On February 27, 2013, Joanne Steenhuis from the Division of Water Quality Wilmington Regional Office
(WiRO) conducted an inspection of the paperwork associated with your Mine off Halltown Road,
Jacksonville.
This inspection was conducted to verify that the Stormwater Pollution Prevention Plan had been
implemented for the facility as specified in NPDES General Permit No. NCG020833. The findings and
comments noted during this inspection are provided in the enclosed copy of compliance inspection report.
Please provide a status report in writing to this office by April 7, 2013 regarding your plans or
measures to be taken to address the items listed below:
1) A review of the paperwork associated with the Stormwater Pollution Prevention Plan found that the
plan had not been fully implemented and the data and additional items as described in the NPDES NCG
020833 needs to be added in order to complete the SPPP.

Inspection Summary:
The inspection of the minsite itself was in compliance, but the meeting concerning the paperwork and the Stormwater
Pollution Prevention Plan (SPPP)showed that the plan had not really been implemented.
Mr humphrey needs to make sure that ALL the areas described in the NPDES 020833 permit is addressed in the plan
and the plan needs to be availalble for the inspection of the Wilmington Regional Office staff for compliance and needs to
include accumulated data as required by the permit.
The plan needs to address the temporary on -site fuel storage once the site starts up again. It needs to include a
temporary containment system(s) if any hydrocarbons are to be located on -site for 3 months or more. The plan needs to
have a page indicating the mine owner's name and/or responsible party's name and information and contact information
and any emergency contact information. This needs to be updated yearly.
Preventative maintenance needs to be more descriptive as to what the operators are trained and required to inspect. it
also needs to include what protocols will be used to remove the "leaks" if/when any are found and what clean-up protocols
will be implemented to clean up the spills/leaks.

Has the Stormwater Pollution Prevention Plan been implemented?
Comment: The region had a copy of the SPPP, but the owner did not have a copy
available at the time of the meeting to review the paperwork. Mr. Humphrey did have a
copy of the site plan and topo map but, the outfall locations were not numbered. Mr.
Humphrey needs to include pages in his plan for the significant spills, training and
discharges. The SPPP is rather bleak and Mr. Humphrey needs to make sure that each
section covered in the permit has a section in his plan to cover the requirement.

Qualitative Monitor
Has the facility conducted its Qualitative Monitoring semi-annually?
Comment: The permit has only been active for a short period of time (November of
2013). There needs to be pages in the plan to record the qualitative monitoring if there
is a discharge and a date and to also record "no discharge" if no discharge occurred
with the 6 months.

On February 21, 2013, Joanne Steenhuis from the Division of Water Quality Wilmington Regional Office
(WiRO) conducted an inspection of the Mine off Halltown Road, Jacksonville.
This inspection was conducted to verify that the facility is operating in compliance with the conditions
and limitations specified in NPDES General Permit No. NCG020833. The findings and comments noted
during this inspection are provided in the enclosed copy of compliance inspection report.

regarding your plans or measures to be taken to address the items listed below:

Comment: The inspection was done at the site. There is no office at the site and the
plan and data are most likely kept offsite. I have left a message with Mr. Ronnie
Humphrey to contact me in order for me to review them.

In accordance with your application for a discharge permit received on October 15,
2012, we are forwarding herewith the subject certificate of coverage to discharge under the
subject state - NPDES general permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Please take notice that this certificate of coverage is not transferable except after
notice to the Division of Water Quality. The Division of Water Quality may require
modification or revocation and reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact
adjacent wetlands. The specific requirements for mine dewatering at facilities near
wetlands can be found in Part III, Section E of your permit. You must have an approved
Pumping Operation and Monitoring (O&M) Plan before mine dewatering'discharges
occur at your facility. Discharging mine dewatering wastewater without Plan approval
will be subject to enforcement action. A draft Pumping 0&M Plan for your facility was
received with the Notice of Intent (NOI) application and forwarded to the Wilmington
Regional Office; however, you must contact Linda Willis at the Wilmington Regional
Office at (910) 796-7215 to verify if that 0&M Plan is adequate or if it requires additional
information or changes. The regional office will assist you in the approval process. Again,
no mine dewatering discharges are allowed under this permit until that Pumping
0&M Plan has been approved.

