The primary goal of the inspection was to evaluate the drainage to Outfall Nos. 1, 2, and 3 and to insure that there are no illicit discharges at your facility. At the time of this inspection the facility was found to be in compliance with permit NCG030134 and no illicit discharges were discovered. Monthly monitoring has been triggered by two consecutive exceedances of zinc and copper (Outfall Nos. 1 and 2) at your facility. Please keep in mind that benchmark exceedances are NOT limit violations or violations of permit conditions; however, you are obligated to follow the tiered response actions outlined in your permit. ThermoFisher Scientific has been following the tiered response actions and therefore is in compliance with the permit. As part of tiered response, ThermoFisher Scientific has initiated housekeeping actions; however zinc and copper concentrations remain above the benchmark values (reference March 28, 2014 letter from you). During the inspection we reviewed housekeeping activities and noted opportunity for additional housekeeping actions such as regular sweeping and vacuuming of the parking lot. We also noted operations that could potentially generate copper and zinc exposures, such as the TIG welding, brazing, and copper cutting areas and a potential avenue of exposure through the roof exhaust vents. As we discussed, we suggest additional review of facility processes including review of safety data sheets (MSDS) and raw materials for zinc and copper content and investigation of potential stormwater exposure (such as the roof exhaust vents). Once this investigation is completed, please submit to our office a description of housekeeping and other practices that have been and will be implemented to address these issues. Address these where feasible. 4) Additional sampling is needed for the representative outfall determination for Outfall 2 being representative for Outfalls 1 and 3. A review of the plant layout during the inspection indicates that the majority of the process/operations (roof vents) drain to Outfall No. 1; the loading dock and the other metal storage bins drain to Outfall No. 3; and the assembly and other specialty operations including the scrap recycle and mixed -metal roll -off bins drain to Outfall No. 2. This suggests that Outfall 2 may not be representative of Outfalls 1 and 3. Please forward these results for all the monthly sampling of all the outfalls. 5) For continued monthly sampling (Tier 2/3 response), you may focus on zinc and copper testing (no longer required to do the other analytical testing since these have not exceeded benchmark levels). However all analytical monitoring is required for the semi-annual testing. 6) The facility doesn't do any vehicle maintenance on site. 7) All of the metal bins are open, but are changed out at least weekly (Biltmore Metal). As required by the permit, the facility conducted stormwater sampling semi-annually in 2013. Benchmark values for copper and zinc were exceeded during these sampling events. The facility instituted Tier One and Tier Two actions as a result of the benchmark exceedances. The outfalls were resampled in January 2014 and February 2014. Benchmark values for copper and .zinc were exceeded during these sampling events, thus triggering Tier Three actions. Sampling results are provided in Attachment B. Since the previous NCG03 permit did not require copper and zinc monitoring, the facility was not aware of the copper and zinc issue prior to the first sampling event in June 2013. Subsequent sampling results have not indicated a reduction in copper and zinc since the implementation of these best management practices. One contributing factor to the stormwater sampling results could be the fact that copper and zinc occur naturally in the soils of North Carolina. The facility also suspects that the buildin roof coui tributin to the copper and zinc exceedance. The roof is galvanized metal and a white elastomeric roof coating was added approximately three years ago. The coating contains between 3-7% zinc. Thermo Fisher took samples from the roof down spouts located adjacent to Outfalls 1 and 2 and directly from the roof near both outfalls. A total of four samples were taken. Two samples exceeded the copper benchmark and all four samples exceeded the zinc benchmark. A copy of the MSDS for the roof coating is presented at Attachment C. Thermo Fisher is seeking to engage in discussions with NCDENR to determine the path forward to be compliant with NPDES Stormwater Permit NCGO30134 while reducing the amount of stormwater sampling required at the facility.
