On May 11, 2017, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral,
and Land Resources (DEMLR), conducted a compliance evaluation inspection for Southern Metals
Recycling 421N located in New Hanover County, North Carolina. The site drains to the Cape Fear River.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):

Waddles on the North side of the property should be reinstalled and expanded in scope: Document use of waddles as a
BM in SPPP. Document any stormwater pipes that are on the property as a BMP. Define size of stormwater (infiltration)
pond and document any discharges (or none) from the pond. Backside of the property should be defined with a berm. Any
engine or transmission processing or storing should have a process that ensures no oil products are getting onto the around.

On October 2, 2013, Staff from the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources, conducted a site inspection for the project known as Southern Metals Recycling located
U.S. 421 South, New Hanover County, North Carolina The site visit and file review revealed that the
subject project is covered by NPDES Stormwater General Permit — NCG200360.
Accordingly, the following observations were noted during the Divisions inspection (please see the
attached addendum for information about your permit):
• This office has not received a written plan of action to address the compliance deficiencies as
identified in the attached October 26, 2010 report. Submit a written Plan of Action by November
17, 2013.

Comment: This site visit was to discuss the requirements of the Stormwater Pollution
Prevention Plan with Dylan Robbins who has recently been employed by Southern
Metals to write the SP3 and help with it's implementation. Jeremy Alpers indicated
there was a discharge from their site to the bordering site which is owned by Great Neck
Holdings. It is another recycle site that is currently trying to get a state stormwater
permit and has been issued the NCG200. It has a stormwater pond that appears to
provide a lot of storage. The 22" rain did not result in a discharge from that pond.

Comment: The Certificate of Coverage was not found in the SWP3. The construction
of a berm around the perimeter of the facility appears to be fairly effective in directing
stormwater to an internal stormwater pond on site. A large rain event may result in a
discharge from the facility. Some areas along the perimeter could not be seen due to
scrap materials being stored on the fence line.

In response to your renewal application for continued coverage under general permit NCG200000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Due to resource constraints,
the Division has been unable to adequately consider appropriate modifications to the permit. Therefore, the permit
has been reissued without changes from the previous permit, so all conditions remain the same. The permit term for
the reissued permit is two years, expiring on September 30, 2008. The general permit may be modified and reissued
prior to its expiration. The permit is reissued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental
Protection Agency, dated December 6, 1983.

Your facility is currently covered for stormwater discharge under General Permit NCG200000. This permit expires on
October 31, 2005. The Division staff is currently in the process of renewing this permit. When a draft version is
available for notice and public comment, it will be posted on our website at http://h2o.enr,state.nc.us/su/. Once
the permit is reissued, your facility would be eligible for continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, enclosed you will find a
Permit Coverage Renewal Application Form. The application must be completed and returned by August 19, 2005 in
order to assure continued coverage under the general permit. Letters confirming our receipt of the completed
application will not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that "no exposure exclusion" is now available to all operators of industrial facilities in any of the
categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel

Land Resources, conducted a site inspection for the project known as Southern Metals Recycling located
U.S. 421 South, New Hanover County, North Carolina The site visit and file review revealed that the
subject project is covered by NPDES Stormwater General Permit — NCG200360.
Accordingly, the following observations were noted during the Divisions inspection (please see the
attached addendum for information about your permit):
• This office has not received a written plan of action to address the compliance deficiencies as
identified in the attached October 26, 2010 report. Submit a written Plan of Action by November
17, 2013.

November 1, 2000. Since there has been a considerable time lag since your permit application was received on
July 31, 1995 this letter is being sent to ensure that the contact information that we have is correct.
Enclosed with this letter you should find a contact information update form with the information that the
Division has on your facility. Please check to see whether or not this information is correct. If any of the
information has changed from what our records show, please make the appropriate corrections in the empty
