1. Clean up the compactor area at Building 611-6, Dock Al. Ensure all cigarette filters stay
inside compactor bin at all times.
2. Install dumpster plugs where they are absent or broken.
3. Update the Stormwater Division's contact information on RJR'S Spill Notification List
4. Clean the oil leak around the tractor and repair the oil leak on tractor. Once discovered,
RJR'S must clean up residual oil leaks.
5. Increase the frequency of your outdoor clean-up schedule for preventing pollutant exposure
to the open environment. Examples include: grease rendering bin, oil leak from tractor, etc.
6. Implement nonstructural BMPs near Building 603-1 (G-7 Process facility) at the tobacco
waste dumpster in order to prevent contamination into RJR's stormwater collection system.
7. Ensure that transfer hoses do not leak glycerin from their holding containers at all times.
8. Remove remaining product from 250 gallon AST tank and dispose in accordance with all
applicable federal, state, and local regulations.
9. Determine the connectivity of the stormwater collection trench at Dock #61, Building 611-
12. If trench is connected to RJR's stormwater conveyance system, ensure a spill kit is
ready accessible for employee use.
10. Fix the broken grates at Dock #61, Building 611-12.
11. Denote the city of Winston-Salem as the receiving MS4 on your general map.
12. Complete the Industrial Activity fields on your qualitative monitoring reports for 10/11/13.

In the fall of 2012, it was discovered that stormwater runoff from the area surrounding Buildings
605-7, 605-10 and 605-12 of the R. J. Reynolds Tobacco Company (RJRT) Whitaker Park
facility discharges to the north onto property formerly owned by RJRT. Since this discharge is
now an outfall for the Whitaker Park facility, we have identified it as outfall number seven (SDO
007). This outfall has a drainage area of approximately ten acres of RJRT property.
Stormwater is collected from the roofs of Buildings 605-7, 605-10 and 605 -12 and parking
areas and roads surrounding these buildings. Therefore, it has very limited exposure to
potential stormwater contaminants and would have similar or fewer contaminants as
measured in outfall number one (SDO 001).
In 2011, Mr. Ron Boone of your office determined that stormwater discharge outfall number
one (SDO 001) be granted Representative Outfall Status (ROS) for outfalls two, three, four, five
and six (SDO 001-006). RJRT hereby requests that outfall number seven (SDO 007) be
included with ROS by sampling outfall number one (SDO 001). Please see the attached
completed ROS request form.
The facility's Stormwater Pollution Prevention Plan has been updated to include outfall number
seven (SDO 007), including its location and drainage area, as per attached drawing E-15387-017.

permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative

permittee may petition the Director far Representative Outfall Status (ROS). DWQ may grant Representative
Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analyticasampling requirements apply.
If Representative Outfall Status is granted, ALL outfalls are still subject to the qualitative monitoring
requirements of the facility's permit —unless otherwise allowed by the permit (such as NCGO20000) and DWQ
approval. The approval letter from DWQ must be kept on site with the facility's Stormwater Pollution
Prevention Plan. The facility must notify DWQ in writing if any changes affect representative status.

In response to your renewal application for continued coverage under stormwater General Permit NCG060000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG060000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/weblwq/ws/sulcurrent-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
• Part 11:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (0&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts ill and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a„renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,

to begin sampling the NCG500000 related discharge from the Bowman Gray Technical Center
facilities; that is, to cease measuring temperature at location WPNS119, and instead measure it at
SDO 002, as the condensate is discharged into the stormwater system. However, RJRT must still
sample upstream and downstream of the point at which this wastewater actually enters Silas
Creek, as required in the general permit.

The purpose of this letter is to respond to your Compliance Evaluation Inspections letter
dated January 14, 2011.
General Stormwater Permit NCG060000, Certificate of Coverage NCG060080
R.J. Reynolds Tobacco Company (RJRT) requests representative outfall status for_,
,stormwater discharge outtall number one (SDO 001),at the Whitaker Park facility under
General Stormwater Permit NCG060000. Certificate of Coverage NCG060080. The
Whitaker Park facility encompasses a total of 193.2 acres. Stormwater from 123 acres
(64%)-of.the facility discharges at SDO 001 ;This includes 102 acres of impervious area-
(:70%- of total impervious area) and a greater percentage of the manufacturing and
production operations. This information is portrayed on the two drawings enclosed (E-
15387-017 and E-15387-018) showing the eastern and western portions of the facility and
the drainage areas for each outtall. The latitude and longitude of each outtall were also
added to the drawings for reference. Stormwater flow direction is shown by arrows for
overland flow and within storm sewers on the drawings.
Stormwater discharge outfalls two, four, five, and six (SDO 002, 004, 005, and 006) have
no exposure to potential stormwater contamination. SDO 002 and 005 are located at
research and development facilities. SDO 004 is located in an area with limited activity.
SDO 006 is located at the Shorefair facility. These facilities have covered loading; docks,
covered dumpsters, and no storage areas outdoors. Stormwater discharge outtall three
(SDO 003) includes areas of limited activity and potential exposure to stormwater
contamination. Most of the drainage area of SDO 003 included storage sheds which have
been raised.

