Gobble has made significant improvements since July of 2016 but the following observations
and violations were noted during NCDEQ's inspection and subsequent file review
Stormwater Discharge - Qualitative Monitoring
General Permit NCG 140000, Part IV Section C requires qualitative monitoring be
conducted twice per year following the established guidelines It appears that one
required monitoring event has been missed since the facility received NOV in July of
2016
2 Stormwater Discharge - Analytical Monitoring
General Permit NCG 140000, Part IV Section A requires the facility to conduct analytical
monitoring twice annually at each of the facilities stormwater outfalls Since the NOD
was issued in July of 2016, this facility has begun to provide analytical monitoring for
Total Suspended Solids (TSS) as required but, has not been monitoring for the required
pH parameter TSS and pH are both required to be collected and tested semi-annually
within the schedule listed in the permit
Required Resnonse
Accordingly, you are directed to respond to this letter in writing within 30 calendar days of
receipt of this Notice Your response should outline how the violations will be addressed and
should be sent to this office at the letterhead address and include the following
1 Provide Qualitative Monitoring of Stormwater Outfalls twice annually Keep records in
the SPPP binder
2 Provide Analytical Monitoring of Stormwater Outfalls per permit requirements defined in
Part IV, Section A TSS and pH are required parameters Keep records in SPPP and
maintain for five (5) year minimum
Thank you for your attention to this matter This office may consider a recommendation for
enforcement to the Director of the DEMLR (Division of Energy, Minerals, & Land Resources)
regarding these issues and any future/continued violations that may be encountered This office
requires that the violations, as detailed above, be abated immediately and properly
resolved Environmental damage and/or failure to secure proper authonzations have been
documented on the subject tract as stated above Your efforts to undertake activities to bring the
subject site back into compliance is not an admission, rather it is an action that must be taken in

On June 23, 2017, Jack Kitchens of the North Carolina Department of Environmental Quality
conducted a multimedia inspection of the Gobble Concrete facility located at 202 Leonard Road
in Lexington Multimedia inspectors are required to conduct their inspections and report any
perceived deficiencies to the division responsible for maintaining permits in that specific area so
that determination can be made as to how to proceed This facility is covered under General
Permit No NCG 140101 which allows the discharge of stormwater point source discharges
associated with activities classified as Ready Mixed Concrete and like activities to the surface
waters of North Carolina
Compliance History
This facility received a Notice of Deficiency (NOD) on July 27, 2016 following deficiencies
discovered during a multimedia inspection and subsequent follow-up At that time the facility
had not developed and was not maintaining a Stormwater Pollution Prevention Plan (SPPP) and
was not conducting any qualitative or analytical monitoring Since receiving the NOD, the
facility has developed an SPPP, has provided training and has begun qualitative and analytical
monitoring The facility has missed one qualitative monitoring event since the last inspection in
July 20t6 Analytical monitoring has been performed for TSS but required pH parameter has not
been analyzed in any sampling event

Inspection Summary
On June 23 2017 Jack Kitchen Compliance Inspector with the North Carolina Department of Environmental Quality
conducted an announced Multimedia Compliance Inspection at Gobble Concrete Company Inc The inspector met with
Chris Garrison Vice President and plant operator who provided the inspector access to the facility s equipment and
available records Gobble Concrete was in operation on the day of the inspection
The site drains to the Northeast section of the property Outfall #1 is identified in the NOI as a reinforced concrete pipe Mr
Garrison showed Mr Kitchen Outfall #1 which appeared of be an area covered in vegetation and brush Mr Garrison stated
that at the bottom of the ditch is a concrete culvert that leads stormwater off the property and under the adjacent railway
The ditch is overgrown and not easily accessible Mr Kitchen observed the ditch in the area of Outfall #1 and did not notice
any evidence of ongoing erosion or recent discharges According to previous inspection observations the ditch would drain
into an unnamed tributary to Abbotts Creek Mr Garrison perfon-ns monitoring and sampling at a location prior to the ditch
and after the settling basin
The concrete mixing trucks are rinsed on the loading pad with water provided by Davidson County The truck wash and
irrigation runoff water drains to a holding basin constructed with gravel berms
The mixing truck cleanout sedimentation basin was observed The area is completely bermed at the far north end of the
property The dikes appeared to be constructed with dirt At the time of the inspection at least one foot of freeboard wa:
observed in the cleanout basin
Admixtures used in the production of concrete are stored in ASTs and inside an enclosed shipping container The loading
door is elevated and leaks or spills would collect at the end of the container A single walled 12 000 gallon diesel fuel above
ground storage tank (AST) was installed in November 2016 and replaced an existing 1 000 gallon tank The tank was
installed with concrete spill containment The spill containment appeared to be adequately sired and in good condition Mr
Kitchen recommended that the drain valve be locked to ensure that accidental releases do not occur
Based on observations documented by the inspector during the June 23, 2017 Multimedia inspection it is recommended
that facility's compliance status be reviewed by DEMLR s Stormwater Program and DWR s wastewater Program to

