Dear Mr. Harris:
The City of Greensboro Stormwater Management Division has found that Guilford County Schools Garage,
located at 131 Franklin Blvd in Greensboro, North Carolina is in violation of City of Greensboro Code Chapter 30,
Article 12, Section 7.3 (A 1) which states:
"It shall be unlawful to use any stream or watercourse to carry off water from any kitchen sink, bathtub or
privy, or to carry off any fluid of an offensive or dangerous nature."
The violation was determined by Rebecca Wells of the Stormwater Management on October 9, 2012, following
and on -site observation at 131 Franklin Blvd, which revealed the following conditions:
Improper discharges from vehicle washing, vehicle maintenance activity in the garage bays, and an
unmaintained oiUwater separator are entering the stormwater conveyance system.
To comply with Chapter 30 of the City of Greensboro Code of Ordinances, it will be necessary to conduct the
following corrective actions:
1) Immediately cease improper discharges from vehicle washing.
2) Permanently cease improper discharges from all (22) floor drains inside the garage bays.
3) Clean out and properly maintain the oillwater separator so that it functions as designed.
4) Provide this office with written notification before November 16, 2012, explaining actions taken
to prevent future improper discharges to the stormwater conveyance system. Please send written

In accordance with the City of Greensboro Code of Ordinances, failure to comply with this notice may result in a
civil penalty of up to $5000 per day. Each subsequent violation is subject to incrementally increasing penalties of
up to an additional $5000 per day. Furthcrmore, any penalties assessed against the City by the State as a result of
the violation will be added to the civil penalty.
Stormwater Management staff will conduct a follow-up inspection/investigation on November 16, 2012 to ensure
compliance with the aforementioned ordinance.

On September 26, 2012 the City of Greensboro Stormwater Management Division completed an
industrial compliance inspection of the Guilford County Schools Garage. Local regulations
permit an inspection of industrial facilities under authority granted by City of Greensboro Code
of Ordinance Chapter 30, Article 12, Section 7.1 (C-5). This inspection consisted of two parts: a
review of the facility files/records and an on -site facility inspection.
The inspection was performed by Rebecca Wells, and the following deficiencies/observations
were noted during the inspection.
Stormwater Pollution Prevention Plan/Spill Plan Review
Site Maps and SWP3
♦ Include a general location map in the Stormwater Pollution Prevention Plan.
Spill Prevention and Response Plan
♦ Update/add the following to the Stormwater Pollution Prevention Plan:
Contact information (names, phone numbers, and other pertinent information)
Document how to properly dispose of materials after a spill.
Monitoring
♦ Conduct and document water quality sampling as required by your NPDES permit.
Include observation reports and/or quantitative results in the plan.
Employee Training
♦ Regularly train all employees on Stormwater issues and practices, spill response
procedures, and maintain specific, up-to-date training records to include in the plan.

Site Inspection
Preventative Maintenance/Good Housekeeping
♦ Cover exposed materials (batteries, engine parts, etc.) or move them to a sheltered
area in order to reduce contact with precipitation/stormwater runoff.
♦ Regularly maintain the oil/water separator in the fueling area.
Non-Stormwater Discharges
♦ No deficiencies observed.
Please note that Guilford County Schools has received a notice of violation from the City of
Greensboro regarding improper discharges to the slormwater conveyance system. These
improper discharges result from current vehicle washing, vehicle maintenance operations, and
an unmaintained oil/water separator.
Based on the above deficiencies, the City of Greensboro will notify the North Carolina
Department of Environmental and Natural Resources (NCDENR) and request a follow-up
inspection. Guilford County Schools Garage may be notified by NCDENR in advance of this
inspection so proper scheduling of personnel can take place. Furthermore, any penalties assessed
against the City by the State as a result of this non-compliance will be assessed against Guilford
County Schools Garage.

Reference is made to your May 17, 2002 request for rescission of the subject NPDES General
Permit. On the request form you state that the facility has been closed, structures removed and the site
razed, and therefore you no longer require coverage under the general permit. In accordance with your
request, NPDES General Permit NCGO80155 is rescinded, effective immediately.
Please be advised that this permit rescission is based wholly upon your statement that the
activities which would require general permit coverage at the site have ceased or been eliminated.
Division staff has not visited the site to obtain independent verification. Operating a treatment facility,
discharging wastewater or discharging specific types of stormwater to waters of the State without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement
action will be certain for persons that have voluntarily relinquished permit coverage when, in fact,
continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit
coverage, you should notify this office immediately. Furthermore, if in the future you wish to again
discharge to the State's surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would
inform the new or prospective owners of their potential need for NPDES permit coverage.

