The site drains to the Core Creek (or Adams Creels Canal), which is currently classified as Class SA HQW Waters in the White Oak River Basin. The following observations were noted during the DEMLR inspection (please see the attached addendum for additional information about your permit): 1. Tier two status is temporarily relieved for the site. Contact this office if any unusual spikes in copper are sampled. 2. Continue with schedule of maintenance and repairs (closed loop recycle basin). 3. Representative outfall status has changed. Tie recycle system is considered wastewater and should be thoroughly contained. The pond has a clay liner that is twenty years old. The pond should be cleaned out and the clay finer should be evaluated. A plastic liner may be needed. All drainage from powerwashing must drain to the pond. Cox put forth plan to replace gravel with quartz gravel, underlined with plastic in order to minimize ground infililralion of wastewater. Maintenance of the used motor oil has been taken care of. The facility is temporarily relieved of tier two status. Continue to work to reduction of copper levels. Wilmington NC 28405 RE: Jarrett Bay Boatworks — COC NCG190052 Compliance Evaluation Inspection —April 19, 20IS Dear Mr. Sams: NAYI�?0�� We appreciate this opportunity to address your office's concerns noted in Brian Lambe's letter dated April 23, 2018. We will address your observations in order: ffnnual Sit'nYpiari, Data: We had been in discussion in the past with our consultant regarding' a request for a waiver from the monthly Tier Two monitoring with the main reason that we should expend funds on implementing BMPs instead of monthly sample collection & analysis. However, we did not submit a waiver request to NCDEQ prior to your April inspection. We have no�v written a waiver request letter and it was mailed to Annette Lucas at NCDEQ on May 18, 2018. 2. .9 SWPPP has not been implemenled: We disagree with this observation-, we have had a SWPPP in place for over 12 years and we believe we have implemented it.in accordance with the General Permit Part I1 Section A. We do agree that we have not always written a Tiered response after each BMV exceedence, but that requirement is noted in Part 11 Section B. Analytical Monitoring Requirements. We will review the analytical data from the last sampling event, and write a Tiered response in accordance with the Permit, We will now address the Required Response per Page 2 of 2 of your letter: ']'his letter will be submitted to your office on or prior to May 2 3, 2018 2_. We will evaluate all discharge points. With the addition of the outfall point- at the boat lift, there are now six (6) points -which discharge stormwater runoff from our prop'&ty. This_ sixth outfall point at, the boat lift is an erosional channel, and we will consider potential "fixes" to eliminate it as a point -source discharge. If we can eliminate this outfall, we will notify your office. In the meantime; we will collect a sample at this location during this current sample collection period. Previous evaluations of the outfalls did not indicate an illicit discharge. Boat washwater is contained within a shallow pond that has no outlet to surface waters and no point source discharge to waters of the State. 3. Tier Two protocols for Cu and Zn will be implemented at SDO-001 and SDO-002, and samples will be collected in May 2018. DMRs will be sent directly to you in addition to the Central Files as soon as we receive the lab reports. 4. The Pond that collects the boat washwater will be excavated to a depth no less than one (1.0) foot above the seasonal high water table, then lined with an HDPL liner material. All removed sediment will be disposed in a permitted construction debris landfill. The blue -stained gravel surrounding the wash pad will be excavated to a depth of 3 inches, removed from the site, and then disposed in a permitted construction debris landfill. Note that the washwater pond is part of a closed -loop treatment system consisting of the Vanish300 device. 5. All containers containing a chemical or petroleum product will be stored indoors or within a designated shed. G. Used oil receptacles will be placed on spill containment racks and protected from precipitation with a canopy- or shed -type roof. 7. Written documentation describing improved BMPs for bottom paint removal and painting will be submitted to your office no later than May 31. We will ensure that BMP 1-8 indicated on Table 4 will be fully implemented. Under your Summary remarks, you indicate that we may need to consult with DWR regarding the closed -loop treatment system. It is our understanding that this device was deemed permitted several vears ago. We will follow-up as you recommend. On the Checklist, you have indicated that we are not in compliance with semi-annual Qualitative Monitoring. We disagree; we have monitored all four outfalls qualitatively on a semi-annual basis since at least 2010. On the Checklist, you have indicated that we are not in compliance with Analytical Monitoring from Vehicle