Inspection Summary
On June 23 2017 Jack Kitchen, Compliance Inspector with the North Carolina Department of Environmental Quality
conducted an announced Multimedia Compliance Inspection at Gobble Concrete Company Inc The inspector met with
Chris Garrison Vice President and plant operator who provided the inspector access to the facility's equipment and
available records Gobble Concrete was in operation on the day of the inspection
The site drains to the Northeast section of the property Outfall #1 is identified in the NOI as a reinforced concrete pipe Mr
Garrison showed Mr Kitchen Outfall #1 which appeared of be an area covered in vegetation and brush Mr Garrison stated
that at the bottom of the ditch is a concrete culvert that leads stormwater off the property and under the adjacent railway
The ditch is overgrown and not easily accessible Mr Kitchen observed the ditch in the area of Outfall #1 and did not notice
any evidence of ongoing erosion or recent discharges According to previous inspection observations the ditch would drain
into an unnamed tributary to Abbotts Creek Mr Garrison performs monitoring and sampling at a location prior to the ditch
and after the settling basin
The concrete mixing trucks are rinsed on the loading pad with water provided by Davidson County The truck wash and
Imgation runoff water drains to a holding basin constructed with gravel berms
The mixing truck cleanout sedimentation basin was observed The area is completely bermed at the far north end of the
property The dikes appeared to be constructed with dirt At the time of the inspection at least one foot of freeboard was
observed in the cleanout basin
Admixtures used in the production of concrete are stored in ASTs and inside an enclosed shipping container The loading
door is elevated and leaks or spills would collect at the end of the container A single walled 12 000-gallon diesel fuel above
ground storage tank (AST) was installed in November 2016 and replaced an existing 1 000-gallon tank The tank was
installed with concrete spill containment The spill containment appeared to be adequately sized and in good condition Mr
Kitchen recommended that the drain valve be locked to ensure that accidental releases do not occur
Based on observations documented by the inspector during the June 23 2017 Multimedia inspection it is recommended
that facility's compliance status be reviewed by DEMLR's Stormwater Program and DWR s wastewater Program to
determine if monitoring violations have occurred A follow up inspection by DEMLR or DWR staff is recommended

On July 13, 2016 Jack Kitchen, Multi -Media Inspector with the North Carolina Department of
Environmental Quality, visited the facility located at 202 Leonard Rd in Lexington to conduct a
compliance inspection as required by your industrial stormwater permit On July 27, 2016 Glen
White of NCDEQ — DEMLR visited the facility to verify findings
Phis facility is covered under General Permit No NCG 140416 which allows the discharge of
stormwater point source discharges associated with activities primarily engaged in production of
Ready -Muted Concrete [SIC 32731 and like activities to the surface waters of North Carolina
1 he following observations and violations were noted dunng NCDEQ's Multi -Media inspection
and subsequent file review and were verified by DEMLR's review
Stormwater Pollution Prevention Plan (SPPP)
The General Permit NCG 140000, Part III, No 1 thru 10 requires the permittee to
develop and implement a SPPP that includes all of the information required in No 1 thm
10 Inspection revealed that this facility has developed a Stormwater Pollution
Prevention Plan but it has not been maintained in accordance with the permit Records
are missing for employee training, responsible party contacts, annual updates,
certification signatures and monitoring records

