On February 1, 2018, Glen White & Sue White, inspectors with the North Carolina Department
of Environmental Quality - Division of Energy, Minerals and Land Resources met with you and
Kim Burton (EHS Manager) at the facility located at 1149 Abtco Road in North Wilkesboro, to
conduct a compliance inspection as part of a complaint investigation received by the Division of
Water Resources permit. This inspection consists of review of the Stormwater Pollution
Prevention Plan (SPPP) and each of its components, review of Monitoring Records as well as
review of the facilities outfalls, containment facilities as well as review of the overall condition
of the site.
The complaint alleged that waste product materials were discharging from the facility and were
entering and contaminating the Yadkin River. Complaint also suggest that the facilities storage
areas exposed to the elements were poorly maintained. The housekeeping issues were verified.
No evidence of discharge to the Yadkin River could be identified.
Permit:
This facility holds General Stormwater Permit NCG070189 to discharge stormwater from
industrial activity associated with Stone, Clay, Glass and Concrete Products [SIC 321 under
the National Pollutant Discharge Elimination System (NPDES). The permit became effective
June 1, 2013 and is scheduled to expire on May 31, 2018. The facility will remain covered under
the permit, even after expiration, until the new general permit is issued by the Stormwater
Permitting Unit in the Raleigh Central Offices.
Records/Reports:
This facility was required to develop and maintain a Stormwater Pollution Prevention Plan
(SPPP) in accordance with Part II, Section A of the permit. All qualitative monitoring records
are required to be maintained with the SPPP for a minimum of five (5) years. Under this permit,
no analytical monitoring is required under current operating procedures. The facility records
currently appear to meet requirements of the permit.

Facility Site Review:
This facility manufactures siding used in commercial and residential applications. Product,
ready to be shipped, is wrapped in plastic to protect it from the elements, and it is stored outside
and behind the building.
Effluent Receiving Waters:
Effluent from this facility drains directly into the adjacent Yadkin River, class "C" waters of the
Yadkin Pee -Dee River Basin.
Self -Monitoring Program:
This facility is required to provide Qualitative Monitoring twice annually. No Analytical
Monitoring is required under current operating procedures. While this facility was found to be
compliant with the requirements of its General Stormwater Permit (NCGO70189), several
deficiencies were found.
The following determination and recommendations were made by DEMLR Staff:
This facility is covered under the NCG070189 Stormwater Permit. The permit only
requires Qualitative Monitoring under current operating procedures. DEMLR does
reserve the right to modify this requirement and may require Allura to begin providing
Analytical Monitoring or to obtain a more restrictive Individual Permit if the issues
cannot be effectively addressed in a timely manner.
• Provide a clear grassed path to each outfall for ease of access for maintenance and
monitoring of each outfall.
• Please have waste product material hauled offsite each week to prevent large stockpiles
of waste from accumulating on the grounds, as is the current condition.
• Remove accumulated waste metal, plastic and wood materials from the facility and haul
to an approved landfill facility.
• Provide better general housekeeping for all outside areas of the facility to be proactive in
preventing pollutants from this facility from reaching the adjacent Yadkin River.

Inspection Summary:
On February 1, 2018, Glen White and Sue White of NCDEQ - DEMLR visited the Allura facility located at 1149 ABTCO Rd
in North Wilkesboro to follow-up on a complaint recieved by the division. Inspectors met with Stephen Phelps (Senior Plant
Engineer) and Kim Burton (EHS Manager). The SPPP and records were reviewed and the outfalls and areas of complaint
were visited.
Determinations and reccomendations made by DEMLR Staff:
1. This facility is covered under the NCG070189 Stormwater Permit. This permit only requires Qualitiative Monitoring be
conducted on a semi-annual basis., DEMLR does reserve the right to modify this requirement and man require Allura to
begin providing Analytical Monitoring or to obtain a more restrictive Individual Permit if issues cannot be effectively addressed
in a timely manner.

(DEMLR) conducted a compliance evaluation inspection at the subject facility on September 16, 2015. Your
assistance throughout the process was greatly appreciated. An inspection checklist is attached for your
records and the inspection findings are summarized below.
1. Permit
This facility holds General Storm water Permit No. NC070189 to discharge Storm water from activities
associated with Stone, Clay, Glass and"Concrete Products and like activities under the National Pollutant
Discharge Elimination System (NPDES)• The permit became effective June 1, 2013 and expires May 31, 2018.
Your permit renewal package must be received in the Central Office in Raleigh no later than 180 days prior to
the expiration date of the permit.
2. Records/Reports
Part II, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP).
The plan must include all nine (9) subsections of Part il, Section A of the permit. An updated copy of the
SPPP was available for review at the time of inspection. Qualitative monitoring is required to be completed
and documented twice yearly as defined in Part II, Section C of the permit. The SPPP plan must be updated
annually and qualitative monitoring must be conducted and properly documented semi-annually to retain
compliance with the permit.

