Mike Thomas of the Winston-Salem Region office of the North Carolina Division of Water
Quality conducted a site visit of the Cemex facility in King, North Carolina on 31 August 2011. The
purpose of this site visit was to confirm that no industrial activity is currently taking place. Your recent
request to discontinue stormwater monitoring while no industrial activities take place was approved,
based on the following conditions:
• The Stormwater Pollution Prevention Plan (SPPP) shall be kept updated to reflect the status of the
facility. It should note that no stockpiles or wastewater of any kind are to be stored on the site, and
that no industrial activities are to take place while the site is not active.
• Qualitative monitoring and Analytical monitoring do not have to be conducted as long as the above
conditions and all other permit conditions are met,
• The annual permit fee will still be due as usual.
+ This office must be notified prior to commencing any industrial activity on the site, even if just
temporary or short-term. If any changes are to be made, a prior Authorization to Construct may be
required.

CEMEX is in receipt of your correspondence dated September 24, 2009. Regarding the Compliance
Evaluation Inspection done by Mr. Ron Boone, CEMEX is providing responses to the violations
discovered as well as solutions to correct deficiencies. It should be clarified that the King plant has not
been operating since 2007. Recently in June 2009 the plant re -opened and it is still not a fully producing
plant. Due to the nature of current business, the King plant will open only as needed and not on a full-time
basis. Our responses are as follows:
— "Documentation and Monitoring Review, Item 3 " During the inspection it was noted that the
Stormwater Pollution Prevention Plan (SP3) had not been fully implemented, including training,
SDO certification, and annual review. The King plant has been closed for nearly two years and it
is the basic reason why the SP3 had not been updated or monitoring done. The SP3 is currently
being fully updated. There were no full-time personnel assigned for this plant. When it re -opened
in June 2009 personnel from other plants were moved to this location. Training documents from
other locations are being copied and inserted into the updated SP3. Also, SDO certification will
be done as soon as possible-
- "Documentation & Monitoring Review, Item 4" During the inspection it was noted that no
analytical monitoring had been done. Again, the King plant remained closed for at least two
years, however since re -opening in June 2009, we have tried to collect a sample but adequate
rainfall at appropriate times was not possible for us to collect a sample. Plant personnel have been
instructed to collect a sample as soon as possible for laboratory analysis.
— "Site Review —Item 7" During the inspection it was noted that there was not a closed valve to
drain the containment area for the diesel tank and admixture tanks. The containment area will be
reinforced and an appropriate drain valve, which will remain locked at all times, will be installed.
In addition, we are ensuring that the onsite drainage of stormwater runoff is directed to the appropriate
locations, i.e. Outfall 001. We are creating additional berms and replacing gravel berms on site to filter
runoff. These features will be added to the Site Plan in the SP3. The King plant will remain with only one
outfall.
Additional improvements for plant appearance are underway to manage potential sources of contaminated
runoff, such as relocating the lightweight material ground bins in order to drain to the retention basin. We
are also cleaning and grading areas of the retention basin.

The estimated timeframe to finish repairs brought up during the Compliance Evaluation Inspection is
October 16, 2009. In the meantime, if the weather permits, we will try to collect an appropriate sample for
analytical and qualitative monitoring purposes.

1. Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ)
conducted a compliance evaluation inspection (CEI) at the subject facility on 17 September 2009,
The assistance and cooperation during the inspection of Jack Marmet, Plant Manager, was greatly
appreciated. An inspection checklist is attached for your records and the inspection findings are
summarized below.
2. The facility is located at 320 Newsome Road, in King, Stokes County, North Carolina. Stormwater
related to industrial activity is discharged to Crooked Run Creek, which is currently classified as
Class WS-1V (water supply) waters in the Yadkin River basin.
Documentation & Monitoring Review
3. The Stormwater Pollution Prevention Plan (SP3) was reviewed and found to be complete.
However it has not been fully implemented. Most notably, training has not been accomplished
and documented as required, there was no certification for the stormwater discharge outfalls
(SDO), and it had not been reviewed annually. Please refer to Part 11 of the general permit for
details on what's required for the SP3 and ensure it is fully implemented.
4. Analytical and qualitative monitoring has not been accomplished as required. It is understood that
part of the reason for this is because the plant has been taken off line and started back up a
couple of times over the past many years. This also appears to be the reason for the SP3
deficiencies. Again please review Part 11 of the NCG140000 general permit in detail to ensure
Cemex meets all requirements with respect to development and implementation of the SP3 and
performing the required analytical and qualitative monitoring.

Site Review
5. The site appeared clean and well organized. There is a pond on the north side of the site into
which all process wastewater goes. The capacity of the pond is unknown but it had about 3 feet
of freeboard at the time of the inspection. Mr. Marmet stated that the pond never discharges.
6. The only SDO is 001, which is located on the southwest corner of the site. The area around 001
and the drainage area to it were both clean. There is a very minute amount of flow that sheetflows
off the asphalt driveway and into an adjacent stormwater ditch along 'Newsome Road at the
southeast corner of the site. Again, please ensure analytical and qualitative monitoring are
accomplished according to permit requirements.
7. The secondary containment, which house a diesel fuel tank, ad -mixture tanks, etc. has an open
drain in it. You must install a pipe and valve on the drain so the containment holds the liquids until
the drain is opened manually. The permit also requires all drain valves from secondary
containments to be locked in the closed position at all times except when in use to drain the
containment after inspection of its contents. Please repair the containment drain as soon as
possible.
8. You are reminded that violations of the NCG140000 general permit are subject to civil penalty
assessments not to exceed $25,000 per day, per violation. Please reply to this letter in writing
within 30 days of receiving it. Your reply should include corrective actions, with implementation
schedules, for each of the violations noted above in paragraphs 3, 4 and 7.

This certificate of coverage shall become effective November 14, 2008.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