Maintenance Areas. We disagree; we have no Vehicle Maintenance Areas. Perhaps this is just semantics as other General Permits break-out additional monitoring at Vehicle Maintenance Areas when New Motor Oil Usage exceeds 55 gallons/ per month. General Permit NCG 190000 makes no distinction. The following observations were noted during the DEVILR inspection (please see the attached addendum for additional information about your permit): i . The annual summary data monitoring report from 2016 and 2017 stated that the expense of monthly monitoring does not improve water quality. Exceedances from outfalls in Tier One require that the operator follow protocol that documents response to the exceedance. Upon the second consecutive exceedance, the operator shall immediately institute Tier Two protocols. - Exceedances of benchmarks on four occasions during the permit term requires Tier three actions. Outfalls one and two currently qualify for Tier Three for Copper and Zinc. Relief from monitoring requirements can only be granted from this office. 2. A stormwater pollution prevention plan has not been implemented and is a violation of Permit Condition Part 11 Section A. There is no recorded documentation of responses for these exceedances. Report sampling results to this office. 4. The recycled wastewater from the power washing station should be evaluated in chat the pond should be lined to prevent groundwater contamination. The gravel surrounding the pad should be replaced on a schedule as to prevent pollutant concentration. This permit does not authorize wastewater discharges. 5. Any chemical containers should be kept in a secure location. Remove; all chemical waste containers from the yard. 6. Used oil receptacles should be on spill prevention racks. 7. The annual summary of data submitted revealed that copper has exceeded benchmark values at outfall one and two in the last four sampling events. Zinc has exceeded the benchmark value for outfall one the last three samples, outfall two is the last four events. The summary includes a sample event on 11/30/2016 that far exceeded the benchmark values in which there is no written documentation of possible sources. The site is generally well kept. There were some housekeeping items that needed to be addressed. A better used oil station should be established as oil residue was on the ground around the containers. Used chemical containers should be removed from the site. Label all containers used for trash to be labeled as such. Any containers with chemicals in them should be stored in a secure location_ The power washing station should be evacuated to prevent infiltration to the ground. The area around the washing station appeared to have a bluish tint. The gravel around this area should be scheduled to be replaced as needed. The wastewater should be limited to the concrete area. The wastewater pond needs to be lined 10 prevent infiltration. You may need to consult with the Division of Water Resouces regarding closed loop wastewater permitting. The annual summary data monitoring report from 2016 and 2017 stated that the expense of monthly monitoring does not improve water quality. The summary includes a sample event on 11/30/2016 that far exceeded the benchmark values in which there is no written documentation of possible sources. The site is generally well kept. There were some housekeeping items that needed to be addressed. A better used oil station should be established as oil residue was on the ground around the containers. Used chemical containers should be removed from the site. Label all containers used for trash to be labeled as such. Any containers with Chemicals in them should be stored in a secure location. The power washing station should be evaluated to prevent infiltration to the ground. The area around the washing station appeared to have a bluish tint. The gravel around this area should be scheduled to be replaced as needed. The wastewater should be limited to the concrete area. The wastewater pond needs to be lined to prevent infiltration. While the metal concentrations have been up and down over the past several years, and almost'never below the BMV, there are no additional feasible BMPs-that can be implemented to consistently reduce Copper below the Benchmark Value. There are several reasons why Copper measurements will probably never be below the benchmark value at our boatyard: • The BMV of 0.005 pptn for Copper in stormwater discharges into saltwater bodies is extremely low. • The General Permit allows discharges of' potable water. The USEPA has set an action level of 1.3 ppin for Copper in potable water. It does not seem reasonable that one allowable discharge (potable water) can have a much higher Copper level than another discharge (stormwater). lt's not reasonable to expect any permittee to treat stormwater to a level cleaner than potable water with available and feasible technology. • Research performed by Bentsen and Garber (littps://fot-esternetwork.com/stormwater- ma ,azit)e/sNv-water/sw-stormwater-management/evaluating-urban-air-deposition- industrial-facility-seattle/ has indicated that urban air deposition may account for a significant load exceeding 0.005 ppm by a factor of-5 to 10 into stormwater discharges. • This facility is located near other boatyards that have a legacy of Copper usage in the form of boat bottom paint. There is already a second outfall (SDO-001) near the wash pad that collects runoff from a small area of the southern portion of the site. This outfall has been subject to qualitative monitoring since this consultant was hired in 2007. During our site visit of June 29 2011, it was determined that C1393.1 is connected to an off -site storm pipe. It was previously believed that CB43.1 acted as a dry well with no discharge point. Thus�003 is a new outfall at CB#3.1. Upon further review of the site's topography and drainage patterns, we have identified a fourth outfall (SDO-004) that drains a portion of the southeastern area of the facility. 2. The Permittee is committed to providing adequate protection for all POL storage tanks and containers. Bulk tanks not currently provided with secondary containment will have secondary containment provided as indicated in the General Permit before December 31 20,11. Smaller tanks and containers will either be provided with secondary' containment or replaced with double -walled tanks and placed under a shed or canopy roof; this action will occur no later than January 31, 2012. The Permittee currently implements the practice of daily site observations in which fresh oil drips are cleaned each day. A Spill Response Program is in place; no significant spills have occurred at this facility since January 1 2011. 3. Other yard inlets around Bldgs 2 and 3 act as dry wells and have no discharge point. 4. The ditches along the south property line are co -shared with adjacent industrial property owners. This Permittee's runoff enters these ditches as sheet flow and is not subject to monitoring; there are no defined outfalls from this Permittee's industrial activity areas into these ditches except at SDO-002 which has been a designated outfall under the original Permit. In our opinion, there are no other point source discharges except for the four outfalls identified on Map 2 in the SWPPP. 5. We have attempted to identify the source of the "whitish flow" that a citizen complained about. We have watched surface runoff and sheet flow from this site during rainfall events. We believe the "whitish flow" is a result of the previous activities at this site — it was a concrete products manufacturing plant — and the fact that the soils are very light tan/ gray in color. Residual cement and concrete dust on the boatyard is the most likely source of whitening the flow. The light colored soil particles transported in sheet flow will also cause a whitening of.the flow entering the adjacent Intracoastal Waterway. As a part of the CHPP, reducing sources of pollution that may result in degradation of water quality and{or aquatic habitat is a high priority for the North Carolina Division of Water Quality (DWQ) as well as other agencies Accordingly, DWQ conducted a comprehensive study of a number of industrial activities and services offered by facilities within the marina industry; specifically, the study focused on pressure washing and hand washing activities. Results of this study show significant levels of metals in waste streams from these pressure -washing and hand -washing activities. National studies have shown similar results. In addition, these other studies show these types of chemicals from pressure -washing and hand -washing to negatively impact benthic organisms from the bioaccumutation of metals in their natural habitat. The wash water generated by industrial activities is defined as a processed wastewater. DWQ is encouraging all North Carolina marinas and boatyards to take the steps that are necessary to ensure that your facility is taking a proactive approach to help reduce the water quality impacts resulting from the chemical constituents found in this processed wastewater. We recognize that some marinas and boatyards have taken proactive measures to minimize the impact from these activities on water quality. Some of these measures include collection and containment devices, closed -loop recycle systems, and other Best Management Practices (BMPs). However, there are many facilities within our marina industry where BMPs have not been pursued or implemented. Stormwater Management of Industrial Activities Stormwater runoff is regulated by the Environmental Protection Agency (EPA) through the National Pollutant Discharge Elimination System (NPDES) permit program. Facilities must re -certify No Exposure status every five years. What if I sell my business, or the name changes? This is a minor modification that requires approval of DWQ's director before a permittee is absolved of responsibility for the permit. However, you may request Representative Outfall— Status (ROS). If approved, this status allows analytical monitoring at fewer outfalls. Frequently Asked -Questions ..Wastewater is not allowed to mix, or be `'diluted", with stormwater for discharge at a stormwater outlet unless permitted by a separate wastewater permit. Once stormwater commingles with wastewater, it is all considered wastewater and must be'handled as such. Does a certified lab need to analyze my samples? State certification requirements apply only to wastewater discharges. However, data gathering and monitoring under all NPDES permits must be conducted in accordance with test procedures approved under federal. regulations as written in 40 CFR §136. All labs certified by North Carolina perform analysis in accordance with those procedures. Using a certified lab is one way to ensure compliance with your permit. The state Division of Water Quality (DWQ) is the agency responsible for implementing this program in North Carolina. Now, two decades later, our state's rapid growth and development rates make the protection of our water resources more critical than ever before. What Is stormwater runoff? It is rain or snow -melt that flows over land and other surfaces following a precipitation event. As the runoff travels along, it picks up pollutants in its path and carries them to the nearest waterway, stream or storm drain, stormwater runoff washes many types of pollutants into our surface waters, including chemicals, litter, bacteria, motor fluids and much more. Why is it such a problem at marinas, shipyards and boatyards? The vast majority of these facilities are located only a short distance (or adjacent to) creeks, streams, wetlands, lakes, rivers and other waterways. Activities such as paint removal, sanding, engine maintenance, hull surface preparation and washing are specific to these facilities. Those activities generate high levels of particularly toxic pollutants including heavy metals, fuel, oil, solvents, paint solids and detergents. The presence of these types of pollutants, combined with the close proximity to surface waters, greatly increases the risk of generating highly polluted stormwater runoff. This is why your facility requires a stormwater permit. What is a stormwater. permit? The'DWQ industrial general permit (NCG190000) allows stormwater discharges from certain activities associated with marinas and ship or boat building and repair. Requirements of this permit aim to reduce the level of pollutants in stormwater runoff that flows to nearby creeks, streams, wetlands and waterways. The end result is greater water quality protection. Who is required to get a stormwater permit? Facilities such as marinas and ship or boat yards that provide vessel maintenance, building and repair, or other activities deemed by DWQ to be similar, are required to obtain this permit. A facility must have this permit unless all industrial activities are performed indoors and there is no potential for contact with, or impact to, stormwater runoff. What If I fail to get a permit and continue to operate my facility? Civil penalties of up to $25,000 a day per violation can be assessed against facilities that fail to obtain a stormwater permit, violate the conditions of their permit or violate water quality standards. How will complying with state permitting laws help my business? Tourism and recreation are multi -billion dollar industries in North Carolina, in large part due to the pristine beauty of our water resources that include streams, lakes, rivers, bays, marshes, the Intracoastal Waterway and ocean. Protecting those resources is an investment in the future of your industry and our state's economy. What can I do to reduce pollutants in stormwater runoff from my facility? A stormwater permit does not authorize wastewater discharges. What is wastewater? It is water that flows from a work area and contains waste material as a direct result of a certain activity. Typical wastewater discharge sources include, but are not limited to, bilge and .ballast water, cooling water, sanitary wastes, pressure and hand washing of vessels, blasting, sanding and fish -cleaning stations. Like stormwater runoff, wastewater from marinas and boatyards easily flows into nearby or adjacent waterways, impairing water quality. What actions should I take to eliminate wastewater discharges from my facility? • Collect wash water in a storage tank and hire a certified waste handler to pump and haul it away. • Install collection systems around wash areas, directing wash water to a holding tank for proper disposal or to a sanitary sewer (if approved by your local government's wastewater treatment plant). • Install a collection device that holds all wastewater but doesn't release it to surface waters. -An evaporative system may help with this.,... • Closed -loop recycle systems collect wash water for treatment and reuse. Note: Due to the high toxicity of wash water, even after treatment, it is not allowed to be discharged on land or into surface waters. Contact a certified waste handler for proper disposal as needed. • Portable wash stations collect and contain wash water during the pressure -washing process. Some facilities