1,2-Diphenylhydrazine decomposes to and cannot be separated from Azobenzene using Method 8270. The result for each analyte is

Inspection Summary:
On November 2, 2018 this facility was inspected for compliance. Stan Aiken and myself met with Jeremy Putnam and Steve
Haney on -site. -During -the -inspection, -the -following -items were-noted�- - --------- ---
1) Housekeeping at the SE comer of the facility is needed. The permitee in directed to revisit and revise the Housekeeping
and preventative maintenance schedule if needed to provide additional cleaning in that area.
2) The nature of the trench drain at the east side of the facility was not completely known. Due to observed polutants coming
from the outlet, the permitee is directed to evaluate the nature and use of that trench drain to ensure no additional pollutants
discharge from that area. Also, if the area is used for storage of liquid material (drums, totes, mop buckets, etc..) The plug in
the end of the pipe should remain in the pipe and be removed only to drain stormwater.
3) An additional outfall was observed at the NW corner of the facility. Ther permitee is directed to immediately begin
including this outfall in all monitoring practices, and add the outfall to the site map. 4) The permittee is also directed to revisit
the secondary containment requirements outlined in the General Permit (NCG030000) on pages 4 and 27.

Dear Mr. Putnam:
In response to your request for regulatory relief and representative outfall status,
NCDENR-Land Quality Section staff conducted a site inspection on May 6, 2014. The
primary goal of the inspection was to evaluate the drainage to Outfall Nos. 1, 2, and 3
and to insure that there are no illicit discharges at your facility. At the time of this
inspection the facility was found to be in compliance with permit NCG030134 and no
illicit discharges were discovered.
Monthly monitoring has been triggered by two consecutive exceedances of zinc and
copper (Outfall Nos. 1 and 2) at your facility. Please keep in mind that benchmark
exceedances are NOT limit violations or violations of permit conditions; however, you
are obligated to follow the tiered response actions outlined in your permit.
ThermoFisher Scientific has been following the tiered response actions and therefore is
in compliance with the permit.
As part of tiered response, ThermoFisher Scientific has initiated housekeeping actions;
however zinc and copper concentrations remain above the benchmark values
(reference March 28, 2014 letter from you). During the inspection we reviewed
housekeeping activities and noted opportunity for additional housekeeping actions such
as regular sweeping and vacuuming of the parking lot. We also noted operations that
could potentially generate copper and zinc exposures, such as the TIG welding,
brazing, and copper cutting areas and a potential avenue of exposure through the roof
exhaust vents. As we discussed, we suggest additional review of facility processes
including review of safety data sheets (MSDS) and raw materials for zinc and copper
content and investigation of potential stormwater exposure (such as the roof exhaust
vents). Once this investigation is completed, please submit to our office a description of
housekeeping and other practices that have been and will be implemented to address
these issues.

We also inspected Outfall Nos. 1, 2, and 3 and associated drainage areas with respect
to your request that Outfall No. 2 be granted representative outfall status for Outfall
Nos. 1 and 3. A review of the plant layout during the inspection indicated that the
majority of the processes and operation drains to Outfall No. 1. Based on this, Outfall
No. 2 may not be representative of Outfall No. 1. Additional sampling is needed from
all outfalls in order for us to complete our review and determination of this request. We
recommend that at least eight sampling events and results be presented for this
determination. Once these are available, please forward to us for review and final
determination of your representative outfall request.
You are instructed to continue Tier II analytical monthly sampling for Outfall Nos. 1, 2,
and 3 (zinc and copper only). All other benchmarks (pH, TSS, 0 & G, Copper, Lead,
and TTO if applicable) shall be monitored on a semiannual basis, unless a tiered
response is triggered for these specific benchmarks. Once all housekeeping actions
are implemented, process emissions reviewed and addressed where feasible, and
monthly analytical results are available demonstrating effect of these actions, we will
consider a review of your request for regulatory relief of Tier 2 monitoring for Outfall
Nos. 1, 2, and 3. This decision only applies to the zinc and copper benchmarks. A
benchmark exceedance of any other parameter listed in your permit will trigger
tiered response actions as described in the general permit.
The relief granted in this letter is contingent upon the current industrial practices and

Inspection Summary:
Facility does powder coat finishing, so probably not subject to TTO sampling.
Operations do generate zinc and copper. Examples being brazing the copper, cutting copper, and TIG welding. Facility
needs to do further review of the processes and opportunity to further limit exposure to stormwater. The roof exhaust
vents should be reviewed and sampled if feasible to identify any "hotspots" for copper and zinc exposures.
We recommend that the parking lot be sweeped/vacuumed to see if this will help reduce zinc and copper loading. We do
recognize that galvanized structures and the roof coating may be contributing to backgound levels of zinc and are not
direct process contributors. However, some opportunity for additional housekeeping is available. Once this is
implemented, sampling results will be evaluated and a decision on relief from Tier 11 sampling made.
Representative Outfall Status Request - Outfall No. 1 seems to have the majority of the processes in it's drainage, and
therefore may not be representative of the drainage in Outfall No. 2. Additional sampling results from all outfalls are
needed to make this determination.
The facility has implemented quite a few housekeeping actions and has made signficant efforts to reduce any potential
zinc and copper exposures.
All drains in the plant are sealed.
The facility is well maintained and was in compliance at the time of the inspection.