Inspection Summary

Mr Garrison showed Mr Kitchen Outfall #1 which appeared of be an area covered in vegetation and brush Heavy
equipment had recently disturbed the area while constructing employee parking Mr Garrison stated that this area above a
ditch was Outfall #1 No pipe was observed Storm water may discharge into a steep ditch adjacent to railroad tracks
The ditch is overgrown and not easily accessible Mr Kitchen observed the ditch in the area of Outfall #1 and did not notice
any evidence of ongoing erosion or recent discharges According to previous inspection observations the ditch would drain
into an unnamed tributary to Abbotts Creek
Mr Kitchen observed truck washing and the Irrigation of raw material stockpiles Irrigation water provided by Davidson
County is applied to the aggregate as pretreatment before it is mixed in the truck The concrete mixing trucks are rinsed on
the loading pad with water provided by Davidson County The truck wash and Irrigation runoff water drains to a holding
basin/pond constructed with gravel berms Mr Kitchen observed heavy equipment tracks and process water outside of the
holding basin Mr Garrison explained that a truck destroyed a section of the berm that contained the process water in the
holding basin The damaged section of the berm had been replaced Standing water was observed from the basin to the
area near Outfall #1 At the time of the inspection water was not visible in the ditch the outlet of Outfall#1 (Photos are
filed in the facility folder)
The mixing truck cleanout sedimentation basin was observed The area is completely bermed at the far north end of the
property The dikes appeared to be constructed with dirt At the time of the inspection there was one to two feet of
freeboard in the cleanout basin If a berm was to fail or if a storm event exceeded the capacity of the containment this
process/waste water would drain to Outfall #1 (Photos are filed in the facility folder )
Admixtures used in the production of concrete are stored in ASTs and inside an enclosed shipping container The loading
door is elevated and leaks or spills would collect at the end of the container The shipping container appeared to be
sufficient spill containment however the integrity of the containers construction is unknown
The SPPP kept in the control room was reviewed by Mr Kitchen There were no signatures for responsible parties in the
SPPP Mr Garrison stated that Mr Addy Middleton was in charge of storm water recordkeeping Mr Middleton s
responsibility was outlined in the SPPP s Pollution Prevention Team document The Certificate of Coverage available for
review at the time of the inspection expired on June 30 2016 RIMS data indicates that the facility has renewed the
General Permit until 2017 Mr Kitchen observed that there was no employee training log and Mr Garrison did not have a
working knowledge of the SPPP Mr Garrison stated that there were ten Gobble Concrete employees The SPPP that
was provided to Mr Kitchen was prepared by Mid -Atlantic Associates Inc and was dated October 26 2011 The SPPP
has not been reviewed or updated since 2011 No Qualitative or Analytical monitoring has ever been documented Mr
Middletown has recorded rainfall in the SPPP It does not appear that the SPPP has been implemented
Based on observations documented by the Inspector during the July 13 2016 Multimedia inspection it is recommended
that facility s compliance status be reviewed by DEMLR s Storm water Program and DWR s wastewater Program to
determine if monitoring violations have occurred and if the construction of outfall #1 was performed in compliance It appears
that process water and storm water have the potential to comingle and discharge at the same outfall A follow up inspection
is recommended