choose to pump water out of the portable wash station, store it in a holding tank until capacity is reached, then have the wastewater hauled away by a certified waste handler. Are there any programs that recognize compliant, clean marinas? The N.C. Clean Marina Program offers incentives for becoming a greener, cleaner facility. Clean Marinas receive a flag to display at their facility and are acknowledged on several agency Web sites, as well as on the annual "Coastal Boating Guide" map which is distributed at welcome centers and tourism offices statewide. Keith Brewer of the Carteret County Sheriff Office who was on patrol in the area of Marshallberg Rd., and advised him of a large trash fire at the end of Marshallberg Rd. Lt Brewer drove to the Marshallberg Fire Dept. an advised the on -duty crew. Responding to the fire was Asst. Chief Tom Mann, and Firefighter Margaret Riggs. On their arrival, they observed a large trash fire fully involved if fire from one end to the other. Firefighter Riggs states that Dale Chadwick came up to her and stated that he started the fire to get rid of the trash that had been dumped there. He used gasoline, and was standing next to a gas can. At this time, Charles Morris arrived on scene and stated that they had a burn permit. He also stated that the owner of the property had paid them to get rid of the trash that was there. I was notified via cell phone by Firefighter Riggs. I told them to extinguish the fire and that I was responding. While enroute, I notified NC Dept. of Natural Resources, Air and Water Quality, and informed them of the incident. 1 was advised that Linda Willis from Water Quality would be responding due to the water -run-off from the fire into the harbor. After the fire had been extinguished, the fire dept left the scene, and I waited on scene for Water Quality. After Linda Willis finished her investigation, we left the area. The detection level for mercury is not low enough even with diltion factor of 5 to 1 to demonstrate levels were below WQ standard Summary: Selenium appears higher than WQ standard. The sample had to be diluted 5 to 1. Salinity causes interference with the analyses, therefore I would compare the concentrations at the bulkhead to the upstream sample taken at the 70 crossing over the N River (see map). Upstream concentration for selenium was the same as that at the Bulkhead Instream at Bulkhead - there were 3 sets of samples collected in stream at the bulkhead The samples collected spanned (equidistant) from each other, the west end of the rubbish pile to the east end of the rubbish pile. The detection level for mercury is not low enough even with diltion factor of 5 to 1 to demonstrate levels were below WQ standard Summary: Selenium appears higher than WQ standard. The sample had to be diluted 5 to 1. Salinity causes interference with the analyses, therefore I would compare the concentrations at the bulkhead to the upstream sample taken at the 70 crossing over the N River (see map). UdA7E Stormwate Permitting Requirements for North Carolina's oZ °CU Marinas, Shipyards and Boatyards 6 Since 1990, the federal National Pollution Discharge Elimination System (NPDES) regulations have mandated that certain industrial activities —including activities at marinas, shipyards and boatyards —be monitored and permitted to reduce the impact of polluted stormwater runoff that enters the nation's waterways. The state Division of Water Quality (DWQ) is the agency responsible for implementing this program in North Carolina. Now, two decades later, our state's rapid growth and development rates make the protection of our water resources more critical than ever before. What is stormwater runoff? It is rain or snow -melt that flows over land and other surfaces following a precipitation event. As the runoff travels along, it picks up pollutants in its path and carries them to the nearest waterway, stream or storm drain. Stormwater runoff washes many types of pollutants into our surface waters, including chemicals, litter, bacteria, motor fluids and much more. Why is it such a problem at marinas, shipyards and boatyards? The vast majority of these facilities are located only a short distance (or adjacent to) creeks, streams, wetlands, lakes, rivers and other waterways. Activities such as paint removal, sanding, engine maintenance, hull surface preparation and washing are specific to these facilities. Those activities generate high levels of particularly toxic pollutants including heavy metals, fuel, oil, solvents, paint solids and detergents. The presence of these types of pollutants, combined with the close proximity to surface waters, greatly increases the risk of generating highly polluted stormwater runoff. This is why your facility requires a stormwater permit. What is a stormwater permit? The DWQ industrial general permit (NCG190000) allows stormwater discharges from certain activities associated with marinas and ship or boat building and repair. Requirements of this permit aim to reduce the level of pollutants in stormwater runoff