During: site insp tions•to determine NCG190000 compliance, some marinas have received varnings or notice -of -violations regarding power wash discharges. It has been tated by NCDWQ regulators that power washing — even if the flows infiltrate into the ground — must be prohibited unless the power wash flows are dischargec to a municipal sanitary sewer system or to a closed -loop recycling system. We do not believe that boat wash flows in any oral — power, hand, -or "garden - hose" — constitute a violation of NCG190000 ap long as the flows infiltrate into the ground and do not result in a point sourc discharge through an outfall or surface flow into the rimadna basin. NPDES General Permit NCGO80000. allows -fo the- infiltration of vehicle wash waters. Other permittees should be, a"ccarded a same, option. NCG190000 was re -issued Septe ber 1, 2004. Marinas started - receiving these warnings (negative findings) and NOVs in Novernber and December 2004. The re -issued Permit does n even mention boat power wash water flows. Why was this concern not broug up during the public comment period prior to re -issuing NCG190000? Is there evidence that boat power wash wat flows are causing :surface or ground water degradation? We will be under contract to perform the outfall monitoring, including stormwater discharge sample -collection and analysis. As you are aware, outfall monitoring is weather -dependant. However, we will make every effort to collect samples before the end of March 2005, and submit the results to your office as soon as we receive the laboratory report. We will visit the marina next week and begin preparation of the SWPPP. The Plan will be available for your review no later than March 31, 2005. Klimek, P.E. Director Division of Water Quality The North Carolina Division of Water Quality conducted a recent inspection of Atlantic Marine on November 10, 2004. This inspection was conducted to determine if the facility is operating in compliance with the conditions and requirements specified in NPDES General Permit Number NCG190000. Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the findings of the inspection and a summary of compliance issues. It was determined that the facility is noncornpliant with the conditions of the permit. A Stormwater Pollution Prevention Plan (SWPPP) has not been prepared and monitoring is not being done. There are also several problematic activities on the site. Pressure washing of boat hulls is being done at the edge of a wetland that is tributary to the sound, allowing toxic constituents of antifouling paint to enter surface waters. Boats are being washed on paved surfaces with no implementation of Best Management Practices to reduce impacts. Within ten days of receipt of this notice, please respond with a schedule for implementing actions necessary to achieve compliance with the General Permit. Monitoring must be initiated as soon as possible and the SWPPP must be prepared within sixty days. Failure to take action to achieve compliance in a timely manner will result in recommendations for assessment of civil penalties. VEHICLE[EQUIPMENT MAINTENANCE AREA: It appears that maintenance is being done within the shop area with no exposure to rainfall. VEHICLEXQUIPMENT WASH AREA: Boat hulls are being pressure washed on pavement at the edge of a marsh that is tributary to Molts Channel, allowing the discharge of toxic constituents contained in antifouling paint. Also, boats are washed on pavement in the sales area and boats are staged over pavement at the edge of the water for washing by customers. No control measures are being employed to collect washwater and reduce impacts to surface waters. TEMPORARY STORAGE OF WASTE MATERIALS: It appears that the storage of waste oil is being done in an appropriate mannef. OUTDOOR STORAGE OF MATERIALS: The 350 gallon above ground diesel fuel storage tank has secondary containment, as required. Boats are staged outside for sales and while awaiting service. Boats in dry storage are within a covered building. These practices are not problematic. SPILL RESPONSE AND CLEANUP PROGRAM: The facility appears to be prepared for spill response and cleanup. ERROSION CONTROL ON SITE: The site is primarily paved, providing little opportunity for erosion. ILLICIT DISCHARGE ELIIVIINATION: Washwater from pressure washing and hand washing of boats is being discharged to surface waters. There is no indication that other wastewaters are being discharged. WASTEWATER TREATMENT FACILITIES: There are no wastewater treatment systems being employed. STREAM IMPACTSIRESULTS OF SAMPLING: Since no washing was being done at the time of the site visit and a rainfall event was not taking place, no sampling was done. It is anticipated that analysis of washwater would indicate contraventions of water quality standards. SUMMARY: The facility is noncompliant with the conditions of the General Permit. The Stormwater Pollution Prevention Plan has not been prepared. Monitoring is not being done. Pressure washing and hand washing of boats are being done with no collection or treatment of wastewater prior to discharge to surface waters.
