The site visit and file review revealed that the subject project is covered by NPDES Stormwater General Permit — NCG020243 . You should modify your operation and monitoring plan to include quarterly monitoring for the pit dewatering discharge in accordance with the requirements specified in Section E of your NPDES General Permit. Please be advised that the NPDES General Permit NCG020000 was renewed on January 1, 2010. Part III. Section A. of the permit requires a written stormwater pollution prevention plan (SWP3). Completion of the written plan is due by January 1, 2011. You do not need to send a copy of the SWP3 to this office, but should have a copy available for review by Division Compliance Inspectors. Please ensure that you are working towards meeting this permit requirement. Considering the steps you have taken to remedy the non compliant status of your facility, the Division will not take any further enforcement action concerning Notice of Violation NOV-2010-PC-0471. I informed her that I had already taken a water sample to Beacham'.s Laboratory for analysis. I will send the results although I know they will be late for the first quarter of 2010. Future samples will be taken and sent to your division quarterly at the end of June, September, and December. I hope this will satisfy the analytical requirement of our permit. Regarding the qualitative monitoring requirement of the permit I will begin performing them on a semi-annual basis. As I understand it this is a visual inspection of any water leaving the site. Such as: storm water runoff, water pumped from the mine, vehicle maintenance, etc. Linda requested a copy of our latest mine map and for us to compose a simple Stormwater Best Management Plan. I have mailed a letter to Mr. Shiver explaining that we have begun sampling the discharge water from our sand pit and are waiting for the lab results to come in at which time I will forward them to you. I will also follow up with quarterly reports at the end of June, September, and December. I have included a copy of this letter for your files. I am also enclosing a Stormwater Best Management Practice Plan for your review. I kept it simple like you said to do. If there is anything I need to add, let me know. Stormwater at this mine drains back into the excavated area and is pumped out via floating electric submersible pumps. The discharged water is now being tested quarterly as per the Division of Water Quality requirements. B.) Any storm water from the access road is controlled by containment berms and natural vegetation along the roadway. We have one small swale that empties into the same discharge point as our pumps do. No visible erosion, scouring, or sedimentation is visible. If any erosion becomes evident it will be corrected immediately. C.) Equipment used onsite will be maintained so as not to leak or discharge pollutants that might enter the surface waters or groundwater. Equipment maintenance other than what is considered daily preventative maintenance is not performed onsite. Any spilled fluids from an unforeseen breakdown such as a blown hydraulic hose or other major component failure shall be immediately contained and the contaminates will be properly disposed of. D.) At this time we do have (1) 550 gal. and (1) 1000 gal. above ground fuel tanks onsite. However they have not been in use for approximately 2 yrs. and we will be removing the 1000 gal. tank as we no longer store on -highway fuel for our trucks. We will keep the 550 gal. tank for future use and will maintain it to prevent any leakage or spills. E.) Qualitative monitoring will be done on a semi-annual basis on any storm water exiting the mine site. in accordance with Part III Sect. B Table 5 of our Stormwater Discharge Permit. F.) Stockpiled sand is kept at an elevation below original grade so there is no danger of the stockpile eroding and material being discharged into any surface waters outside of the mined area. We do have one stockpile of topsoil but it is mostly covered with vegetation. We will monitor it for any erosion.
