Land Cover and Land Use Categories per NC Standard Classification System: 1 Heavily Developed or Disturbed Land,
5.01 Altered Lands. The site is currently a sanitary sewer easement maintained by the City of Jacksonville. The
easement is undeveloped and mowed yearly to maintain access. The site is bordered to the north by a stream and to the
south by woods or developed properties.

3d. Explain the purpose of the proposed project:
The City of Jacksonville's Water System Improvements Project's purpose is to provide a new source of groundwater for
the consumption of the City in order for the City to follow the Division of Water Resource's Central Coastal Plain Capacity
Use Area Regulations. This regulation requires a reduction of 75% in water withdrawals from the City's Cretaceous Well
Fields. In order to do this a new Well Field is being established under the Water System Improvement Project. This
Project also includes the construction of the transmission mains associated with piping the water from the well fields to a
new Water Treatment Plant that is also under this Project.
This permit application is directly for the installation of a raw water main.

The project will be a linear line work project which will consist of trenching, placing pipe, and back-filling the trench.
Equipment to be used includes but may not be limited to of a backhoe, pipe fusing machine, payloader, and dump truck.
Original existing contour and grade will be restored to pre-construction conditions.

D. Impact Justification and Mitigation
1. Avoidance and Minimization

The original project design avoided this route all together. The route orignally went through existing City of Jacksonville Road
ROW along HY 17 and Western Blvd. However, this route was not acceptable by NCDOT due to an existing TIP project in the
area. The next option was to route the line in the existing 30' utility easement that follows Dotey's Branch. A delineation was
performed by Watershed Hydrology and the route was designed to keep within the existing easement except for one location
in which DOT requires that the alignment be located outside of the existing easement. All wetlands within the easement have
been previously disturbed and undergo yearly maintanence and have been determined to not require mitigation. None of the
impacted waters are navigable.

Minimum disturbance area is achieved through construction techniques. All areas where impacts will take place will be
constructed in a maximum of one day, reducing the time that the areas will see impacts. Total project area will be entirely in
the previously disturbed and maintained utility easement except for one location which minimizes any new disturbances to the
waters of the U.S.

Project Name: City of Jacksonville Water Systems Improvements -
Dotey's Branch Alignment
Existing Action ID: SAW-2007-3783-067
Existing Project Background Information
The City of Jacksonville Water System Improvements project consists of a four Million Gallon
per day(MGD) Nano-filtration Water Treatment Plant, 16 ground water wells, and approximately
88,000 linear feet of water transmission main. The attached Exhibit 4: Permitted System depicts
the water system that is currently permitted.
Since the date of the original approved permit the transmission main alignment has changed due
' to requirements set forth by the North Carolina Department of Transportation (NCDOT) ( T.I.P.
#U-4007B) that resulted in conflicting easement jurisdictions and placement of utility lines
within NCDOT proposed travel corridors.
The current and final alignment for the transmission mains is depicted in the Exhibit S: Vicinity
Map. The transmission main project has been broken down into sections shown on Exhibit 3:
Phasing Plan. Sections A, B, C, and H have not changed from the original permitted design;
however, minor changes have been made in Sections C, D, E, F, and G. The majority of changes
consist of slight shifting of the line within 5 to 10 feet from the original location, changing the
side of the road the alignment was originally on, and changing the route to less populated streets.
In all cases except one, these changes do not change the type of land, the amount of land or the
owner of the land. The one exception to this is henceforth referred to as the Dotey's Branch
Alignment, shown on Exhibit 6: Dotey's Branch Alignment. This alignment has moved the
original transmission main from within right of way to an existing City of Jacksonville Utility
easement. This easement is currently maintained but includes a number of jurisdictional
wetlands. Since this alignment is different in scope and location from the original permitted
alignment, and adds wetland impacts that were not a part of the original approved permit, a PCN
is being filed for this portion of the project.
1 Dotey's Branch Alignment Impact Description
All impacts to wetlands and surface waters in the Dotey's Branch Project Area will be
temporary. Impact totals are shown in the table below and are depicted on Exhibit 7: Wetland
Impacts.

' In all locations expect for one the alignment is kept within a City of Jacksonville Utility
Easement. This is a well maintained active easement that contains an existing sewer line. In
' order to minimize the impacts to the area to the maximum extent practicable, the temporary
disturbances will be kept in already disturbed areas. During the One-Stop Express Permitting
Meeting held on August 26, 2009 the Army Corps of Engineers stated that any impacts contained
' within this Utility Easement will not require mitigation.
It was the intent of the client to keep all disturbances within the easement, however, in one
' location this was not possible due the NCDOT TIP project. The NCDOT project will be re-
routing the existing Easement and Sewer Line in one area and thus this project was required to
go outside of the existing easement and route the new water line in the proposed location for the
' NCDOT project. This results in 0.06 acres of undisturbed forested headwater wetland to be
impacted.
There will be one surface water impact to a non-navigable ditch. This impact will also be
temporary and original existing contour and grade will be restored to pre-construction
conditions.
None of the impact areas are within an area designated as Areas of Environmental Concern
(AEC).

