(Foss) appreciates the opportunity to respond to your NPDES Compliance Inspection Report, dated July 30, 2013. The report was based on observations noted during an NPDES compliance inspection conducted at the above -referenced facility on July 17, 2013. As indicated in the report, the facility was found to be in minimal compliance with the permit requirements. The issues or findings noted during the compliance inspection are listed below in italics, with the responses and/or actions taken provided directly beneath them. Item 9: The location and numbers of the outfalls need to be addressed and corrected, if necessary, on the site plan. Both outfalls need to be sampled for the analytical and qualitative monitoring requirements from this time forward. Stormwater at the site either infiltrates into the sandy site soils, leaves the site as sheet flow or enters the on -site network of drainage ditches. The ditches are interconnected and ultimately discharge off -site at Outfall No. 1, located on the southeast portion of the site. During heavy rain events, stormwater entering the ditches may also overflow and leave the site as sheetflow on the northern portion of the site. Outfall No. 1 is located at the intersection of two drainage ditches, which run along the southern and eastern perimeters of the site. An updated site map showing the direction of flow associated with the on -site ditch network, as well as the location of Outfall No. 1, is provided as an attachment. In addition, a path/walkway will also be cleared along the southeast portion of the site in order to provide better access for outfall monitoring. Qualitative and quantitative monitoring will continue to be conducted on a semi-annual basis at Outfall No. 1. Prior to the July 17, 2013 site inspection, the facility also included a potential stormwater discharge outfall location along the western property boundary of the site (identified on the previous site map as Potential Outfall No. 2). During the site inspection, the portion of the drainage ditch associated with this potential outfali had recently been cleared and over - excavated. Given the overall topographic gradient and general direction of stormwater flow within the ditch, the over -excavation activities ultimately resulted in the formation of a point - source discharge on this portion of the site. In order to eliminate the presence of a second point -source discharge, the portion of the ditch associated with Potential Outfall No. 2 was then backfilled. Stormwater runoff from this area will now be directed into the remaining on - site ditch network, which flows east/west across the site prior to either discharging off -site at Outfall No. 1 or leaving the site as sheetflow on the northern portion of the site. Item 2: Good housekeeping practices need to be increased in dealing with (a) daily inspections of fuel and transmission spills on -site and their immediate clean up (b) daily cleaning of the fuel spills around the fluid drainage area to prevent the fuel from leaving the concrete pad; (c) cleaning up of the debris in the ditches on -site to allow the water to now to the outlets; and (d) areas around the lot need to be bermed to prevent illicit stormwater discharges. Better housekeeping practices will be implemented at the site and incorporated into the day-to-day operations to ensure that spills/releases are cleaned up upon initial discovery. Particular emphasis will be applied to the covered drain racks, bulk fluid aboveground storage tanks (ASTs) and surrounding concrete pad along the western exterior of the scrap metal storage building. Following the July 17, 2013 site inspection, Foss personnel took measures to clean out and remove debris from the on -site ditch network, as discussed with you during the site inspection. In the future, routine measures will be implemented at the site to ensure the ditches remain unimpeded and continue to flow as designed. In addition, Foss personnel also constructed earthen berms along the northern portion of the property (where stormwater runoff would leave the site as sheet flow) to prevent illicit discharges and eliminate the potential for a point -source discharge on this portion of the site. However, the areas along the southern and eastern portions of the site discharge directly into one of two adjacent drainage ditches, which run along the southern and eastern perimeters of the site prior to merging and discharging off -site at Outfall No, 1. The following issues need to be addressed: 1) The ditches on -site have alot of debris in them and should be cleaned out to keep the water moving off the site. 2) A couple of areas around the perimeter of the lot need to be bermed to prevent illicit drainage areas. 3) The facility needs to be more diligent about checking for hydrocarbon spills in the yard daily and cleaning them up ASAP (within 24 hrs)and disposing of the material properly. 4) The confusion of the outfall numbering needs to be addressed. Please send pictures of where you have determined where outfall #1 is (since the location on the site map and the physical location itself did not look to be an outfall) or if you change the location. Please address which outfall has been previously sampled and how you want to address this in the future. Be sure to update the Stormwater Pollution Prevention Plan with this information. 5) Whatever the•facility can do to maintain a vegetated buffer around the perimeter of the lot would benefit the facility itself. The site has tanks that the car fluids are drained into the bottom of the rack where the cars are placed has a secondary catch basin that fluids are captured that do not make it it to the tanks. This catch basin is then drained and the fluids are drained into tanks. The DWQ observed some areas where fluids had drained across the concrete pad where the draining station is located and suggests that additional inspections and general good housekeeping maintanence be stepped up for this area. Although the station is located under a roof, it could cause potential problems if not consistently cleaned and maintained. The answer to this will be determined by Mr. Eubanks and he will respond to this issue. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG100000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances.
