RE: Biltmore French Broad River and Swannanoa Riverbank Stabilization
Nationwide Permit 13 Permit Modification Request (GC 4134)
USACE Action ID# SA W-2018-02171 NCDWR Project# 18-1589 V2
Buncombe County, North Carolina
Dear Ms. Jones and Ms. Higgins,
The attached Pre-Construction Notification (PCN) modification is being submitted on
behalf of The Biltmore Company represented by Mr. Parker Andes. The project site is a
+/-2,485 acre parcel with a physical address of 1 Lodge Street, Asheville, North Carolina
(35.56685, -82.546343). The applicant was issued a Nationwide Permit (NWP) 13 on
May 17, 2019 for bank stabilization in four locations on the French Broad river and three
locations on the Swannanoa River to prevent loss of property and for an emergency
portage location for recreational watercraft on the French Broad River. Approval of a 401
Water Quality Certification (GC 4134) was issued on February 8, 2019.
The applicant was issued a NWP13 Permit modification on July 10, 2019 and 401
General Certification modification August 12, 2019, which included an additional impact
consisting of a 400 LP of temporary construction access route (impact S 11) within the
Swannanoa River, to accomplish bank stabilization repairs on the left bank of the
Swannanoa River (impact S9).
The applicant has identified an additional necessary repair on the left bank of the
Swannanoa River, adjacent to the Ram Branch confluence. The applicant requests
modification of the permit to include a new 100 LP impact on the left bank of the
Swannanoa River, consisting of geolifts (impact S 12) to protect the arch culvert on Ram
Branch at the confluence with the Swannanoa River. In order to access the repair site, the
applicant will construct a temporary equipment access ramp adjacent to the repair,
resulting in additional 25 LP (impact S13) of temporary impacts to the Swannanoa
Riverbank. The temporary equipment access ramp will be re-graded to match original
contours and reseeded upon completion of the bank repair. Please review the attached
