Dear Mr. Clayton:
On August 2, 2017, Paul Williams, Environmental Specialist with the North Carolina
Department of Environmental Quality — Division of Air Quality (NCDEQ — DAQ) conducted a
multimedia inspection at the facility located at 7809 Lebanon Road in Greensboro, NC. The
inspection discovered several deficiencies regarding the facilities industrial stormwater permit.
This facility holds General Stormwater Permit NCG160174 to discharge stormwater from
industrial activity associated with Asphalt Paving Mixtures and Blocks [SIC 29511 under the
National Pollutant Discharge Elimination System (NPDES). The permit became effective
October 1, 2014 and expires on September 30, 2019. A copy of the current permit is required to
be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. The current
permit was available for review and was included_ in the SPPP at the time of Mr. Williams
inspection.
This facility was required to develop and maintain a Stormwater Pollution Prevention Plan
(SPPP). At the time of the DAQ inspection, the facility had not provided required annual
employee training, had not been conducting analytical and qualitative monitoring bi-annually as
required and had not been required signing annual certification of the SPPP.

The following observations and violations were noted during the NCDEQ multimedia inspection
and subsequent follow-up inspection:
Stormwater Pollution Prevention Plan:
• NCG 160000 Part II Section A requires the permittee to develop an implement a
Stormwater Pollution Prevention Plan that includes items 1 thru 9 of Section A. The
facility was deficient with annual certification of the SPPP and has'not provided or
documented annual employee training as required.
Analytical Monitoring (Bi-Annual) z,
• NCG160000, Part II, Section B requires analytical monitoring to be conducted twice
annually for TSS and total rainfall at each outfall. The facility was deficient in that it has
no record of every complying with the bi-annual monitoring requirement. Also, if the
facility conducts maintenance and uses more than 55-gal/mo. of oil or fluids, they are
required to provide analytical monitoring for vehicle maintenance which includes the
Non -Polar Oil & Grease parameter. Failure to monitor and report in accordance with
the permit terms may result in monthly monitoring and renortingfor a specified time
period
Qualitative Monitoring (Bi-Annual)
• NCG 160000, Part II Section C requires the qualitative monitoring to be conducted twice
annually at each outfall. The facility was deficient in that it did not monitor twice
annually as required. Monitoring requires the person conducting monitoring to go to
each outfall twice each year and document on the qualitative monitoring form what was
observed. It is a visual inspection only. Fill out a separate form for each outfall. Please
begin monitoring twice (2) annually as permit requires.
Your Required Response:
Accordingly, you are directed to respond to this letter in writing within 30 calendar days of
receipt of this Notice. Your response should outline Crow the violations will be addressed and
should be sent to this office at the letterhead address and include the following:
• Stormwater Pollution Prevention Plan: In your response, tell us how you will address
the deficiencies of each of the 9 items of Part II, Section A of the permit and let us know
when you expect to have this issue corrected.
• Analytical Monitoring: Begin bi-annual analytical monitoring. Let us know when to
expect results from your monitoring samples and who will be collecting samples and
what facility you choose to providing testing services.
Qualitative Monitoring'. Begin qualitative monitoring for each outfall. Monitoring
should identify color, odor, clarity, floating solids, suspended solids, foam, oil sheen,
erosion or deposition and any other obvious indication of pollution. A photo taken at of
the water at the time of inspection provides excellent documentation. Your response
should include your expected compliance with bi-annual monitoring.

Thank you for your attention to this matter. Failure to correct the violations may result in this
office's recommendation for enforcement by the Director of the DEMLR (Division of Energy,
Minerals, & Land Resources) if the issues and any future violations continue. This office
requires that the violations, as detailed above, be abated immediately and properly
resolved. Environmental damage and/or failure to secure proper authorizations have been
documented on the subject tract as stated above. Your efforts to undertake activities to bring the
subject site back into compliance is not an admission, rather it is an action that must be taken in
order to begin to resolve ongoing environmental issues.
Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a civil
penalty assessment of up to a maximum of $25,000.00 per day for each violation. Your
above-mentioned,response to this correspondence, the degree and extent of harm to the
environment and the duration and gravity of the violation(s) will be considered in any civil

NCG050254, US Corregated (was LinPac), 7205 Cessna Drive: This is now closed and is for sale. (No info. They are still
paying their annual fee. Maybe they just want to keep the permit current for marketability purposes).
NCG090026, Ashland, 7210 Cessna Drive: This is now another business. (This permit was rescinded back on 7/17/09.
See info attached).
Lastly, NCG160176 (Sharpe Brothers, Vey I�lio- 311 Burnt Poplar Rd) was inspected, and they commented that they had
two other permitted facilities —one o Burgess/Leban EPA notes they have a permit for this facility (NCG160174), but
it isn't on our list. Also, according to the EPA website, their permit expired in 2009. Bottom line is should this facility on
Lebanon be on our list? (Not sure why it is not on your list as it is an active permit. See info attached. Also not sure why
it is still expired. Do you have a name/phone #/email for a contact there?).