Inspection Summary
On July 13, 2016 Jack Kitchen Compliance Inspector with the North Carolina Department of Environmental Quality
conducted an announced Multimedia Compliance Inspection at Gobble Concrete Company Inc The inspector met with
Chris Garrison Vice President and plant operator who provided the Inspector access to the facility s equipment and
avatlabte records Gobble Concrete was in operation on the day of the inspection
The site drains to the Northeast section of the property Outfall #1 is identified in the NOI as a reinforced concrete pipe
Mr Garrison showed Mr Kitchen Outfall #1 which appeared of be an area covered in vegetation and brush Heavy
equipment had recently disturbed the area while constructing employee parkrng Mr Garrison stated that this area above a
ditch was Outfall #1 No pipe was observed Storm water may discharge into a steep ditch adjacent to railroad tracks
The ditch is overgrown and not easily accessible Mr Kitchen observed the ditch in the area of Outfall #1 and did not notice
any evidence of ongoing erosion or recent discharges According to previous inspection observations the ditch would drain
into an unnamed tributary to Abbotts Creek
Mr Kitchen observed truck washing and the irrigation of raw material stockpiles Irrigation water provided by Davidson
County is applied to the aggregate as pretreatment before it is mixed in the truck The concrete mixing trucks are rinsed on
the loading pad with water provided by Davidson County The truck wash and irrigation runoff water drains to a holding
basin/pond constructed with gravel berms Mr Kitchen observed heavy equipment tracks and process water outside of the
holding basin Mr Garrison explained that a truck destroyed a section of the berm that contained the process water in the
holding basin The damaged section of the berm had been replaced Standing water was observed from the basin to the
area near Outfall #1 At the time of the inspection waterwas not visible in the ditch the outlet of Outfall#1 (Photos are
filed in the facility folder)
The mixing truck cleanout sedimentation basin was observed The area is completely bermed at the far north end of the
property The dikes appeared to be constructed with dirt At the time of the inspection there was one to two feet of
freeboard in the cleanout basin If a berm was to fail or if a storm event exceeded the capacity of the containment this
process/waste water would drain to Outfall #1 (Photos are filed in the facility folder)
Admixtures used in the production of concrete are stored in ASTs and inside an enclosed shipping container The loading
door is elevated and leaks or spills would collect at the end of the container The shipping container appeared to be
sufficient spill containment however the integnty of the containers construction is unknown
The SPPP kept in the control room was reviewed by Mr Kitchen There were no signatures for responsible parties in the
SPPP Mr Garrison stated that Mr Addy Middleton was in charge of storm water recordkeeping Mr Middleton s
responsibility was outlined in the SPPP s Pollution Prevention Team document The Certificate of Coverage available for
review at the time of the inspection expired on June 30 2016 RIMS data indicates that the facility has renewed the
General Permit until 2017 Mr Kitchen observed that there was no employee training log and Mr Garrison did not have a
working knowledge of the SPPP Mr Garrison stated that there were ten Gobble Concrete employees The SPPP that
was provided to Mr Kitchen was prepared by Mid -Atlantic Associates Inc and was dated October 26, 2011 The SPPP
has not been reviewed or updated since 2011 No Qualitative or Analytical monitoring has ever been documented Mr
Middletown has recorded rainfall in the SPPP It does not appear that the SPPP has been implemented
Based on observations documented by the Inspector during the July 13 2016 Multimedia inspection it is recommended
that facility s compliance status be reviewed by DEMLR s Storm water Program and DWR s wastewater Program to
determine if monitoring violations have occurred and if the construction of outfall #1 was performed in compliance It appears
that process water and storm water have the potential to comingle and discharge at the same outfall A follow up inspection
is recommended

I visited the site today, and Corey happened to be with me It was better than I expected, as they have made some
Improvements since I was last there We think the best thing for the site, which looks good overall, is to issue the
general permit They are going to work with us on making some minor Improvements to their sedimentation basin, but
they are good to go There was no evidence that any water from the basins, nor the car washing area, has made it to
the outfall area, though they have agreed to beef up the berm around the basins I think we can work best with them
when they are under the permit

Hope you are well This is the one I called you about we've received an NO1 from Ronald Gobble/Gobble
Concrete, Inc for their Ready mix facility in Lexington (Davidson County) for coverage under NCG140000 The
site discharges stormwater and possibly wastewater into Leonard Creek (C)
I've attached all the materials they sent in They state they are not discharging wastewater, but I think we
need to make sure that is the case, and then they may possibly need some kind of wastewater permit —
perhaps a CLRS from LAU (although might be deemed permitted — but that is LAU's call)