Please note that mine dewatering wastewater includes wet pit overflows caused
solel4bdirect rainfall and groundwater seepage for this type of mining operation (sand
mining). Any discharge of this water (and any stormwater commingled with it) is subject
to the effluent limitations in this permit.
This general permit allows the discharge of stormwater and certain types of
wastewater from your facility. In your NOI application, you specified that only mine
dewatering water would. be discharged from this facility. If separate point -source
discharges of stormwater occur (i.e., stormwater not combined with mine dewatering
water], you must adhere to the conditions in this permit for stormwater discharges.
Coastal'stormawater management rules apply to this county. You may be required
to apply for an additional coastal State Stormwater Permit for any buildings or other
impervious area that are added to this mine site. If you are unsure about whether these
rules affect you, please contact Kelly Johnson in the Wilmington Regional Office at (910)
796-7345 to determine if you need to apply for a State Stormwater Permit.
This permit does not affect the legal requirements to obtain other permits which
may be required by the Division of Water Quality or permits required by the Division of
Land Resources, Coastal Area Management Act or any other federal or local governmental
permit that may be required.

We don't have any information in house here in WiRO as far as I know. We could use the large scale map. I'm assuming
they had a wetland delineation done? I'm not concerned for the wetlands to which they are discharging but am curious
if there are other wetlands adjacent to the pit that could be drained by their dewatering activities. Please go ahead and
issue the permit, we'll try to get them on the list for inspection to see what we have out there.

Hi Linda,
Please see the attached NOI we received from HCI, Inc. for this mine in Onslow County, near Jacksonvilie. It looks like
they've been in touch with you already. It's an existing operation that got its mining permit (#67-68) back in April 2010.
They discharge through wetlands to Northeast Creek.
They submitted a Pumping 0&M Plan (included in the scan), but it doesn't appear to be very thorough. There's no
information about pumping specifications (they also did not check those items off the checklist of the NOI). It's a sand
mine and may not be a big concern (they discharge to wetlands from a sediment -pond), but then again this 0&M Plan
might need some major work. They did include an evaluation using the Skaggs Method to show a necessary set -back
from Wetlands of just over 45'.
I have two copies of a larger Mine Site Plan, so if you weren't provided with one when the applicant consulted with
you, please let me know so I can send it.
Please let me know if you have any concerns with this mine obtaining coverage under NCG02.

prepared by Parker & Associates, Inc. with input from the owner.
1. SITE PLAN'
A. See the attached Exhibit 1 — Portion of USGS map, and Exhibit 2 — Portion of
Onslow County D.O.T. Map.
B. The HCI Halltown Road Mine is a sand mining operation only. Sand is
excavated and loaded directly into trucks and hauled offsite to other locations. Loading
is performed with an excavator and other than normal daily maintenance, all equipment
service is performed off site. No fuels or lubricants are stored near or in the mining area.
Excavated material is normally wet so dust is not a problem in mine. The haul road is
monitored and dampened utilizing a water truck when necessary to control any dust
created from hauling operations. There is no waste generated from this operation,
therefore, no disposal plan is needed. The possible pollutants to be concerned with are
small amounts of fuel or hydraulic oil created by a ruptured hose or pipe on trucks or
equipment. This is not a normal occurrence but in the unlikely event that it does happen
there is always someone on site to minimize and contain the spill before it reaches any
water source. Any contaminated soils will be removed and disposed of at a facility
certified to treat soils.

D. There have been no significant spills or leaks at this location, therefore, no
corrective actions have been needed.

E. A floating pump will be utilized to dewater the Mine when needed. The floating pump
will be configured to pump water from 6"-12" below the surface of the ponded water,
therefore, pump off the clearer accumulated water.The discharge pipe for the dewatering
pump will be inspected daily when pumping. The discharge line is located in close
proximity to power source for pump and immediately after starting, pump discharge will
be evaluated to determine if any non-stormwater discharge is present. Pumping is only
performed as needed and never immediately after or during a rain event. Visual checks
for clarity are performed each time pump is operated. Any foam, discoloration or unusual
odor would result in immediate shut down of pump and discharge. Samples will be
collected quarterly and analyzed by a certified laboratory and results will be kept on site.
Results will also be forwarded to NC Division of Water Quality annually as required. At
any time sampling results exceed acceptable levels, discharging will cease until
conditions become more favorable and samples would be taken monthly for a period of
one year. After such time, if levels have been consistently lower than acceptable levels,
samples would be drawn on a quarterly basis at minimum or as deemed necessary. Daily
records will be maintained on site recording times and amounts of pumping as well as,
recorded rain fall.
2. EROSION AND SEDIMENTATION CONTROL AND DEWATERING
There is no gravity discharge of stormwater to the adjacent wetlands or creek,
therefore, there are no special erosion and sedimentation control measures. The
dewatcring discharge will pump into a rip rap basin, then flow through the sediment basin
and through a couple rock check dams prior to discharging into the 50' undisturbed
buffer, prior to flowing into the wetlands, then flowing through the approximately 550'
of wetlands prior to reaching Northeast Creek. The facility shall be operated and
maintained in compliance with the mining permit issued by the Division of Land
Resources.
3. STORMWATER MANAGEMENT PLAN
A. All excavation and land disturbance is confined to the mine area with only one
controlled discharge source (dewatering pump). A diversion berm is maintained around
the mine perimeter to eliminate stormwater run-on. No discharge of stormwater
(pumping) will occur until all solids have settled and water is clear.
B. An inspection of mine slopes, entrance/exit, and stormwater protection devices
(BMP's) will be conducted weekly or within 24 hours of any storm event by the mine
operator or other competent person. No pumping discharge will take place during or
immediately after a storm event. A rain gauge will be kept on site and monitored and all
rainfall recorded. A record of inspections, deficiencies land corrections will be recorded
and kept on site.
C. There is no bulk storage of any kind on this site.