Your facility is currently covered for stormwater discharge under General Permit NCG160000. This permit expires on
July 31, 2009. The Division staff is currently in the process of renewing this permit. When a draft is available for
notice and public comment, it will be posted on our website at http://h2o.enr.state.nc.us/su/publicnotice.htm. Please
continue to check this website to review and comment on proposed changes to the permit. Once the permit is
reissued, your facility would be eligible for continued coverage under the reissued permit.
To assure consideration for continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit. Enclosed you will find a Permit Coverage Renewal Application Form. The
application must be completed and returned by March 6, 2009. Letters confirming our receipt of the completed
application will not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $25,000 per day.
"No exposure exclusion" is now available to industrial facilities in any of the categories of "storm water discharges
associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of
"no exposure", i.e. the facility industrial materials and operations are not exposed to stormwater, you can apply for
the no exposure exclusion. For additional information contact the Central Office Stormwater Staff member listed
below or check the Stormwater Permitting Unit Web Site at http://h2o.enr.state.nc.us/su/Noexpexempt.htm.
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions can be found on the bottom of the form. You will be notified when
the rescission process has been completed.

This inspection letter is being sent as a replacement for the Notice of Violation that was
sent to you by our office on May 16, 2008. The Notice of Violation is therefore retracted based
on further consideration after receiving your written response.
On May 14, 2008, Jenny Graznak of this office performed a General Stormwater Permit
Inspection at the Vecellio & Grogan North Carolina 1 Sharpe Brothers Asphalt plant located at
7809 Lebanon Road in Greensboro, North Carolina. This facility holds General Stormwater
Permit No. NCG160174 under the National Pollutant Discharge Elimination System (NPDES) to
discharge Stormwater from activities associated with Asphalt Paving Mixtures and Blocks. You
and Robert Kennedy (Safety Director) were present for the inspection. This type of inspection
consists of two basic parts: a review of facility files and self -monitoring data and an inspection of
the facility's discharge points. This particular inspection evaluated five (5) areas, and
observations from each area are addressed below:
1. Permit
The permit became effective August 1, 2004 and expires July 31, 2009.
2. RecordslReports
The facility has a Stormwater Pollution Prevention Plan (SPPP) that includes a location map,
site plan, storage practices, and a list of Best Management Practices on the site. Employee
training in stormwater pollution prevention occurs on an annual basis. Please make sure that
the SPPP is reviewed on an annual basis and updated as necessary.
3. Facility Site Review
The site includes an asphalt production area and an aggregate storage area (sand, gravel,
debris, etc.). The asphalt production area houses two liquid asphalt tanks and two fuel oil tanks
protected with secondary containment. The plant manager is required to observe the standing
water in -the containment area for signs of contamination (oil sheen, color, foam, etc.) prior to its
release. The water is restrained by manually operated and locked valves. Records are
maintained of inspections of the containment area, which occur after every rain event. A&D
Environmental is typically contracted to remove Stormwater from the containment area if any
signs of containment are noted. In fact, A&D visited the site on the day of the inspection to
remove Stormwater from the containment area.

4. Effluent/Receiving Waters
Stormwater from this site drains to Brush Creek (Class WS-111, NSW) in the Cape Fear River
Basin. There is one detention area in the far back corner of the site that collects all Stormwater
from the site. The discharge from this area is the only Stormwater outfall on the site. However,
due to the design of the site, Stormwater runs through such a wide vegetated buffer in front of
the detention area that it appears that very little Stormwater ever reaches the outfall. No
problems were noted at the outfall.
5. Self -Monitoring Program
Your permit requires semi-annual qualitative and annual analytical monitoring at the stormwater
discharge outfali on your site. It was determined during the inspection that you have not been
performing these self -monitoring requirements, as outlined in Permit text Part 11, Sections B & C.
As described above, it was noted during the inspection that very little Stormwater, if any,
reaches the outfall. However, since the permit requires documentation of semi-annual
qualitative and annual analytical monitoring at the stormwater discharge outfall, please start
documenting inspections of the outfall at the time intervals mandated in the permit to satisfy
these monitoring requirements. If there is no Stormwater at the outfall, simply state in your
inspection documents "No Discharge,"

We have had the opportunity to review the above -referenced Inspection Report and Notice of Violation
issued to Vecellio & Grogan/Sharpe Brothers as a result of Ms. Jenny Graznak's May 14. 2008
inspection of our Greensboro asphalt plant. We take this report. the Notice of Violation. and our strong
environmental compliance record seriously. We are writing to express our concern as to the statements
contained in sections 4 and 5 of the report in general and the Notice of Violation included in section 5,
in particular. As you'll note from the report, these sections deal with the detention. discharge. and
nlomtorrrlg of storm water at our facility.
We do not believe that the Notice of Violation contained in section 5 related to monitoring of storm
water at the storm water discharge outfall is appropriate given the minimal quantities of stortn water
present at the facility. Indeed, as the report points out in section 4, very little storm water ever reaches
the outfall due to the :wide buffer in front of the detention area and the layout of the site. Based upon
these facts.. at any given time, the discharge outfall, which is the very location subject to the self -
monitoring requirements we are alleged to have violated, contains minimal amounts of storm water. if
any, We do not, therefore, believe that the self -monitoring requirements cited ill Section 5 are
implicated, that we have violated these requirements, or that any corrective actions are necessary in
order to abate the stated violation.
We welcome the opportunity to discuss this matter with you in more detail and we are willing to provide
you with any additional information you may require in order clarify the matters contained in the report
and, if necessary, to remedy the Notice of Violation.

advising us of the actions taken to abate the violations. Please include in your response a
detailed description of why these violations occurred and how they will be prevented in the
