ) for renewal of
your permit. To make this renewal process easier, we are informing you in advance that your permit will be
expiring. Enclosed you will find an individual permit renewal application form. supplemental information request.
and Stormwater Pollution Prevention Plan certification.
Filing the application form along with the requested supplimental information will constitute your application for
renewal of your permit. The application form must be completed and returned along with all requested information
by July 4. 2001 in order to constitute a timely renewal filing.
Failure to request renewal by July 4. 2001 may result in a civil assessment of at least S500.00. Larger penalties
may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to 525,000 per day.