4. SPILL PREVENTION AND RESPONSE PLAN (SPRP)
There is no bulk storage of any kind on site, therefore, there is no potential for
spills.

6. EMPLOYEE 'TRAINING
Training for all involved in mine operation will be required semi-annually. This
training will include safety, things to look for that could possibly contaminate water,

employees and anyone working in mine area will be required to receive training before
entering mine. Training will be provided by mine operator. Mine operator will stay up to
date on new references and resources pertaining to mining safety and stormwater
management.
7. RESPONSIBLE PARTY
The mine operator will be responsible for all mine and dewatering practices. He
will ensure that all requirements are met and all records are up to date. The operator is
also responsible for training of employees and personnel.
8. PLAN AMENDMENT
The SPPP will be reviewed annually and amended as needed and all changes
incorporated into training and Best Management Practices.

9. PLAN IMPLEMENTATION
The SPPP will be implemented immediately upon approval and a copy
maintained on site. Additional copies of the plan and recorded data can be provided upon
request. Information will be kept on site for a minimum period of five years.

result of previous site inspections by DLR and DWQ staff which revealed a pump onsite actively dewatering
the mine pit.
On June 13, 2012, staff from the Wilmington Regional Ofrlce of the DWQ met with you to conduct a
follow up inspection. During the site visit, DWQ staff observed that the pump had been removed, and no
dewatering was being conducted at that time. You stated that the mining activity has been suspended that
the site is in the process of being sold to the adjacent property owner to be included as part of a DOT
borrow pit.
As a result, staff concluded that an NPDES Stormwater General Permit NCG020000 will not be
required for,this facility as long as the site is operated without discharging stormwater, mine dewatering
watewater or process watewater to surface waters or wetlands from active or inactive mining. if you find

With all due respect to the statements made in your Notice of Violation letter, we have not been
pumping water into the wetlands, nor have we been pumping any discharge from this site. The original
Mine Plan provided for the construction of a temporary sediment pond along the Western perimeter of
the Mine. We noted that when water entered this sediment pond it did not overflow, but rather went into
the ground. Based on that, we tested the area to see what happened if we pumped water into the pond.
We found that the water continued to move into the ground without overflowing this sediment pond.
We would be happy to meet with you or your staff on site to show them how this has been
operating. We do not believe that anything we have done is a violation of our permit or any of the rules.

On May 3, Jean Conway and Joanne Steenhuis of the Division of Water Quality (DWQ) Wilmington Regional
Office conducted a site inspection at the Halltown Road Mine (Division of Land Resources (DLR) Mining Permit
#67-68) and observed a discharge to wetlands without the approved General Stormwater Permit NCG020000 for
mining operations.
A file review reveals there has been no application received by DWQ and there has been no permit issued for this
mine. The National Pollution Discharge Elimination System (NPDES) program was established by the federal
Clean Water Act (1972) and then delegated to the Division of Water Quality for implementation in North Carolina.
The NPDES Phase I permitting program for stormwater discharges was established in 1990. Phase I focused on site
and operation planning to reduce pollutant sources. One of the industries regulated through NPDES permits is
mining activities under the standard industrial code I442.
As a result of the site inspection and file review, the following violation, detailed below, is noted:
(1) Operating this facility without an NPDES stormwater permit

(1) It is illegal to operate certain industrial plants without a permit under North Carolina General Statute
i t (NCGS) 143-215.1(a). Illegal operation is subject to civil penalties of up to $25,600 per day according
to NCGS 143-215.6A(a)(2). NPDES general permit NCG020000 has been established pursuant to
#� NCGS 143-215.1(b) for discharges of stormwater to surface waters. This general permit is applicable
to owners or operators of stormwater point source discharges associated with activities classified as
establishments primarily engaged in mining.
The Halltown Road Mine was operating at the time of inspection and a pump was observed
actively dewatering the mine pit.
DLR Mine Inspection Report dated 2/7/2012 requested the pump be removed from site and
DWQ be notified.