Discharge consists of fuel oil from property runoff during rainfall events. The approximate on site
storage capacity is 2550 gals (per staff report). Current monitoring requirement is oil &
grease,pH, Phenols, and flow. Since this facility is under 1 million gallon storage capacity, the
new SOP for storm water discharges from oil and petroleum facilities will apply [ref. memo to
regional wq supervisors 3/15/921. New requirements will be less stringent.
Technical Support recommends eliminating the requirement for phenols monitoring since the
discharge is not into a water supply. The region should note, however, that elevated levels appear
in the compliance monitoring system.

SPECIAL INSTRUCTIONS OR CONDITIONS
Pen -nit must contain flow monitoring requirement such that all volumes of wastewater leaving the
facility are monitored. If continuous monitoring is not feasible, then discharger shall record the
approximate times that discharge began and ended, along with instantaneous flow at the time of
effluent samping. Monitoring for all toxicants should be performed during the first five discrete
discharge events (annually thereafter) after the effective date of the NPDES permit. Monitoring
should occur at the same time that the whole -effluent toxicitiy sample is collected during the
discharge event (samples should be collected within 24 hours of the beginning of the event).

ACUTE TOXICITY MONITORING (EPISODIC)
The permittee shall conduct FIVE acute toxicity tests using protocols defined as definitive in
E.P.A. Document 600/4-85/013 entitled "The Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales
promelas) 24 hour static test, using effluent collected as a single grab sample. Effluent samples
for self -monitoring purposes must be obtained below all waste treatment. Sampling and
subsequent testing will occur during the fast five discrete discharge events after the effective date
of this permit. After monitoring of the fast five toxicity tests, the permittee will conduct one test
annually, with the annual period beginning in January of the next calendar year. The annual test
requirement must be performed and reported by June 30. If no discharge occurs by June 30,
notification will be made to the Division by this date. Toxicity testing will be performed on the
next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this
permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it
was performed, using the appropriate parameter code. Additionally, DEM Form AT-1 (original) is
to be sent to the following address:

Test data shall be complete and accurate and include all supporting chenucaliphysical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Environmental Management indicate potential impacts to the receiving stream,
this permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test.
Failure to submit suitable test results will constitute noncompliance with monitoring requirements.

greater than permitted limits or if a change in the wastestream occurs, then toxicity testing and/or

This facility discharges runoff from small fuel storage/transfer area. Springer -Eubank has reported
three "pass" results for toxicity. Technical Support concurs with WiRO's recommendation to
delete the toxicity testing requirement and the organics testing. [ref. 5/15/91 memo from A. Preston
Howard]. However, Tech Support suggests a grab sample be taken of the facility's effluent,
perhaps annually, to test for toxicty (in-house). Should the facility show acute toxicity, organics
monitoring would then be required.

The permitme shall conduct acute toxicity tests on a �y asis using protocols defined in the
North Carolina Procedure Document entitled "Pass/Fail Methodlogy For Determining Acute
Toxicity In A Single Effluent Concentration". The monitoring shall be performed as a Fathead
Minnow (Pimcphales �Qr .melas 24 hour static test, using effluent collected as a 24 hour
composite. The effluent concentration at which there may be at no time significant acute mortality
in any two consecutive toxicity tests is 90% (defined as treatment two in the North Carolina
procedure document). Effluent samples for self -monitoring purposes must be obtained during
representative effluent discharge below all waste treatment. The first test will be performed after
thirty days from issuance of this permit ern n ANNVALL-Y
All toxicity- testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month.in which -it was perfor-tamed, using the parameter
code TGE6C. Additionally, DEM Form AT-2 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of. Environmental Management indicate potential impacts to the receiving stream,
this permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate retesting (within 30 days of initial monitoring event). Failure to submit
suitable test results will constitute noncompliance with monitoring requirements.

It is felt that the proposed monitoring requirements for
this facility are excessive. Flow monitoring and recording is
not only impractical, but it is also not very meaningful. The
discharge occurs only as a result of rainfall and the dry ditch
does not appear to directly reach the river.
As the WLA form indicates, the organics valves have all been
< 0.2 ppb and all toxicity tests have received passing scores.
It is recommended that toxicity testing be required on an annual
basis. If the toxicity test is failed then organics monitoring
should be required. It appears that the acute P/F test is
appropriate rather than the full range test.