The State Environmental Policy Act (G,S. 113A) requires that the Division of Environmental Health detenmine whether a
proposed major agency action will significantly affect the environment. The City of Jacksonville Water Supply and
' Treatment Facilities Project is such a major action. This project is seeking Rinds from the federally sponsored Drinking
Water State Revolving Fund (DWSRF). Under the DWSRF program requirements, the proposed project must be
subjected to an cm.vironmental review in accordance with the State Environmental Review Procedures (SERF) negotiated
' between the US Environmental Protection Agency and the state's Division of Environmental Health. This project is
covered by the SERF. This project should be reviewed as 'a NEPA-Like review based on the (SERF).
In order to determine whether construction of a taw and distribution water supply system of approximately 58,300 feet of
20, 16, 12 and 6 inch pipelines to he constricted within existing rights of way and easements and an 8 million gallons a
day nanofiltration treatment plant on approximately 13 acres of land with well field comprised of approximately 32 wells
and about 30,000 .feet of 16 inches pipeline of by product water from the treatment plant will cause significant
' environmental impacts, an environmental assessment has been prepared. The environmental assessment is attached. It
contains detailed information on the key issues, including a brief description of the proposed project and a summary of
probable environmental impacts and proposed mitigations. None of the impacts were found to be significant.
Ow the basis of the analysis of the irtrpacts as shown in the environmental assessment, no environmental impact statement
(EIS) will be prepared. This FONSI completes the environmental review record. The FONSI and Environmental
' Assessment shall be available for inspection and comment for 30 days at the State Clearinghouse. This FONSI will
become effective upon successful release from the State Clearinghouse review.
Summary of PONSI for publication in the Environmental Bulletin. After completion of an environmental assessment
tinder G.S. 113.A, a FONSI has been made in the case of the City of Jacksonville Water Supply and Treatment Facilities

On July 18th and 19th, 2005, a survey for federally listed threatened and endangered species and
their habitats was conducted on the Jacksonville We1Ls Project in Jacksonville., North Carolina.
The proposed corridor, well sites,. and treatment facility site are located along North Marine
Boulevard (highway 17) and Western Boulevard. The attached USQS abowa the location of the
site.
Records and Literatures ,
' The Natural Heritage Program (NHP) has recorded fifteen federally.listed threatened or +
endangered species for Onslow County, North Carolina. Each of these spades is described
below:
Bald Eagle allaee w kaeoce halus
The Bald Eagle is currently listed as federally threatened but has been proposed to be delisted.
The eagle is a large specimen of approximately 30 inches with a wingspan of up,,to 7 feet. It is a .
blackish bird with a white head and tail. The eagle primarily-feeds on fish and thus prefers large
rivers, lakes, sounds, and marshes. Nesting occurs within the transition zone between forest and
marsh or open water. Nests are typically built in large live trees that provide easy access to open
water.

Piping Plover (Cham*ius neekdus)
This species is listed aS threatened. It is a little larger than a sparrow and is whitish with pale
sandy-brown on the back and top of the head. A complete or partial band of black occurs around
the neck. In North Carolina, barrier island beaches are used as nesting sites. During migration
and winter, these plovers can be found along sandy beach shoals, primarily on outer beaches, and
' inner sand or mud flats.
' American Alligator (Alligator arts s*pknsts)
The American Alligator is a large aquatic reptilian sometimes reaching'a length of 12 feet. Nests
are built near water in late spring and summer and are made from vegetation and soil. Females
normally guard their nests until hatching-commences. The alligator inhabits.slow moving rivers,
' lakes, marshes, and estuaries. It can be distinguished from. crocodiles by its rounded -snout. The
population of this species dramatically dropped when the species was hunted forits hide The
population size 'of the alligator has since risen due to protection under federal law. it is currently
' listed as threatened. .
Shortnose Sturgeon (Adpenser bkeWros*wm)
' The ihortnose sturgeon is currently listed gas codangere& ` This primitive,fish contains. five-rows
of bony plates, a tail with the.upper -lobe largerthan the lower, and four barbels elt the mouth.
It. is described as having a blackish head, and back; a yellowish-brown body, and right underside.
' Individuals of this species can reach one meta long. It njigrates into fresh water systems from
the, ocean to spawn.during spring (aoadromous). The young can live. in these "hwater systems
for several years before returning°to the.ocxan. his believed these fish prefer deep water with
soft substrate, vegdated bottom, and little. or no cui rent, except during migrationp and spawning
in the southeastern United States. Ovwfi&ing and degradation of rivers have resulted in the
decline of this species.
' Soathern Splcebuih (Lindera mefissffiofia)
Pondberry is a-deciduous. shrub growing to a height of. approximately Zmetera in height and, is
currently-listed as endangered. Young'shoots arise from stolons and are usually hairy.(pilose).
' Leaves are firm, elliptic'to narrowly ovate, with a round4base and ciliate margins. This plant
flowers in April to May and fruits mn August to September. The flowers an We' yellow and form
clusters: When crushed, the leaves have a sweet aroma similar to sassafrass. They normally
occupy sandy sinks and pond margins within this am. and typically-.prefer shaade'butcan
withstand sun.
' Rougb-leaf Loweatrife (Lysimachla asperufifoft)
This endangered plant is an erect finial with leaves occurring in whorls of 3 or 4. The stems
are rarely branched and am. glandular particularly near the tip. Leaves are noimOlly glandular as
well, particularly near the base and along the veins. Leaves are lanceolate with on acute tip and a
base that is generally trunonte to rounded. The inflorescence is a raceme with flowers that have
five fused yellow petals and five sepals fused at the base. It is an endemic plant to the Carolinas

