On March 15, 2017 Glen White of the North Carolina Department of Environmental Quality —
Division of Energy, Minerals and Land Resources met with you at the facility located at 194 Red
Marshall Road, to conduct a compliance inspection. This inspection consists of review of the
Stormwater Pollution Prevention Plan and all of its components as well as facility outfalls and
any possible stormwater exposures. Your assistance with inspection was greatly appreciated.
Permit:
This facility holds General Stormwater Permit NCG100112 to discharge stormwater from
industrial activity associated with Used Motor Vehicle Parts and Automobile Wrecking for
Scrap under the National Pollutant Discharge Elimination System (NPDES). The permit
became effective November 01, 2012 and expires on October 31, 2017. The current permit was
available for review and was included in the SPPP.
Records/Reports:
This facility was required to develop and maintain a Stormwater Pollution Prevention Plan
(SPPP) in accordance with Part 11, Section A of the permit. All qualitative and analytical
monitoring records are required to be maintained with the SPPP for a minimum of five (5) years.
Records appear to be current and complete.
Facility Site Review:
This facility is a full service scrap metal and used auto parts dealer. When vehicles are brought
onto the site, fluids are removed under roof. Gas tanks are removed first. Good gas is used in
service vehicles and bad gas is picked up by Universal Refiners for recycling as is antifreeze and
oil. Batteries are charged and tested. Good batteries are placed in sales and are quickly sold.
Bad batteries are picked up for recycling once a pallet is full.

Cars typically stay onsite for approximately 18 months, Crushing is done onsite by a contracted
vendor and around 600 cars are crushed with each visit. Crushed cars are shredded at the
Newcorp Foundary in Monroe, NC. Good tires are stored inside and are sold to the general
public. Bad tired are stored under roof delivered to the landfill periodically. Car parts are
cataloged and stored in the warehouse.
All cars are on stored on gravel. Gravel is in good condition and free of fluid spills. All fluids
are removed from vehicles before they go on the yard.
Effluent Receiving Waters:
Effluent from this facility discharges via two outfalls. Outfall 001-is at the front of the facility
and drainage from the parking lot and traffic coming onto and leaving the site. Outfall 002 is at
the back corner of the facility and receives water from the salvage vehicle yard. Effluent
discharges to Tardy Branch — Class "C" waters of the Roanoke River Basin.
Self -Monitoring Program:
This facility is required to provide Qualitative and Analytical Monitoring on a semi-annual basis.
Monitoring has been performed as per the permit. Analytical samples are collected and
delivered to Meritech in Reidsville for testing. Results appear to fall within parameters with the
exception on one exceedance at Outfall 001, The next monitoring period showed the exceedance
was correct.
The facility was found to be compliant with its industrial stormwater permit. If you have

In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (f) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part 11 of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal,ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases-
• Sections B, C: Failure to perform analytical Stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event," A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
34 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On January 6, 2010, Jenny Graznak of this office performed a Stormwater Permit
Inspection at P & D Automotive located at 194 Red Marshall Road in Pelham, North Carolina.
This facility holds General Stormwater Permit No. NCG100112 under the National Pollutant
Discharge Elimination System (NPDES) to discharge Stormwater discharges associated with
activities classified as Used Motor Vehicle Parts, You were present for the inspection, This
type of inspection consists of two basic parts: a review of facility files and self -monitoring data
and an inspection of the facility's discharge points. This particular inspection evaluated five (5)
areas, and observations from each area are addressed below:
1. Permit
The permit became effective November 1, 2007 and expires October 31, 2012. A copy of the
current permit was available during the inspection.
2. RecordslReports
As required by the Permit, the facility has a Stormwater Pollution Prevention Plan (SPPP) that
was available for review during the inspection. The SPPP includes a location map of the site
and outfalls, along with a site plan listing potential stormwater pollutants and best management
practices used at the site. There is also a Spill Prevention and Response Plan. Employee
Training of the SPPP occurs on an annual basis.
3. Facility Site Review
When a car arrives in the front lot, all of the parts are inventoried and labeled. From there, the
car is moved inside where fluids are drained and engines are removed- Motor oil, antifreeze,
brake fluid, etc. are stored in a tank awaiting pick-up by Noble Oil, which visits the site once per
year. Noble's last site visit occurred on December 28, 2009 according to facility receipts, which
are stored with the SPPP. Gasoline is siphoned from the cars and is either used on -site or if it
the gasoline is dirty or contaminated, it is removed by Noble Oil. Unusable tires are stored
inside and delivered to the county landfill at 3-month intervals. Batteries are stored inside and
any unusable batteries are sold to Battery Masters out of Lexington for recycling. All car parts
are kept inside in parts storage. 'Cars on the back lot are empty. The car crusher visits the site

