Williams tn Eastern Excavating Mine 143 Penguin Lane Jacksonville, NC 28546 Subject: NPDES Compliance Inspection Eastern Excavating Mine NPDES Permit No. NCG020280 Information Request Onslow County Dear Mr. Williams, An inspection of the Eastern Excavating Mine pit on Penguin Lane in Jacksonville was conducted on January 20, 2010. This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES Pen -nit No. NCG020280. Your office was contacted and permission was given by the secretary to enter the mine site for inspection. The Wilmington Regional Office is requesting information to help establish whether the permit conditions are being met and to determine if there are any potential wetland impacts due to fill materials around the perimeter of the mine site. Please be aware the NPDES General Permit NCG020000 has been renewed (effective January I. 2010). The new permit requires a Stormwater Pollution and Prevention Plan be developed and implemented within twelve months of the issuance date of the permit (due January 1, 2011). If you do not have a copy of the new permit, please contact this office and one will be sent to your attention. Please provide the following information to this office within sixty (60) days of receiving this notification: l . Qualitative and quantitative monitoring reports for'the calendar years 2007-2009. 2. Please request a site visit by the United States Army Corps of Engineers (USACOE) to determine whether bill materials are within the wetland boundaries along the north and northwest sides of the mine. The wetlands were not flagged nor does it appear that the mine pit boundary was flagged, therefore it is impossible for the inspector to determine whether wetland impacts have occurred without verification by the USACOE. This office is hereby requesting the following information: 1. a wetland delineation signed by the USACQE for all wetlands within the mine site boundary and wetlands within 400' from the mine site boundary. The wetlands need to be flagged to ensure no encrouchment from mining activities into those areas occur. 2. a copy of the mine site map with the wetlands clearly marked. 3. copies of the past 3 years qualitative and quantitative monitoring for the mine pit discharges (stormwater and/or wastewater). This information must be provided within 60 days of receipt of this inspection report. This inspection will be considered neither compliant or non compliant pending receipt of the requested information herein. Failure to provide the requested information will constitute non compliance with the permit conditions which could result in enforcement actions. Williams: On June 10, 2008 an inspection of the subject mine was performed by Karl Hammers of this office. A copy of the inspection is enclosed. Several deficiencies were observed that require your prompt attention. The deficiencies discovered and the necessary corrective actions are as follows: Operating Condition #3A. Sufficient Buffer (minimum 50 feet) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of the waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. — There appears to be little or no buffer between the affected land and the wetland in some areas. Locate and survey the edge of the wetlands adjacent to the mine. Restore or maintain the buffers shown on the mine map last revised November 21, 2007. 2, Operating Condition # 5. All mining permit boundaries shall be permanently marked at the site on 100 foot intervals unless the line of sight allows for larger spacing intervals. -No markers were observed on site. The permit boundaries shall be permanently marked. If the previously described deficiencies are not corrected within 30 days following your receipt of this Notice, this matter will be referred to the Director, Division of Land Resources, Department of Environment and Natural Resources, for the issuance of an official Notice of Violation in an effort to secure compliance at the site.