Does the Winston-Salem Regional Office have any concerns about issuing this facility a COC for this general
permit?
Let me know if you think if they are discharging or have a likelihood of discharging wastewater If they don't,
also let me know and I can send to LAU (or you can talk to them if you prefer) to see if they want them to get a
CLRS permit/deemed permitting
If we don't receive any objections, we'll issue the COC in 30 days

located 202 Leonard Road in Lexington, Davidson County, North Carolina Gobble mistakenly
ou ht that their construction stormwater permit was sufficient for<operation, and as such are now
applying for this stormwater general perrni -As shown on the attatched drawing, the stormwwater at
the southern portion of the site sheet flows+into adjacent grassy areas The stormwater from the
remaining areas of the site flows to an outfall located at the eastern portion of the site
After loading,'[ uc s are rinsedoff north,of they loading area, There are no soa s or deter ants
used inythis process This is a low volume plant"with only four trucks, so this,wash waterAypically
evaporates or infiltrates intothe ground,before reaching Cutfall 1 When Itrucks return to the site,,,

basin located at the northern portion of the site This basin is completely bermed an withe

Mid -Atlantic Associates, Inc (Mid -Atlantic), on behalf of Gobble Concrete, Inc (Gobble),
appreciates the opportunity to submit this Notice of Intent for the ready mixed concrete facility
located 202 Leonard Road in Lexington, Davidson County, North Carolina Gobble mistakenly
th, ought that their construction stormwater permit was sufficient for operation, and as such are now
applying for this stormwater general permit As shown -on attached drawing, the stormwater at
the southern portion of the site sheet flows into adjacent grassy areas The stormwater from the
remaining areas of the site flows to an outfall located at the eastern portion of the site
After loading, trues are rinsed off north of the loading area There are no sows or detergents
used in this process This is a low volume plant with only four trucks, so this wash water typically
evaporates or infiltrates into the ground before reaching Outfall 1 When trucks return to the site,
waster is added to the drums and this mixina drum cleanout is dischar ed into a sedimentation
basin located at the northern portion of the site This basin is completely bermed and with the
exception of ram that falls directly into the structure, receives no s ormwat�r This basin typically
has approximately one -foot of freeboard and does not discharge Water in the structure eva o2rates
and the soli s are periodical) removed (during dry periods) and placed on site to dry As such,
there is no process wastewater discharge at the site associated with mixing drum cleanout nor is
there a wastewater treatment facility at the site

Your request for a new NPDES NCG140000 General Permit received on November 4, 2010 is being
returned due to the application being substantially incomplete The N01, $100 00 fee site plan, and
location map are enclosed with this letter
The N01 states that this facility produces wastewater discharges from vehicle and equipment
cleaning, wetting of raw material stockpiles, and mixing drum cleaning As such, design specification
and plans must be submitted to demonstrate compliance with NCG140000's effluent limits for TSS,
pH and settleable solids
If wastewater treatment facilities are not currently in place at this facility or you are unable to
demonstrate current compliance with permit effluent limits application for an Authorization to
Construct (ATC) such facilities must be made at the time of N01 submission and requires three (3)
sets of the above -mentions plant specifications, and calculations If treatment works are in place,
Authorization to continue to operate those facilities must be made concurrently with the NOI
submission See page 3 of 5 of the N01 for further submittal requirements and provide this
Information as soon as possible to continue processing of your application

On October 18, 2010, Jemfer Carter, of the Division of Water Quality, performed a stornlwater inspection
at Gobble Concrete, Incorporated on Leonard Rd in Lexington, North Carolina You «ere present for the
inspection The inspection was prompted when the new facility began operating, which you said was in
June 2010
Obsei vations
o The entire site drains to the Northeast corner of the property, near the septic tank, into a ditch that
drains to an unnamed tributary to Abbotts Creel (class WS-III waters)
a No vehicle maintenance is performed on site
Vehicle/equipment washing and Nvetting of raw material stockpiles (approximately 2x/year) take place
on site Vehicle/equipment washing takes place on a bermed concrete pad Residual solids are
allowed to drain & dry, and then removed to a pile which is sold for use in driveways Both areas
drain to the above -mentioned area
o Overall housekeeping is good
Based on the Standardized Tax Code (SIC) for your type of industry (Ready -mixed concrete), Gobble
Concrete, Inc was required to obtain an NPDES General Stormwater Permit rNCG 140000 prior to
beginning operations 1

• Within fifteen (30) business days of receipt of this letter, please submit the Notice of Intent
(application) for NPDES pennit #NCG140000 pro,, ided (enclosed) Send the original application,
along with any required documentation to the address noted on the application in addition, send a
copy to the Winston-Salem Regional Office (WSRO) at the letterhead address
