Based on your submittal and signed certification of no exposure at the above referenced facility, the site visit of April 13. 2009 by Ms. Allocco of this Office, and the repair of the sewer line at the rear of your facility, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR i26.22(g), which is incorporated by reference in North Carolina regulations. -We are also hereby rescinding your current individual stormwater permit, NCS000357. Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure exclusion, you are obligated to immediately obtain N PDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge Your conditional no - exposure exclusion expires in five years (June 17, 2014). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. There was no evidence of staining or stormwater impact at the Loading docks/Shipping area and the adjoining cardboard dumpster was covered The general trash dumpster was not covered but was under roof There were no ASTs that required secondary containment. During the site visit DWQ personnel observed an illicit sewer discharge to the asphalt area near the generai trash dumpster. The discharged wastewater was running through residuals on the asphalt from the general trash dumpster and had stained the asphalt leading to one of the two stormwater ditches on site. The permittee was instructed to fix the sewer leak before a No Exposure Certification would be granted. The permittee forwarded pictures of the repaired sewer pipe to M. Allocco on 4/15/09 to qualify for No Exposure. Please note that if this pipe is broken in the future Monarch Color will need to have it repaired immediately to continue coverage under the No Exposure Certificate (NCGNE0593).