approximately 1.5 - 2 years depending on inventory. The yard is re -graveled after every visit
from the car crusher.
4. Effluent/Receiving Waters
The facility has two stormwater discharge outfalls. Outfall 001 is in the front of the facility and
drains storm water from the receiving lots and parking lots. Outfall 002 is in the back corner of
the property and drains storm water from the back lot of empty cars. Stormwater from the
property discharges to Tardy Branch (Class C) in the Roanoke River Basin. The outfalls
appeared to be well maintained. Outfall 002 is located outside the fence in a vegetated area.
5. Self -Monitoring Program
An on -site review of the analytical and qualitative monitoring reports during the inspection
showed that all parameters were evaluated per the specifications of the permit. The most
recent analytical monitoring events occurred on May 20, 2008, January 6, 2009, and November
11, 2009. Meritech Laboratories performed the analyses and the results were within permit
limits. You remarked during the inspection that the test for Ethylene Glycol is an expensive one
(over $500 for both outfalls) and questioned the requirement for semi-annual sampling since
you have never received a result over the permit benchmark value. As you know, ethylene
glycol is a toxic organic compound typically found in antifreeze. This particular general permit
(NCG100000) is up for renewal in 2012 and you are encouraged to submit comments to the
Stormwater Permitting Unit at that time. You can either submit these comments to our office for
forwarding or you can send them directly to the Stormwater Permitting Unity at the following

We received a copy of Stormwater Pollution Prevention Plan (SPPP) prepared by McGill Associates
on the City of Statesville's behalf on October 6, 2008. We are providing our review comments to you. Please
address deficiencies and consider revisions to address the following concerns.
• General Comments: This SPPP uses the template SPPP forms available for the Auto Salvage industry
under NCG100000. It is not a problem to borrow from that template; however, several references -to
terms specific to that industry were not removed or modified.. For example, the document references
"Yard Areas" and "Salvage Yard List of Significant Spills," as well as the Total Toxic Organics
(TTO) certification that is not applicable to the Stormwater. Permit for W WTPs. We are advising you
to edit the SPPP more appropriately. Also, please note that the NCG110000 General Permit has a
more recent version of SPPP requirements (although similar to NCG 100000). It is the permittee's
responsibility to ensure its Plan is consistent with the details in the right permit.
• General Location Map (Page 2): The receiving waters are not filled in on the table under the map.
Also, the map (or the site plan) did not•identify that this segment of Fourth Creek is on the 303d
List of Impaired Waters (Please see: http://h2o.enr,state.ne.us/tmdl/documents/303d_Report.pdt).
This receiving stream was listed as impaired in the 2006 report because of fecal coliform and turbidity
standard violations, as well as impaired biological integrity. This information should be recorded in
the SPPP. (Attached is an excerpt from the 303(d) List for your reference.)
• Storage and Activities Description (Page 3): This section includes areas of storage but does not
describe any of the areas that drain to stormwater discharge outfalls. The narrative description section
should also identify activities, storage, loading, disposal, etc. in each of the areas draining to SDO-1, -
2, and -3.