Thank you so much for your time during our inspection last Tuesday (May 6). We appreciate you continuing efforts to
address the zinc and copper stormwater exposures. A summary of our discussions during the inspection (including a list
of requested information) is as follows. We will follow up this email with a formal letter and the inspection report. Let
me know if you have any questions or need more information.
1) Please provide the amount of polyurethane (and a copy of the MSDS) that is used annually/monthly in the
touch-up booth. Since the majority of your finishing is powder coat, we discussed whether or not your touch-up
booth would trigger the requirement for TTO (total toxic organics) sampling. Further review indicates that this
requirement is triggered for "metal finishing" as defined in 40 CFR 433.11(see attached). Please review this
definition for applicability to your operation. My preliminary review indicates that this probably does not apply
to your operation (touch up booth).
2) We would suggest that you all consider sweeping/vacuuming the parking lot and see if this decreases the
amount of copper and zinc in your stormwater outfalls. If so, we would encourage this as an on -going BMP.
3) Continue reviewing the processes (material and MSDS review) at the plant (such as the TIG welding, brazing,
copper cutting operations) for potential exposures to stormwater such as emissions out of the roof exhaust
vents above these operations. Address these where feasible.
4) Additional sampling is needed for the representative outfall determination for Outfall 2 being representative for
Outfalls 1 and 3. A review of the plant layout during the inspection indicates that the majority of the
process/operations (roof vents) drain to Outfall No. 1; the loading dock and the other metal storage bins drain
to Outfall No. 3; and the assembly and other specialty operations including the scrap recycle and mixed -metal
roll -off bins drain to Outfall No. 2. This suggests that Outfall 2 may not be representative of Outfalls 1 and
3. Please forward these results for all the monthly sampling of all the outfalls.
5) For continued monthly sampling (Tier 2/3 response), you may focus on zinc and copper testing (no longer
required to do the other analytical testing since these have not exceeded benchmark levels). However all
analytical monitoring is required for the semi-annual testing.
6) The facility doesn't do any vehicle maintenance on site.
7) All of the metal bins are open, but are changed out at least weekly (Biltmore Metal). You all have researched
the possibility of covering, but it is not operationally or economically feasible because of the frequent pick-
up/drop-off schedule for recycling.
8) The facility has implemented allot of BMPs to reduce the metals discharges and we appreciate your efforts on
this. The facility was clean and well -maintained. The facility was in compliance at the time of the inspection.

Thank you time today on the telephone and for your letter received in our office April 1, 2014 notifying us of the Tier 3
status for zinc and copper in Outfalls 1 and 2 and requesting representative outfall status for Outfalls 1 and 3 .
As part of our review of your request for relief from the Tier 3 sampling, we would like to schedule an inspection of the
facility. Please let us know your availability starting the week of April 21, 2014. As part of this review, we also ask the
facility to review the facility material inventory for any processes that may be using zinc and copper containing materials
and any possible venting/exposure of these materials to stormwater including any potential ventilation or stack
emissions that might be exposed to stormwater. We would like to review this information as part of our inspection
also. Note that until we make a determination you are required to continue the Tier III sampling (monthly) and are to
sample all triggered outfalls (1 and 2 at this time) for all parameters (pH, TSS, Oil & Grease, Copper, Lead, Zinc, TTO if
applicable, and total rainfall). You may have sampled all of these in your January and February samples, but you did not
provide this information in your letter. As part of the representative outfall status, we will need to review sampling
data from Outfall 3. Based on this, you should begin sampling this outfall as required in your general stormwater permit
(semiannual unless benchmarks are exceeded).
We appreciate your efforts in minimizing stormwater exposures and look forward to working with you to address your
concerns. We are aware that non -process contributors such as galvanized roofing and gutters can increase zinc levels in
outfalls, but we want to be sure that any potential process contributors have been addressed and minimized. Just let us
know when a convenient time is for an inspection. Please note that Tier 3 response and sampling of Outfall 3 should
continue until we have made a formal written decision on your request. Also as discussed, the more results we have the
more informed decision we can make regarding your request.

