Just an FYI that this one was issued today Since they had some things going on at the site to begin with I included some
additional things in the cover letter and in the COC to hopefully make sure that they stay on track Cover letter —
included language about all of the areas Isaiah found in the initial site visit and how they addressed them, COC — added
language to make them aware that their compliance schedule is treating them as a "new facility" so the SPPP and
secondary containment are required at permit issuance

forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215 1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended)
Please note that the NCGO80000 General Permit will expire on October 31, 2018 Typically all
permit COCs are renewed automatically once the General Permit itself is finalized, unless there are
outstanding annual fees There is no need to reapply for a renewal unless the Division directs you
to do so. Be sure to check our program website for updates and public notice of proposed renewal
actions in 2018
We appreciate the efforts of Southeast Bulk's staff to address issues raised from an earlier site visit
Shawna Riddle of our Asheville regional Office conducted a second site visit along with Skip Hutton
of Southeast Bulk on July 1 1, 2018 Based on this site visit these issues have been adequately
addressed for permit issuance
• Secondary containment capacity has been determined and the facility will limit their use of
onsite tanks to those that together are within the calculated containment capacity
• Your outfall point is potentially submerged and DEMLR staff have advised a sampling
location upstream in your pipe system so that results will not be impacted
• Trench drains onsite have been accessed and cleaned to assure that drainage is not
circumvented from the proper flow path Please assure that proper operation and

It appears that storage tanks outside of secondary containment have been removed Please
assure that your SPPP establishes the proper handling of tanks that may be onsite at any
time to assure proper removal or containment
Please be aware that Richlands Creek [segment index number 5-16-(1)b] is an impaired water and
your facility ultimately drains to this waterbody This stream is impaired because of fecal coliform
exceeding the criteria level There are currently no Total Maximum Daily Loads (TMDLs) developed
that affect this watershed Information about TMDLs can be found on the Division of Water
Resources' website https //dM nc gov/about/divisions/water-resources/plannin modeling_
assessmentltmdls In Part 1, Section A, the General Permit explains that for discharges to watersheds

(NCG080151) with Morgan Energy Facility did not respond or pay fees so permit was rescinded in
2012 No current coverage Was material taken from Asheville site to this location?
• 7/3/2018 - Talked with DWR (Zan Price and Brett Laverly) about their NOV for Asheville facility — Feb
2018 NOV for release of Home heating oil Facility also dealing with DWM with issues — corrective
action for UST, contaminated soils from past releases, etc Still working on cleanup Facility
indicated they would not be distributing fuel from the Asheville site any longer DWR will pursue
enforcement for release to River Noted that facility wasn't aware of drain in containment area
Had been covered with debris DWR sent copies of their NOV and other information for the
Asheville facility
• 7/3/2018 - Talked with Shawna about Asheville facility — we issued an NOV in June 2018 Appears
that eh facility was not following their stormwater permit for awhile Permitee hired consultant
and now has SWP3 for the Asheville facility Still unsure where they took the material removed
from the tanks at Asheville She thinks it may have been taken to Waynesville —could be another
location that may need a permit also Talked with Shawna about the possibility of issuing a permit
with conditions to correct things Isaiah found She will review letter if we do this Gave me contact
for company she has worked with — Skip Hutton
• 7/3/2018 —Talked with Skip Hutton about issues that our site inspection found He noted that
larger container in the containment area are empty and that containment has been found sufficient
by consultant? Appears some tanks won't be used, are locked, etc Also noted that containment
walls had been sealed previously and asked for pictures if we had them of problem areas Skip
indicated he would be at the site next week (July 10 -12) and could meet staff on site to discuss
Also discussed Asheville facility— Bulk fuel activities shutdown Some tanks capped and sealed after
being emptied Lube oil tanks with smaller amount of product will remain in operation so they will
need to maintain permit at Asheville facility Sent an email to Mr Hutton noting the issues that
were found in the first site visa
• Emails/calls to Shawna — she will meet with Mr Hutton on site
• 7/11/2018 — talked with Shawna She had been onsite and feels that things have been addressed
and the permit can be issued Containment should be sufficient They had consultant do
calculations and they are only using 6 or 7 tanks in the area, not all of them so the capacity will be
limited Black pipe noted in first inspection isn't their pipe Shawna make recommendation for
monitoring their outfall back upstream to avoid the submerged pipe, possible at the last chamber in
the o/w separator Can work with them on future site visits Trench drains — covers had been
welded shut but they opened and cleaned and took sediment offsite All flow is to the o/w
separator now and there should be no bypass Drums noted in first inspection have been removed