• Stormwater Discharge Outfall Certification Statement (Page 5A): This certification references "the
salvage yard listed below." Please make revisions as appropriate for this type of facility.
• Feasibility Study (Page 6): We recognize that at most WWTPs, expansive stormwater BMP
improvements (such as eliminating all exposure) will not be feasible. However, at the very least this
section of the SPPP could address eliminating exposure. It is acceptable to document it is impractical
and too expensive to place the entire treatment plant, or portions of the plant, under cover at this time.
Perhaps there are smaller areas that could be considered for cover?
• Secondary Containment (Page 7): We noted "5 or less 55 gallon drums of New/Used Oil" listed in
this section. However, this material is not mentioned earlier in the storage areas described on Page 3.
• BMP Summary, Maintenance & Housekeeping (Page 8): You included BMPs currently in practice.
However, this section should also address other BMPs under consideration (both structural, such as
vegetated filters, detention ponds, etc., and non-structural, such as good housekeeping). This section
of the SPPP mirrors the requirement in Part 1I, 2. (c) `BMP Summary'. If there are no new BMPs
under consideration for this year of the plan, it should be noted.
• BMP Summary, Maintenance & Housekeeping (cont.): The `Preventative Maintenance and Good
Housekeeping Program' SPPP requirement of your General Permit (Part 11, 4.) addresses regular
inspections of material handling areas and cleaning schedules. You should note here where records of,
those regular inspections are kept. In addition, the program should specifically identify areas that have
the potential for soil erosion. Have these been identified, or are there no areas at the plant where this
is a potential problem? Also, positions responsible for the implementation of the SPPP are not named
(this would fulfill the requirement in Part II, 6.). The `Responsible Employees' column of this section
only has `YES' noted (meaning trained?) instead of what employee position is responsible.
• Employee Training: Facility personnel or teams responsible for implementing Stormwater
Management Training are not identified in this SPPP (See Part H, 5.), nor is any information included
that demonstrates training is scheduled on an annual basis.
• Spill Prevention and Response Plan (SPRP) (Page 9A): The facility personnel or team responsible for
implementing the SPRP are not identified (as per Part II, 3. of the permit).
• FacilityInspection Program: This requirement of the SPPP (see Part 11, 8.) specifies semi-annual
inspections of Stormwater systems (collection points, conveyances, treatment devices, etc.),
Inspections of these systems may be part of the plant area and equipment inspections already listed on
Page 10 (Stormwater Area Inspection Checklist) of the SPPP, but it is not clear. Ensure that Page t0
of the SPPP you submitted includes inspection schedules of stormwater systems. Note also that the
template used is not consistent with the current text of NCG 110000—these inspections are not
restricted to "once in the spring and once in the fall" as the footnote reads, and the permit does require
they be separated by at least 60 days unless performed more frequently.
• Stormwater Discharge Monitoring Report (DMR) (Page 11): This form is set up for the Auto Salvage
permit. If you ever need to fill out a DMR because of vehicle maintenance activities (the only trigger
for analytical monitoring under this permit), please modify this form as necessary or use the generic

If the facility uses any organic chemical (i.e., solvent, degreaser, etc) that contain toxic pollutants in 40 CFR
401.15 (TTOs as listed on page# 12), they will be identified.
Solvents which contain TTOs will be stored in labeled drums or containers designed to prevent spills and in no
way, allowed to contaminate stormwater.
The facility has implemented an Emergency Preparedness and Response procedure (page# 9) which provides
;facility personnel with instructions to prevent spills and effectively respond to any spill emergencies.
All facility personnel will receive training in the proper handling, storage and disposal of hazardous chemicals in
their workplace.

Dye Testing Verification Results
On December 2, 2008 the City of Statesville Water/Sewer Maintenance Department assisted the 4«
Creek WWTP Senior Operator in conducting some dye tests. The dye test is required for the Storm
Water Permit. The following floor drains were tested:
❖ Maintenance/Generator building.
❖ Chlorine building.
RAS/WAS building.
* Dewatering building.
All of the above drains go back to the headworks of the WWTP.
The following storm drains were tested:
❖ Secondary Clarifier's #1, 2 & I
❖ Area in front of Dewatering building.
All of the above drains flow down to the lower portion of the WWTP. This drainage system carries
the storm water runoff to the outer perimeter of the WWTP.