Thermo Fisher Scientific, LLC (Thermo Fisher) operates metal finishing processes
at 275 Aiken Road, Asheville, Buncombe County, NC_ The facility operates
under NPDES General Permit NCG030134 and has two permitted stormwater
outfalls. As required by the permit, the facility conducted stormwater sampling
semi-annually in 2013. Benchmark values for copper and zinc were exceeded
during these sampling events. The facility instituted Tier One and Tier Two
actions as a result of the benchmark exceedances. The outfalls were resampled in
January 2014 and February 2014. Benchmark values for copper and .zinc were
exceeded during these sampling events, thus triggering Tier Three actions.
Sampling results are provided in Attachment B.
Since the previous NCG03 permit did not require copper and zinc monitoring,
the facility was not aware of the copper and zinc issue prior to the first sampling
event in June 2013. Thermo Fisher has implemented the following best
management practices at the facility in an effort to reduce the metals discharged
to the stormwater. e v �
• Installed Ultratech heavy metal drains guards at each outfall;
• Implemented a stronger good housekeeping program including more
fre uent swee ing;
• Cleaned all stormwater grates;
• Added a grate over stormwater catch basin associated with Outfall #2,
• Changed storage procedure for used compressor bins;
• Redirected gutter downspouts away from cold steel roll off bin;
• Agreement made with scrap metal contractor to contact fabrication
associate prior to exchanging roll off to let associate monitor exchange
and to clean the area immediately after the exchange;
• Gravel rock added to area of erosion due to truck turn around area;
• Bailed cardboard stored inside a trailer instead of on the ground;

Subsequent sampling results have not indicated a reduction in copper and zinc
since the implementation of these best management practices.
One contributing factor to the stormwater sampling results could be the fact that
copper and zinc occur naturally in the soils of North Carolina. The facility also
suspects that the buildin roof coui tributin to the copper and zinc
exceedance. The roof is galvanized metal and a white elastomeric roof coating
was added approximately three years ago. The coating contains between 3-7%
zinc. Thermo Fisher took samples from the roof down spouts located adjacent to
Outfalls 1 and 2 and directly from the roof near both outfalls. A total of four
samples were taken. Two samples exceeded the copper benchmark and all four
samples exceeded the zinc benchmark. A copy of the MSDS for the roof coating
is presented at Attachment C.
Thermo Fisher is seeking to engage in discussions with NCDENR to determine
the path forward to be compliant with NPDES Stormwater Permit NCGO30134
while reducing the amount of stormwater sampling required at the facility.
In addition, the facility has recently added a new loadin dock at the southern
pg tion of th ces to this area. This
area is associated with industrial activity and needs to be added a5 QtLtfa1L#3_
However, the facility would like to request Representative OutfalI Status (ROS)
for Outfall #3 and Outfall #1. Operations at Outfall #2 are similar to operations
at the rest of the facility.

Monitoring results (Attachment B), and a Representative Outfall Status Request
Form (Attachment D). Thermo Fisher understands that Representative Outfall
Status does not eliminate the qualitative monitoring or inspection requirement
for each outfall.

If a facility is required to sample multiple discharge locations with very similar stormwater discharges, the
permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative
Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.
If Representative Outfall Status is granted, ALL outfalls are still subject to the qualitative monitoring

the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (CDC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last CDC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wc1/wslsu/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections 6, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,

Inspection Summary:
The inspection was facilitated by John Scales of Thermo Fisher Scientific, LLG, who provided documents for review and a
site tour. The facility employs several best management practices within its interior, such as capped floor drains,
secondary containment for chemicals etc...., but none of which are described In its stormwater pollution prevention plan.
It is recommended that the stormwater pollution prevention plan be updated to reflect all best management practices
employed.
The exterior of the facility has exposed new and used pallets, styrofoam, and a scrap metal bin, again none of which are
described in the stormwater pollution prevention plan. Roof runoff from the back of the building is directed onto a concrete
area containing the scrap metal bin and used pallet bin and washes pollutants directly into a storm drain. Options to
reduce this exposure are limited to providing a, roof or using trailers for storage. The facility is encouraged to consider
these and other options for reducing contaminated stormwater runoff to Reems Greek.
I
Visual and analytical monitoring records demonstrate compliance with permit monitoring frequency requirements,
although a low pH (4.4 to 5.1) appears to plaque some samples. Annual employee training records for line employees
are not kept, although training is established_ it is recommended that such record -keeping be initiated during the next
permit cycle.

Comment: The facility implements numerous interior best management practices
related to chemicals and secondary containment. However the plan does not address
any of these efforts. Annual training records of line employees is not documented,
although it is provided. Recommend that these records be kept and included with an
updated plan that reflects all current best management practices employed. Exterior
best management practices are limited at the site in part due to site configuration and
limited space. The majority of material stored outside are new pallets, a storage
container for used pallets, styrofoam, and a scrap metal bin. The site manager might
consider a method of reducing exposure by seeking coverage for the scrap metal and
used pallet bin (i.e. using trailers instead of bins or obtaining covered bins). Whatever
best management practices are developed should be included in the stonnwater

on August 31, 2002, The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Writer
Quality (DWQ) for renewal of your permit coverage_ To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General, Permit Coverage Renewal.
Application Form. The application must be completed and returned by March 4, 2(H)2 in order uo assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil -assessment of at least $250.00. Larger -
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to S 10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of (lie l I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For .additional

is reissued pursuant to the requirements of North Carolina General Statute 143-2 l5 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.

w A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