that flows to nearby creeks, streams, wetlands and waterways. The end result is greater water quality protection. Who is required to get a stormwater permit? Facilities such as marinas and ship or boat yards that provide vessel maintenance, building and repair, or other activities deemed by DWQ to be similar, are required to obtain this permit. A facility must have this permit unless all industrial activities are performed indoors and there is no potential for contact with, or impact to, stormwater runoff. What if I fail to get a permit and continue to operate my facility? Civil penalties of up to $25,000 a day per violation can be assessed against facilities that fail to obtain a stormwater permit, violate the conditions of their permit or violate water quality standards. How will complying with state permitting laws help my business? Tourism and recreation are multi -billion dollar industries in North Carolina, in large part due to the pristine beauty of our water resources that include streams, lakes, rivers, bays, marshes, the Intracoastal Waterway and ocean. Protecting those resources is an investment in the future of your industry and our state's economy. What can I do to reduce pollutants in stormwater runoff from my facility? There are a variety of "best management practices" (BMPs) that help to reduce the risk of pollutants entering stormwater. Listed below are possible measures and methods for use at your facility. Non-structural (practices or activities) BMPs: • Eliminate exposure of materials and equipment by moving items to indoor locations. • Practice good housekeeping on -site: handle and store all materials in an orderly fashion. • Exchange hazardous materials for non -hazardous ones whenever possible. • Establish a set schedule of leak and maintenance checks to minimize the risk of spills. • Be sure staff is trained to respond immediately to clean up any spills that occur. • Establish bulk storage tank procedures that minimize the risk of spills during loading and unloading. • Maintain wash pads and keep them cleared of paint chips, debris and particles from site activities: Structural (equipment or devices) BMPs: • Create containment dikes around the loading areas of bulk -liquid storage containers. • Build roofs and secondary containment around materials to prevent exposure to stormwater. • Convert from a liquid operation to a dry operation for hull maintenance and cleaning. • Minimize contamination by using tarps or other devices to collect debris such as paint chips from boat maintenance and paint removal areas. • Locate hull maintenance areas as far away as possible from waterways. What about pressure washing and other activities that generate water discharges at my facility? Many marina and shipyard or boatyard activities generate wastewater. A stormwater permit does not authorize wastewater discharges. What is wastewater? It is water than flows from a work area and contains waste material as a direct result of a certain activity. Typical wastewater discharge sources include, but are not limited to, bilge and ballast water, cooling water, sanitary wastes, pressure and hand washing of vessels, blasting, sanding and fish -cleaning stations. Like stormwater runoff, wastewater from marinas and boatyards easily flows into nearby or adjacent waterways, impairing water quality. What actions should 1 take to eliminate wastewater discharges from my facility? • Collect wash water in a storage tank and hire a certified waste handler to pump and haul it away. • Install collection systems around wash areas, directing wash water to a holding tank for proper disposal or to a sanitary sewer (if approved by your local government's wastewater treatment plant). • Install a collection device that holds all wastewater but doesn't release it to surface waters. An evaporative system may help with this. • Closed -loop recycle systems collect wash water for treatment and reuse. Note: Due to the high toxicity of wash water, even after treatment, it is not allowed to be discharged on land or into surface waters. Contact a certified waste handier for proper disposal as needed. • Portable wash stations collect and contain wash water during the pressure -washing process. Some facilities choose to pump water out of the portable wash station, store it in a holding tank until capacity is reached, then have the wastewater hauled away by a certified waste handler. Bottom Sanding BMP 1. When sanding boat bottoms indoors or outdoors, a -tarp or sheet of plastic shall be securely placed around the entire perimeter of boat. The outer perimeter of the tarp/plastic shall extend 10 feet from the outer edges of the boat hull. 2. A raised edge shall be established around the outer perimeter of the tarp/plastic to prevent contamination to soil or ground outside of the tarped zone. This can be accomplished with 8" x 8" blocks or 6" PVC piping border. 3. Once bottom sanding is completed, all bottom paint particles contained in ground tarp/plastic shall be collected and disposed of to landfill bound dumpsters.