Marcia, per our conversation on September 30, 2008 regarding the extension for the
Storm water permit # NCG110112. The City of Statesville's Fourth Creek WWTP is
requesting a 30 day extension for submitting a Pollution Prevention Plan and Storm
Water program. This is due to the protocol that the City Council has established
for hiring engineering firms. This will put us over the original due date of
December 31,2008. Therefore, I am requesting that the due date to be moved to

This is a letter in response to the Notice of Violation regarding the Stornw ater Permit #
NCG110112. As of August 22, 2008 1 have mailed a Permit Renewal Application form to the Central
Office of DWQ.ln regards to the Pollution Prevention Plan and the overall Stormwater program, we
have contracted McGill Associates Engineers to have this plan completed on or before the December
31, 2008 due date.

Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection
conducted at the subject facility on August 15, 2008 by John Lesley of this Office. Please
inform the facility's Operator -in -Responsible Charge of our findings by forwarding a copy of the
enclosed report.
This Report is being issued as a Notice of Violation (NOV) because of violations of the
subject permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the
Stormwater Pollution Prevention Plan and Qualitative Monitoring heading of the report. The
cited violations had not previously been cited under either a Notice of Violation (NOV) or a civil
penalty assessment document.. Pursuant to G.S. 143-215.6A, a civil penalty of not more than
twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with -the terms, conditions, or requirements of any permit issued
pursuant to G.S. 143-215.1..Should this Office make an enforcement recommendation relative
to the violations,'.yo.0 will -be advised in writing.
It is required that'a response,to this Notice be submitted by no later than September 18,
2008 addressing the deiicieiicies.notcd in the subject report. In responding, please address your

Inspection Summary:
The facility applied for Certification of Non -Exposure on 9/10/08. The inspection found that the qualifications for
non -exposure are not met by the facility (see Permt and Outfall Section comments below). This office recommends that
the City utilize a consultant to prepare the Stormwater Pollution Prevention Plan due to limited access to required
materials (maps, etc) and time constraints on the WIIVTP staff.
The Division's Stormwater Permitting Unit is sending a permit renewal application. It is required that the facility submit the
completed application by no later than 15 days after receipt of the application. In addition, the Stormwater Pollution
Prevention Plan must be submitted to the Stormwater Permitting Unit by no later than December 31, 2008.

Comment: Stormwater runoff is collected from the aeration basins and digester area
and conveyed through a series of culverts and ditches to Fourth Creek. Three storm
drains are located in the vicinity. of the final clarifiers that discharge to a culvert and ditch
to Fourth Creek. The equipment fueling area stormwater flows down grade to a culvert
and ditch to Fourth Creek. The stormwater from the dewatering, sludge storage, and
bar screen is conveyed to the head of the VWV"P for treatment according to site
drawings of the facility The stormwater collection system from the sludge dewatering
builiding, sludge storage areas, and bar screen have not been evaluated by testing and
there is no documention to show' that the stormwater is actually going back into the
VWVi-P for treatment.. This portion of the stormwater collection system must be
properly tested and documented to show that it does not discharge to the envronment.

A Compliance Evaluation Inspection was performed at P & D Automotive by .fenny
Freeman and Jenifer Krearner on March 4, 2004. This inspection was in response to a complaint
alerting our office to a possible violation of your NPDES General Stormwater Permit No.
NCG 100112 at the above -mentioned property.
The complaint received by this office reported that engines are being pressure washed in
the gravel lot in the front of your facility. It was learned from the inspection that cars are indeed
being hosed off in the front parking lot, but only to rinse off mud. It appears that no soap or oil
and grease are being rinsed off into the storm drain. This practice is allowable by your permit as
long as this condition continues to be met, and if the water drains only into one of your monitored
drainage ditches.
The remainder of the inspection revealed that P & D Automotive Systems is in
compliance with its General Stormwater Permit. This particular inspection evaluated seven (7)
areas. The respective rating for each area is noted in Section C of the attached EPA inspection
report, and the observations during the inspection of each area are addressed in the summary