3. Facility Site Review
This site manufactures siding used in commercial and residential applications. Much of the product ready for
shipping is stored outside behind the building. It is protected from the elements by plastic wrapping
material. Site was clean and neat.
4..Effluent/Receiving Waters
Stormwater from this site drains into outfalls that empty into the Yadkin River or outfalls that empty directly
into the Yadkin River, which is adjacent.
5. Self -Monitoring Program
Analytical Monitoring: This site is not required to provide analytical monitoring under current operating
procedures.
6. Qualitative Monitoring: All qualitative records do not need to be submitted to DEMLR, however, the
records must be kept on file at the facility for a period of five years. Bi-annual monitoring has been done in
the past as required per the permit. The latest monitoring was done in March 2015. The next one is just
now coming due.
7. Outfails:
All outfalls were observed at this time of inspection. A path needs to be cleared to outfall six (6) so that
monitoring can be easily and safely accomplished.

ASSIGNMENT AND ASSUMPTION, BILL OF SALE AND CONVEYANCE
THIS ASSIGNMENT AND ASSUMPTION, BILL OF SALE AND
CONVEYANCE (this "Assignment") is made and entered into as of February 1, 2014 by and
between CertainTeed Corporation, a Delaware corporation (the "Seller"), and Plycem USA, Inc.,
a Georgia corporation (the "Buyer").
BACKGROUND
A. The Buyer and the Seller are parties to that certain Purchase Agreement,
dated December 18, 2013 (the "Purchase Agreement"), pursuant to which the Seller has agreed
to: (i) sell, convey, grant, assign, transfer and deliver to the Buyer, and the Buyer has agreed to
purchase and acquire and accept from the Seller, the Conveyed Assets free and clear of all Liens;
and (ii) assume the Assumed Liabilities.
B. Initially capitalized terms not defined in this Assignment shall have the
meanings ascribed to such terms in the Purchase Agreement.
TERMS
NOW, 'THEREFORE, in consideration of the foregoing premises and of the
mutual covenants hereinafter set forth, and for other good and valuable consideration, the receipt
and sufficiency of which are hereby acknowledged, the parties hereto, intending to be legally
bound, hereby agree as follows:
ARTICLE I
TRANSFER OF CONVEYED ASSETS AND ASSUMPTION OF ASSUMED
LIABILITIES
1.1. Transfer of Conveyed Assets, The Seller hereby sells, conveys, grants,
assigns, transfers and delivers unto the Buyer all of the Conveyed Assets free and clear of all
Liens. The Buyer hereby accepts such sale, conveyance, grant, assignment, transfer and delivery.
1.2. Assumption of Assumed Liabilities. The Buyer hereby assumes, and shall
discharge and pay when due, the Assumed Liabilities, in each case in accordance with the terms
and conditions in the Purchase Agreement.
ARTICLE 11
MISCELLANEOUS
2.1. No Waiver or Modification; Sub'ect to Purchase A reement. Nothing
contained in this Assignment may be construed as a waiver of any rights or remedies of the
parties hereto as set foth in, or arising in connection with, the Purchase Agreement or any other
instrument or document delivered by the parties hereto pursuant to the Purchase Agreement. This
Assignment is not intended to limit in any manner the terms of the Purchase Agreement nor is it
intended to create any obligation broader than those specifically set forth in the Purchase
Agreement. in the event of a conflict or inconsistency between this Assignment and the Purchase
Agreement, the terms of the Purchase Agreement shall prevail. Neither this Assignment nor any

term hereof may be changed, waived, discharged, or terminated other than by an instrument in
writing signed by the parties hereto. No failure to enforce any provision of this Assignment shall
be deemed to or shall constitute a waiver of any other provision hereof nor shall such waiver
constitute a continuing waiver. This Assignment is subject to all of the representations,
warranties, covenants, exclusions and indemnities set forth in the Purchase Agreement.
2.2. Binding Effect; Successors and Assigns. This Assignment shall be
binding upon and inure to the benefit of the parties hereto and their respective successors and
assigns.
2.3. Counterparts; Effectiveness. This Assignment may be executed in two
counterparts, each of which shall be deemed to be an original but both of which shall constitute
one and the same agreement. This Assignment shall become effective when each party hereto
shall have received counterparts thereof signed and delivered (by telecopy or other electronic
means) by the other party hereto.
2.4. Governing Law. THIS ASSIGNMENT AND THE LEGAL RELATIONS
BETWEEN THE PARTIES HERETO SHALL BE GOVERNED BY AND CONSTRUED IN
ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK, WITHOUT REGARD
'1'O THE CONFLICT OF LAWS RULES THEREOF (OTHER THAN SECTIONS 5-1401 AND
5-1402 OF THE NEW YORK GENERAL OBLIGATIONS LAW).