All volumes of wastewater leaving the facility must be monitored. If
continuous flow monitoring is not feasible, then discharger shall record
the approximate times that discharge started and ended, along with the
instantaneous flow at the time of effluent sampling.
Recommend monitoring for the attached list of parameters on the same
schedule as the toxicity test (first five discrete discharge events and
then annually after that). Monitoring and toxicity samples (grab samples)
should be taken at the same time, within 24 hours of the beginning of the
discharge event. A reopener clause should be placed in the permit to
allow for limits to be placed on toxicants should the facility fail its
whole -effluent toxicity test.

if using Cerioda hnia is TAA3B. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was

Review of the proposed Wasteload Allocation for Miller Oil Company in
Haywood County (NCO023221) shows recommended effluent.limits with
monitoring for lead, pH,and settleable solids, and turbidity,(instream)
in addition to oil & grease limitations contained in the existing
permit. Also, the=WLA recommends monitoring requirements for acute
toxicity, naphthalene, benzene, toluene, and xylene, purgeable,
and extractable organics. The justification for these additional
effluent limits is "Standard Divisional Procedure for Oil & Petroleum
Storage Facilities".
Laboratory analysis collected during a routine compliance
inspection on 2/21/89 after rainfall shows a pH of 6.2, lead at 13
ppb,.and oil & grease at 11 ppm. Considering these data and the
fact that a discharge from the oil/water separator depends upon
rainfall or storm events, and considering that there is a SPCC plan
with spill containment/controls in place, this office doesn't recommend
effluent limits for pH, lead or settleable solids. The runoff from
this area would approximate that of a parking lot except for the
pollutant potential caused be the presence of the oil storage units.
Oil & Grease limits and monitoring is appropriate;to determine the
effectiveness of the treatment facility. It is recommended that
monitoring requirements for lead be contained in the permit at a
frequency of quarterly with the months specified. Effluent limits for
lead should be added to the permit through a specific reopener clause
if the need is demonstrated by monitoring data. The wastewater covered
by this permit consists of storm water from parking areas, other
impervious areas, and overland runoff. Because the site is stabilized
with regard to erosion and runoff is expected to have no more turbidity
than would be expected from any other "developed" area, the Region
cannot support instream turbidity limits. It is recommended that this
requirement also not be included in the permit.

Even though the receiving stream, Farmer Branch, as well as Richland
Creek to which it is tributary consists mainly of urban drainage, it
bears a Class "B" classification due to the presence of Lake Junaluska
(downstream). As result, aquatic toxicity screening is reasonable.
Rather than include this requirement in the permit at this time, the
ARO will schedule an acute toxicity testing at this facility during
FY 89 and will address the results as appropriate and.consistent with.
standard screening activities. Any needed toxicity monitoring and/or
limits can be added to the permit ,via a reopener clause.
The WLA form includes several components of petroleum products as
targets for monitoring as well as a.recommendation for a permit
requirement to monitor all volumes of wastewater leaving the facility
and record the approximate time of discharge beginning and end.
Because of the nature of this discharge (storm water runoff), it is
not practical to provide this type of coverage. Discharge data should
continue to be provided when effluent samples are collected. Rather
than require monitoring for petroleum components, which are clearly
present in urban runoff, street storm water, service station runoff,
and other similar storm waters, the discharger should be required to
contain, clean up, and properly dispose of any spills or losses on the
site. In addition, the permitee should be required to report all
spills and confirm that appropriate clean-up action was taken. (The
spill prevention and control plan already addresses many of these
points, but inclusion in the permit is still appropriate.) The Region
recommends that the monitoring for the petroleum components not be
included in the permit.
In conclusion, the ARO recommends an effluent limits page
consistent with -that of the existing permit with the addition of a
monitoring requirement for lead, specific wording in the permit
concerning spill and loss control, and reopener clauses to allow lead
and aquatic toxicity limits and/or monitoring as determined necessary.
Division policy on the permitting of petroleum storage facilities
should be established in writing and with the concurrence of the
permitting, regional, modeling, and management staff. The controls and
reliability requirements for discharges from these type operations
should be consistent with downstream uses and practical considerations
of the risks they pose to the waters uses. Should you wish to d' cuss
this matter in more detail, please advise.

The permittee shall conduct FIVE acute toxicity tests using protocols defined in E.P.A. Document
600/4-55/01 7 entitled "The Acute Toxicity of Effluents to Fresliwater anti Marine Organisms''.
The monitoring shall be performed as a Daphnia up lex or Ceriodaphnia 4S hour static test, using
effluent collected as a single grab sample. Effluent samples for self -monitoring purposes must be
obtained below all \ aste treatment. Sampling and subsequent testing will occur during tile. first five
discrete cischarge events after the effective date of this permit. After monitoring of the first five
toxicity tests: the permittee will conduct one test annually, with the annual period beginning in