With all due respect to the statements made in your Notice of Violation letter, we have not been
pumping water into the wetlands, nor have we been pumping any dischat•ge from this site. The original
Mine Plan provided for the construction of a temporary sJ ent pond along the Western_pcaimeter of--
the Mine. We noted that when water entered this sedirent pond it did not overflow, but rather went into
the ground. Based on that, we tested the area to see what happened if we pumped water into the pond.
We found that the water continued to move into the ground without overflowing this sediment pond.
We would be happy to meet with you or your staff on site to show them how this has been
operating. We do not believe that anything we have done is a violation of our permit or any of the rules.
Please advise if any additional information is needed from us at this time. Please contact us
when you are ready to meet.

On May 22, 2012, you responded to a Notice of Violation (NOV) dated May 9, 2012, from
the Division of Water Quality (DWQ) for operating without an NPDES Stormwater Permit for the
tract known as Halltown Road Mine located Halltown Road in Onslow County, North Carolina.
This NOV was issued as a result of previous site inspections by DLR and DWQ staff which
revealed a pump onsite actively dewatering the mine pit.
On June 13, 2012, staff from the Wilmington Regional Office of the DWQ met with you to
conduct a follow up inspection. During the site visit, DWQ staff observed that the pump had been
removed, and no dewatering was being conducted at that time. You stated that the mining activity
has been suspended that the site is in the process of being sold to the adjacent property owner to
be included as part of a DOT borrow pit.
As a result, staff concluded that an NPDES Stormwater General Permit NCG020000 will
not be required for this facility as long as the site is operated without discharging stormwater,
mine dewatering watewater or process watewater to surface waters or wetlands from active or
inactive mining. If you find that dewatering may be necessary in the future, you will be required to
obtain coverage for the NPDES Stormwater General Permit NCG020000.
Thank you for your assistance and cooperation during this inspection. Please be
advised that violations of the NPDES Stormwater General Permit may be subject to a civil
penalty assessment of up to $25,000.00 per day for each violation. If you have any

On May 3, Jean Conway and Joanne Steenhuis of the Division of Water Quality (DWQ) Wilmington Regional
Office conducted a site inspection at the Halltown Road Mine (Division of Land Resources (DLR) Mining Permit
967-68) and observed a discharge to wetlands without the approved General Stormwater Permit NCG020000 for
mining operations.
A file review reveals there has been no application received by DWQ and there has been no permit issued for this
mine. The National Pollution Discharge Elimination System (NPDES) program was established by the federal
Clean Water Act (1972) and then delegated to the Division of Water Quality for implementation in North Carolina.
The NPDES Phase I permitting program for stormwater discharges was established in 1990. Phase I focused on site
and operation planning to reduce pollutant sources. One of the industries regulated through NPDES permits is
mining activities under the standard industrial code 1442.
As a result of the site inspection and file review, the following violation, detailed below, is noted:
(1) Operating this facility without an NPDES Stormwater permit
Item 1. Operating a facility without a stormwater permit
(1) It is illegal to operate certain industrial plants without a permit under North Carolina General Statute
(NCGS) 143-2 15, 1 (a). Illegal operation is subject to civil penalties of up to $25,000 per day according
to NCGS 143-215.6A(a)(2). NPDES general permit NCG020000 has been established pursuant to
NCGS 143-215.1(b) for discharges of stormwater to surface waters. This general permit is applicable
to owners or operators of stormwater point source discharges associated with activities classified as
establishments primarily engaged in mining.
The Halltown Road Mine was operating at the time of inspection and a pump was observed
actively dewatering the mine pit.
DLR Mine Inspection Report dated 2/7/2012 requested the pump be removed from site and
DWQ be notified.

Construction Specifications
1.
Aggregate size — Use 2-3 inch washed stone
2.
Length — As effective, but not less than 50 feet.
3.
Thickness — Not less than six (6) inches.
4.
Width — Not less than full width of oil points of
ingress or egress. Minimum of 12'.
5.
Install filter fabric under entire footprint of the construction entrance.
6.
Washing — When necessary, wheels shall be cleaned to
remove sediment prior to entrance onto public right—of—
way. When washing is required, it shall be done on an
area stabilized with crushed stone which drains into an
approved sediment trap or sediment basin. All sediment
shall be prevented from entering any storm drain, ditch,
or watercourse through use of sandbags, gravel, boards
or other approved methods.
7.
Maintenance — The entrance shall be maintained in a
condition which will prevent tracking or flowing of
sediment onto public rights —of —way. This may require
periodic top dressing with additional stone as conditions
demand and repair and/or cleanout of any measures used to LIMITS OF
trap sediment. All sediment, spilled, dropped. washed or
tracked onto public rights —of —way must be removed EXCAVATIO