General Wastewater Permit NCG500000, Certificate of Coverage NCG500096
Steam condensate is discharged to the storm sewer at four locations within the Bowman
Gray Technical Center facilities. Condensate enters the storm sewer at catch basin CB103
located north of the northeast corner of Building; 611-6 and at manhole MH100 located

north of Building 611-2. CB103 and MH 100 discharge through the storm sewer to SD03.
Condensate also enters the storm sewer at manhole MH86 located north of the northeast
corner of Building 611-4 and at manhole MH77 located north of Building 611-9. MH86
and MH77 discharge through the storm sewer to SD02.
Monitoring for condensate discharge to the storm sewer previously included sampling
four locations. A sample from the intake of the storm sewer system (WPSD002) and a
sample from Silas Creek (WPSD001 have been analyzed for pH, temperature, and flow
rate. Two additional samples have been collected to measure the water temperature
(WPNS110 and WPNS 1l9). We propose to stop measuring temperature at location
WPC 9 and instead measure temperature at SD02. The WPNS 119 sample location is
downgradient of WPSD001 in Silas Creek. SD02 is at the outfall of the storm sewer
from the facility. Upon approval of the change in sampling locations, we will notify
Research & Analytical Labs.

1. Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ)
conducted compliance evaluation inspections (CEI) at the subject facility on the subject permits on
December 15, 2010. Your assistance and cooperation during the inspection, as well as that of
Chris Hay, was greatly appreciated. Inspection checklists are attached for your records and
inspection findings are summarized below.
2. The facility is located at 1001 Reynolds Boulevard, in Winston-Salem, Forsyth County, North
Carolina. Stormwater related to industrial activity is discharged to Silas Creek, which is currently
classified as Class C waters in the Yadkin Pee Dee River basin. It is not known for certain at this
time whether there still is a wastewater discharge from the facility regulated by NCG500096.

3. The Stormwater Pollution Prevention Plan (SP3) is complete, current and has been implemented.
Mr. Boone noted the following items:
a. Stormwater training should be conducted and documented annually for all those personnel
involved in any of the facility's operations that have the potential to contaminate stormwater
runoff. The facility has conducted and documented training but Mr. Boone felt it necessary to
reiterate the requirements.

b. The site plan does not clearly define the individual drainage areas that drain to each of the five
outfalls and it does not include arrows that indicate the direction of flow within each drainage
area.
c. Each of the five stormwater discharge outfalls (SDO) should be identified on the general
location map along with accurate latitudes and longitudes.
Please take note that as part of the annual review of the SP3, the list of spills should be updated
and the SDOs should be recertified. Please refer to Part 11, Section A, Paragraph 7 of the general
permit for more details.
4. Monitoring is only being conducted at SDO 001 and there is no documentation of representative
outfall status (ROS) on file. Please begin monitoring all five identified SDOs until either ROS is
granted for the facility or you are otherwise officially relieved of monitoring SDOs 002 through 005
in writing from the Division. Analytical and qualitative monitoring (AM & QM) records of SDO 001
for the .years 2009 and 2010 were reviewed during the inspection and were found to be complete
and current. R&A Laboratories conducts the monitoring for RJ Reynolds.
5. It is noted that the Whitaker Park complex actually includes several separate parcels of land,
which are not all contiguous, and which lie between North Cherry Street to the west, Gossett
Street and the Oracle Flexible Packaging plant to the north, Indiana Avenue to the east, and
Deacon Boulevard and 30th Street to the south. Operations at each specific parcel vary greatly
and at some, industrial activity is extremely limited and/or not exposed to precipitation. Mr. Boone.
advised you during the 'inspection that a comprehensive review of the complex should be
conducted to determine whether getting separate permits or No Exposure Certifications (NEC) for
each parcel may be a more effective/efficient way to manage all stormwater issues within the
entire complex. However, RJ Reynolds should begin conducting AM and QM at all five SDOs until
all such issues are resolved.

6. The site was very clean and well maintained. Mr. Boone noted no violations or discrepancies. It
is believed that you have minimized exposure of industrial activities to the maximum extent
practical.

7. Not all required records are currently available for this permit. However, it is not known for certain
at this time whether there still is a wastewater discharge from the facility regulated by
NCG500096. There are some monitoring data available, but it is incomplete. RJ Reynolds will
determine whether there is still a discharge and begin monitoring as required, or if there is no such
discharge(s) request rescission of the permit. Mr. Boone noted no conditions at any of the
stormwater outfalls evaluated during the inspection which may be indicative of any such
wastewater discharge(s).

8. You are reminded that violations of either the NCG060000 or the NCG500000 general permits are
subject to civil penalty assessments not to exceed $25,000 per day, per violation. Please

In response to your renewal application for continued coverage under the subject permit, the Division
of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