and'grows primarily in ecotone between. pond.pine pocosins and longleaf pine uplands. It
generally requires some type of regular disturbance in which the overstory is minimal as in the
cases of roadside ditches, firebreaks, and other regularly.maintained right-of-ways.
Red-Cockaded Woodpecker (Pico(des, boreaNs)
A 20-cm long "barred" woodpecker with black cap and nape of neck. Large white cheek patches
distinguish this woodpecker. Males have a small red spot on each side of the black- cap. The
woodpeckers diet consists mainly of insects, which include ants, beetles and wood boring insects.
Found in family groups in pine savannahs with little umdargrowth. Populations are found in
stands of pines (longleaf pine, loblolly, slash) with a minimum age of 84120 years. Longleaf
pine are most commonly used for nesting. Dense stands (stands that are primarily hardwoods, or
that have a dense hardwood understory) are avoided. This species is currently listed as
endangered: .
Sesbeach Amaranth (4maranthus pumllas)
The seabeach amaranth is mrerctly-federallyhisted as a tlareat+ened specees. It is characterized by
trailing stems, thick leaves, and flowers in axdlary fascicles; Flowering and fiuiling occur from
June to first .frost. This species habitat requirements are constricted to sand dunes and overwash.

Cooley's Meadowrue (ThsHctram eoolcyl)
Coops meadowrue is' a..federally listed.endangered plant with weah,-erect .or loaning, stems.
This species normally grows up to l meter tall and has loaves-divided into smaU!leaflets, usually
in. groups of threosr. zThe leaflets are green above with pale undersides and, flowers are fow and
small. Flowering occurs in June and fruiting occurs in August through.Septembe?'. This species
occurs in.moist to wet bogs-and savannahs, fire plow lines, roadside-ditebes, and'powedine
rights-of-way.' Regular disturbance. that maintains an open habitat is optimal for! the survival of
the species.
Golden Sedge (Carer Wet)
Golden sedge its, federally Noted endangered plant. This species inhabits sivauna-swamp forest
ecotones over coquina_limestone..
Loggerkesd (Care to cardta)
The loggerhead sea turtle is currently listed as threatened . It is reddish brown, with a large head,
blunt jaws and heart-shaped shell. Nesting occurs on beaches in the U.S. fi May to August
with hatching occturing approximately 2 months afterbeing-laid. The turtles cah be found far
offshore, in bays, salt marshes, creeks and mouths of large rivers.
Green Turtle (Chelonla rnydas)
The green turtle, a threatencd spec ckgrows to approximately four feet in length. Its color
ranges from light to dark brown with dark markings: The head is relatively small. and the front
limbs have one claw each. This species rarely nests on the shores of North Carolina and

developed areas. Suitable habitat does not exist for RCW, West Indian manatees merican
alligator, short nosed sturgeon, loggerhead, green turtle, leatherback, eastern cougar, wabeach
amaranth, southern spicxbush, rough-leaf loosestrife, Piping plover, golden aedg, or the bald
eagle. Marginal habitat occurs in some areas of the proposed alignment for Cooley's meadowrue
within wet ditches along the roadside. These areas were examined.for the presence of this
species. No individuals of CooWa meadowme was found during the field survey.
conclusion
As stated before, no federally listed threatened or endangered species were found during the-field
survey of the proposed alignment, well sites, and treatment facility site. Most ofthe area has
been developed and a majority of the proposed alignment is in grass and mowed; Based on site
observations it is unlikely that this project will adversely affect populations of federally listed
endangered or threatened species in Onslow County.

The site exhibits water bodies with ordinary high water and abutting wetlands as defined in the 1987 wetland
delineation manual. The water bodies on the site include Deen Gulley Creek (Dotev's Branch) rand 2 unnamed
tributariesl, a Relatively Permanent Water - which drains into Mill Creek, a Traditionally Navigable Waterway - and
' adjacent wetlands. This determination is based on verification site visits by David E. Bailey on 6/17/2009 and 8/12/2009.
D. Remarks
' This JD covers the above referenced section, a small segment of the overall SAW-2007-03787proiect corridor, as shown
in the referenced approved survey map showing Waters of the US. Portions of the corridor described above fall within
a revious Jurisdictional Determination under SAW-2001-00919 as reflected on the referenced approved survey map
showing Waters of the US