primarily for industries engaged in: Stone, Clay, Glass, and Concrete Products. Qualitative Monitoring is
required per Part II, Section B. Please insure the monitoring for this requirement is performed as required in the
pen -nit.
In a letter from the Division dated August 27, 2010, analytical monitoring is required for COD, TSS, and pH.
This is further discussed in the section, Self -Monitoring Program, of this report.

The site inspection showed a chemical loading area from rail trains. The storm grate is sealed when off loading
is performed.
There is concrete fiber siding stored on the impervious areas of the facility. The product is sealed in a Certain

Self -Monitoring Program
As discussed the following Outfalls will apply:
Outfall #001 - Certain Teed stormwater draining from the storage yard to a vegetative ditch and
discharging to the Yadkin River.
Out fall #002 - Certain Teed stormwater draining from an adjacent storage area and discharging to the
Yadkin River.
Outfall #006A — Certain Teed stormwater from the roof drains to a black rib Culvert in the manhole.
The bottom of the manhole receives water from LP.
Outfall #006B - Certain Teed stormwater from the front unloading area of the building to a concrete
Culvert in the manhole. The bottom of the manhole receives water from LP.
Please prepare a schematic showing the Outfall sampling points and a description of how the sample is

collected. Please submit this at the sample you complete the required sampling.
During our meeting it was discussed that Certain Teed will collect analytical samples for COD, TSS, and pH
from each of the above outfalls. There will be a monthly sample collected, for each parameter described above,
during each month from October through December 2010. (three (3) sample sets from each outfall) During
January 2011 the analytical samples will be submitted to this office to compare the COD, TSS, and pH against
the benchmark values in the NCG210000 permit. if the analytical results demonstrate that the outfalls will not
exceed benchmark values the analytical monitoring, as described in the August 27, 2010 letter, will no longer be
required.
The compliance evaluation inspection is satisfactory. Mr. Hurley is going a very good job implementing the

NPDES general permit. This pen it is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between Nofih Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Additional monitoring for this site is required because the anal yt ,_al.monitoring taken for
the site's current permit (NCG210340) has values over the current benchmarks. This facility
should be covered under the NCG07 (Stone, Clay, & Glass) but has'beeti covered under an
NCG21 (Timber). Therefore, samples must be taken to determine if the parameters over the
benchmarks are coming from stormwater associated with the CertainTeed Facility. The following
analytical monitoring should be performed until the Winston Salem Regional -Office has adequate
data to show parameter benchmark exceedances are not because of stormwater coming from
CcrtainTeed's facility. If the samples indicate that parameters are over the benchmarks because of
stormwater coming from the CertainTeed site then an individual permit may be required at that
time.

In accordance with your application for a discharge permit received on June 25, 2010, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
'General Statute 143-215.1 and the Memorandum of Agreement between North'Carolina and thc:
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Additional monitoring for this site is Yequired because the analytical monitoring taken for
the site's current permit (NCG210340) has values over the current benchmarks. This facility
should be covered under'the NCG07 (Stone, Clay, & Glass) but has been covered under an
NCG21 (Timber). Therefore, samples must be taken to determine if the parameters over the
benchmarks are coming from stormwater associated with the CertainTeed Facility. The following
analytical monitoring should be performed until the Winston Salem Regional Office has adequate
data to show parameter benchmark exceedances are not because of stormwater coming from
CertainTeed's facility. If the samples indicate that parameters are over the benchmarks because of
stormwater coming from the CertainTeed site then an individual permit may be required at that
time.

Required analytical monitoring: Analytical monitoring shall continue according to the NCQ''`,
permit for COD, TSS, and pH. Pipe 006 will be sampled at two locations on Certain Teed
,property during representative rain events. These samples will be used to determine the pollutants.;

process.
In accordance with your request for coverage under NCG07, we are rescinding your
NCG21 Perrnit. Certificate of Coverage Number NCG200338 is rescinded effective immediately.
Please take notice that this certificate of coverag is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirement:, to obtain other pen -nits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources,
Coastal Area Management Act or any other federal or local governmental permit that may be
