On June 6, 2019, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral,
and Land Resources (DEMLR), conducted a compliance evaluation inspection for Diversified Biomass
Company DBA American Property Experts located in New Hanvover County, North Carolina. The site
drains to Cape Fear River, which is currently classified as Class C Waters in the Cape Fear River Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):

Mr. Thompson was unavailable during inspection. Please contact this office to schedule review of SPPP
and monitoring documents.
The inspection is in response to a complaint of concrete crushing on the property. The NCG210000 does
not cover concrete crushing, only timber and wood products. NCG070000 covers stone and concrete
products. Compliance options will be discussed next meeting.
Thank you for your assistance and cooperation during this inspection. Please be advised that violations
of the NPDES Stormwater General Permit may be subject to a civil penalty assessment of up to
$25,000.00 per day for each violation. If you have any questions, comments, or need assistance with

Conditions of Permit
1. Operation and maintenance of this facility shall be in accordance with the Solid
Waste Management Rules (15A NCAC 1313, Section .0300), the permit application
and the Operation Plan submitted with the permit application. Failure to comply
may result in compliance actions or permit revocation.
2. Any leachatc generated at the facility shall be managed in such a manner that there
will be no degradation of ground or surface waters.
This facility shall be operated in such a mailer that soil erosion and runoff from the
site shall be controlled. Erosion and runoff control structures shall be in place at the
facility and in proper working order.
4. Grading at the facility resulting in a reduced depth to seasonal or permanent ground
water shall not be allowed.
The 50-foot property line buffer shall be maintained free of waste and final product.
Only materials specifically listed in the permit application may be managed at this
facility without adequate testing and prior approval by the Division of Waste
Management. Low carbon -nitrogen wastes, such as grass clippings shall not be
received at the facility. Any heat generation in excess of 110 degrees Fahrenheit
(composting) in any of the piles of material at the facility will be considered a
permit violation and shall result in the facility meeting all the requirements of
Section .1400 of the Solid Waste Management Rules within 3 months.
7. Non conforming waste received at the facility or removed from final product during
screening shall be maintained in an appropriate on -site container or removed front
the facility within 30 days and properly disposed. Contaminated soils may not be
managed at this facility.
This facility shall be operated and maintained with sufficient dust control measures
to minimize airborne emissions and to prevent dust from becoming a nuisance or
safety hazard.
9. The limits of the permitted area shall be marked with permanent and clearly visible
markers.

10. The amount and type of waste received, the amount of waste on -site, and the amount
and type of products sold or otherwise distributed shall be reported to the Division
of Waste Management by August I" of each year for the previous July 1 to Tune 30.
All quantities shall be in tons.
11. Existing groundwater monitoring wells at the facility shall be protected from
vehicular traffic and the area around the wells shall be maintained free of waste and
product.
12. This permit shall expire on April 11, 2016. A change in ownership, increase in
facility capacity, process changes or receiving additional waste types shall require a
permit modification. Any changes to the Treatment and Processing Rules may
require operational changes at this facility.

SECTION 1— APPROVAL
Having reviewed the application and all supporting materials, the City of Wilmington has
determined that the application is complete and the proposed development meets the
requirements of the City of Wilmington's Comprehensive Stormwater Ordinance.

Therefore,.the above referenced site is hereby approved and subject to all conditions set
forth in Section 2 of this approval and all applicable provisions of the City of Wilmington
Comprehensive Stormwater Management Ordinance.
This permit shall be effective from the date of issuance until rescinded and shall be subject
to the following specified conditions and limitations:
Section 2 - CONDITIONS
1. This approval is valid only for the stormwater management system as proposed on
the approved stormwater management plans dated 10/27/14.
The project has not proposed any built -upon area as indicated in Section IV of the
Stormwater Management Application Form submitted as part of the approved
stormwater permit application package, and per the approved plans.
3. The permittee shall submit a revised stormwater management application packet to
the City of Wilmington and shall have received approval prior to construction, for
any modification to the approved plans, including, but not limited to, those listed
below:
• Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
• Further subdivision, acquisition, lease or sale of any part of the project area.
• Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
4. This permit is not transferable except after application and approval by the City of
Wilmington. In the event of a change of ownership, name change or change of
address the permittee must submit a completed Name/Ownership Change form to
the City of Wilmington at least 30 days prior to the change. It shall be signed by all
applicable parties, and be accompanied by all required supporting documentation.
Submittal of a complete application shall not be construed as an approved
application. The application will be reviewed on its own merits by the City of
Wilmington and may or may not be approved. The project must be in compliance
with the terms of this permit in order for the transfer request to be considered. The
permittee is responsible for compliance with all permit conditions until such time as
the City of Wilmington approves the transfer request. Neither the sale of the project

