I recently went to an NEC application site. The site is currently under the NCG05 permit. They are storing material used in their industrial process outside. I am currently maintaining that the facility does not qualify for NEC. The material outside (see attached photo) is rolls of raw paper that they will use for making cardboard. They have small tarp caps for them that protect the interior of the product, but to me, it is still exposed to the weather. I have called and discussed the issue with Mike Lawyer, and he concurs with my assessment. He recommended that I double-check with you. Thanks, Isaiah Isaiah L. This is consistent with EPA rules and EPA Guidance Manual for Conditional Exclusion from Stormwater Permitting, June 2000. When EPA promulgated that "No Exposure" provision of the stormwater permitting provisions of the CWA, it was the intent of EPA to provide regulated industries a simplified but effective way of complying with the goals and intent of the CWA— to preserve and improve the water quality of our rivers, streams, lakes, and regulated water bodies. If industries are able to certify that industrial processes and/or waste materials. which could contribute to stomrwater contamination, are not exposed to stormwater, industry can certify "no exposure". As such, these facilities are exempt from the stormwater permitting requirements. Per 40 CFR 122 and EPA Guidance Manual, EPA provides: Industrial materials and activities not requiring storm resistant shelter. . . "(and therefore exempt from stormwater permitting), include the following examples: To qualify for this exclusion, storm resistant shelter is not required for: (i) Drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak ("Sealed" means banded or otherwise secured and without operational taps or valves); (ii) Adequately maintained vehicles used in material handling; and (iii) Final products, other than products that would be mobilized in storm water discharge (e.g., rock salt) PCA maintains that roll stock is a final product and exempt from stormwater permitting. This is a final product and is a material that will not be mobilized if exposed to stormwater. The material will not degrade or deteriorate. The roll stock is capped preventing any degradation or migration of contaminates to stormwater. In reviewing examples set forth by EPA (drums, barrels, tanks, and similar containers) that are tightly sealed and not deteriorated are exempt, finished roll stock is clearly a material/item that will not contribute to stormwater contamination and qualifies for "no exposure" certification. 0 0 Facilit Name: . The Regional Office may also inspect your facility at any time in the future for compliance with the No Exposure Exclusion. North Carolina General Statute 143-215.6 13(i) provides that: Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental Management) Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten thousand dollars ($10,000).