Areas noted with potential leaks where pipes go through containment wall — these are old luhe
pipes that are no longer used and there will be no storage in the well house so no industrial activity
Containment walls sealed in March Mr Mutton will send an email outlining response to our
previous email on the secondary containment capacity — Shawna forwarded on 7/17/2018 Cover
letter addresses response to all items raised in first site visit

On June 22, 2018 1 visited this site for an N61 i' spection No one was present on site During the inspection, the
following items were noted
1) Secondary Containment for the large containers was not sufficient The'containment wall was,observed to be,
leaking accumulated stormwater during the inspection from various cracks that follow the seam of the concrete .�
pad and block wall A few locations where pipes were run through the wall were not observed to'be adequately
sealed around the opening •" t ?�
2) The location,of Outfall #001 is two pipes (one black corrugatedVlastic,pipe, and a white 6" PVC pipe)'vhhich are
partially submerged in an unnamed, tribu' f6ry.of Richland Creek (Classification B,Tr) Due to the intermingling of,
stormwater with the creek, this sampling location would not be appropriate, or representative of the activity on
site The sampling location should be farther -from the creek " '
3) Trench drains on site were partially filled with sediment, and in'some locations, vegetation if the flow from
these trench drains is supposed to flout to the Oil -Water Separator, these areas should be`icleaned put to ' ,l
prevent the possibility of stormwater filling and carrying industrial product out of the trench drains and off site
4) A storage tank and several drums were observed on site, outside the containment area No clear markings were
on the containers to classify their capacity or contents These containers should be moved to a secondary
containment area and identified
It is my recommendation that this facilit NOT be given coverage under NCG080969 as proposed in the NOl until the
above items are addressed (Pictures available if needed)

On February 14, 2018, staff of the Asheville Regional Office inspected Southeast Bulk, LLC, for
compliance with your general permit The General Permit NCGO80797 for this facility was
reissued to Southeast Energy, LLC on November 16, 2017, and is valid for one year Site
inspection was due to a complaint of fuel oil bung released into the French Broad River
Accordingly, the following observations and permit condition violations were noted during the
inspection and subsequent File review
The facility sloes not have a current Stormwater Pollution Prevention Plan (SPPP) This is
a permit reclim ement Southeast Bulk, LLC, must have all permit required
documentation, plans, and reports on file at the facility The SPPP is to be updated
annually. The current copy at the facility was dated July 17, 2007.
2 Southeast Bulk, LLC, is required to conduct inspections of all storinwatei systems at a
minimum on a semi-annual schedule 'I he inspection and any subsequent mlaintenancc
activities peiformed shall be documented and included in the SPPP. Inspections are not
being conducted as required.

On June 22, 2018 1 visited this site for an NOI inspection No one was present on site During the inspection, the
following Items were noted
1) Secondary Containment for the large containers was not sufficient The containment wall was observed to be
leaking accumulated stormwater during the inspection from various cracks that follow the seam of the concrete
pad and block wail A few locations where pipes were run through the wall were not observed to be adequately
sealed around the opening
2) The location of Outfall #001 is two pipes (one black corrugated plastic pipe, and a white 6" PVC pipe) which are
partially submerged in an unnamed tributary of Richland Creek (Classification B,Tr) Due to the intermingling of
stormwater with the creek, this sampling location would not be appropriate, or representative of the activity on
site The sampling location should be farther from the creek
3) Trench drains on site were partially filled with sediment, and in some locations, vegetation If the flow from
these trench drains is supposed to flow to the Oil -Water Separator, these areas should be cleaned out to
prevent the possibility of stormwater filling and carrying industrial product out of the trench drains and off site
4) A storage tank and several drums were observed on site, outside the containment area No clear markings were
on the containers to classify their capacity or contents These containers should be moved to a secondary
containment area and identified
It is my recommendation that this facility NOT be given coverage under NCGO80969 as proposed in the NOI until the
above items are addressed (Pictures available if needed)