Conditions of Permit
1. Operation and maintenance of this facility shall be in accordance with the Solid
Waste Management Rules (15A NCAC 13B, Section .0300), the permit application
and the Operation Plan submitted with the permit application. Failure to comply
may result in compliance actions or permit revocation.
2. Any leachate generated at the facility shall be managed in such a manner that there
will be no degradation of ground or surface waters.
3. This facility shall be operated in such a manner that soil erosion and runoff from the
site shall be controlled. Erosion and runoff control structures shall be in place at the
facility and in proper working order.
4. Grading at the facility resulting in a reduced depth to seasonal or permanent ground
water shall not be allowed.
The 50-foot property line buffer shall be maintained free of waste and final product.
6. Only materials specifically listed in the permit application may be managed at this
facility without adequate testing and prior approval by the Division of Waste
Management. Low carbon -nitrogen wastes, such as grass clippings shall not be
received at the facility. Any heat generation in excess of 110 degrees Fahrenheit
(composting) in any of the piles of material at the facility will be considered a
permit violation and shall result in the facility meeting all the requirements of
Section .1400 of the Solid Waste Management Rules within 3 months.
7. Non conforming waste received at the facility or removed from final product during
screening shall be maintained in an appropriate on -site container or remo\,ed From
the facility within 30 days and properly disposed. Contaminated soils may not be
managed at this facility.
8. This facility shall be operated and maintained with sufficient dust control measures
to minimize airborne emissions and to prevent dust from becoming a nuisance or
safety hazard.
9. The limits of the permitted area shall be marked with permanent and clearly visible
markers.

10. The amount and type of waste received, the amount of waste on -site, and the amount
and type of products sold or otherwise distributed shall be reported to the Division
of Waste Management by August 1 S` of each year for the previous July I to .tune 30.
All quantities shall be in tons.
11. Existing groundwater monitoring wells at the facility shall be protected from
vehicular traffic and the area around the wells shall be maintained free of waste and
product.
12. This permit shall expire on April 11, 2016. A change in ownership, increase in
facility capacity, process changes or receiving additional waste types shall require a
permit modification. Any changes to the Treatment and Processing Rules may
require operational changes at this facility.

Having reviewed the application and all supporting materials, the City of Wilmington has
determined that the application is complete and the proposed development meets the
requirements of the City of Wilmington's Comprehensive Stormwater Ordinance.

This permit shall be effective from the date of issuance until rescinded and shall be subject
to the following specified conditions and limitations:
Section 2 - CONDITIONS
This approval is valid only for the stormwater management system as proposed on
the approved stormwater management plans dated 10/27/14.
The project has not proposed any built -upon area as indicated in Section IV of the
Stormwater Management Application Form submitted as part of the approved
stormwater permit application package, and per the approved plans.
3. The permittee shall submit a revised stormwater management application packet to
the City of Wilmington and shall have received approval prior to construction, for
any modification to the approved plans, including, but not limited to, those listed
below:
Any revision to any item shown on the approved plays, including the
stormwater management measures, built -upon area, details, etc.
• Further subdivision, acquisition, lease or sale of any part of the project area.
• Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
4. This permit is not transferable except after application and approval by the City of
Wilmington. In the event of a change of ownership, name change or change of
address the permittee must submit a completed Name/Ownership Change form to
the City of Wilmington at least 30 days prior to the change. It shall be signed by all
applicable parties, and be accompanied by all required supporting documentation.
Submittal of a complete application shall not be construed as an approved
application. The application will be reviewed on its own merits by the City of
Wilmington and may or maynot be approved. The project must be in compliance
i with the terms of this permit n order for the transfer request to be considered. The
permittee is responsible for compliance with all permit conditions until such time as
the City of Wilmington approves the transfer request. Neither the sale of the project
