Dear Colonel Woodbury:
In accordance with your request, this office has circulatej to interested
state review agencies U. S. Army Corps of Engineers Public Notice .... 0027
dated November 5, 1987 describing a project proposed by the Wake County Board
of Education of Raleigh. The project, involving wetland fill for the proposal
of constructing parking spaces for a new school central service complex, is
located adjacent to Walnut Creek east of Rock Quarry Road in Raleigh, in Wake
County.
In response to the circulation of the public notice to develop a
coordinated state position, four agencies submitted objections to the filling
of those wetland areas located in the Walnut Creek flood plain. Agency
objections was either non-existent or not as strong to filling the isolated
wetland. It is our understanding that this area. about 22,000 sq. ft. in
size, has been authorized to be filled under a C.O.E. nationwide permit.
The consensus of the responding agencies was that the project could be
redesigned to preclude wetland fill. This state viewpoint position supports
that consensus.
For your information, the Division of Environmental Management issued
1401 Water Quality Certification No. 2194 for the requested fill on December
31, 1987.

The Raleigh Regional Office has reviewed the subject
project for N.C. State Certification in accordance with
Section 401 of the Clean Water Act.
The Wake County Board of Education plans to construct a
new facility on the southern bank of Walnut Creek. During
this construction, it is proposed that three wetland areas
be filled and graded to allow construction of buildings.
The wetland areas are subject to flooding during heavy
rainfall events.
Therefore, this office recommends that certification
include conditions that all activities shall not cause
sufficient runoff to increase stream turbidity by 50 NTU's
and that appropriate erosion control measures be taken to
limit surface runoff into Walnut Creek.

Dear Colonel Woodbury:
This is in response to the subject public notice concerning a proposal to place
fill material in wetlands adjacent to Walnut Creek, in Raleigh, Wake County,
North Carolina. The purpose of the work is to construct a service complex for
the Wake County School System. As a result of this activity, three wetland
areas will be affected by the proposed project.
Based on information in the public notice and telephone conversations with the
Corps project officer, the first area is isolated and appears to be the remnant
of an old borrow pit. The wetlands vegetation is reported to be highly
degraded and of low value. This 22,000 sq. ft. site will be filled for a
proposed gravel service yard, equipment shed, and parking area. The two other
areas are in the floodplain of Walnut Creek and are considered to be a very
high quality bottomland hardwood wetland system.
Approximately 115,000 sq. ft. of this bottomland hardwood will be eliminated by
the construction of a gravel service yard. Wetland floristic species noted
on-site include: Pickerelweed (Pontederia cordata), arrow arum (Peltandra
virginica), lizard's tail (Saururus cernuus), green ash (Fraxinus
pennsylvanica) and water tupelo (Nyssa aquatica).
Bottomland hardwood wetlands perform valuable functions within the aquatic
system including: fish and wildlife habitat values, water quality services,
detrital export, and vital stormwater retention capabilities.
Although this Agency has no objection to filling the remnant borrow pit, we do
have serious concerns over the loss of 115,000 sq. ft. of bottomland hardwoods.

It is clear that this portion of the project will eliminate a valuable aquatic
resource and will result in unacceptable adverse environmental impacts.
Consequently, it is our opinion that the fill proposal in the bottomland
hardwoods located in the floodplain of Walnut Creek is contrary to the Section
404 Guidelines and should be denied.

Department of the Army permit TO PLACE FILL MATERIAL IN WETLANDS ADJACENT TO
WALNUT CREEK, EAST OF ROCK QUARRY ROAD, AND NORTH OF 1-40, IN RAL~:IGH, WAKE
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made d~lring an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show that three wetland areas will be affected by the proposed
project. The first area is isolated and appears to be the remnants of an old
borrow pit. It is an area approximately 22,000 square feet and will be
completely filled for the proposed gravel service yard, the equipment shed,
and the parking area around the operations building. The wetlands here are
characterized by steep slopes in a fairly straight line, with high ground
"berms" running parallel to wetland areas. Vcget,1tion present in the wetlands
and along the borders include Carex sp., wi 110w (Salix sp.), al der (Alnus
sp.), river birch (Betula nigra), red maple (Acer rubr~), and cattails (Typha
latifolia). The two other areas arc in the flood plain of Walnut Creek, and
appear to get a fresh supply of water every time the Creek overflows. As the
creek recedes, water is left in thesl~ areas, 8.nd 8. mature wetland has
resulted. Approximately 115,000 square feet of wetlands will be affected in
these areilS, impacted by the gravel service yarJ. The soil is pure organic
muck, gradually changing to mottled clay/silt with some sand. Veget8.tion
present in both areas includes the above species as well as Pontederi8. sp.,
Peltandra sp., lizard's tail (Saururus cernuus), green ash (Fraxinus
pennsylvanica), and water tupelo (Nyssaaq~ca). The purpose of the work is
to construct a new Wake County School System Central Services complex. Plans
showing the work are included with this public notice.
The St8.te of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authori~ation. No
Dep<irtment of the Army permit wi 11 be issued unt i 1 the coordi nated St3te
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within

the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligihle
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cllltllr<l1 resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant <lnd onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or thre<ltened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of <lll those factors which become relevant in each particular
case. The benefits which reasonably may be expected to Accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions tinder which
it will be allowed to occur, ~re therefore determined by the Otltcome of the
general balancing process. That decision should reflect the national concern
for both protection and uti 1fzation of importilnt resources. ALl filctl)rs which
may be relevant to the proposal must he considered inclucling the cumuJative
effects thereof. Among those Are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, ~~ater supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, <lnd, in general, the needs and welfare of the people. For
Bctivities involving the pl<lcement of dredged or fill materials in wBters of
the United States, ~ permit will be deni(~d if the discharge that would he
~uthorized by such permit wOl1ld not comply with the Environmental Protection
Agencies I 404(b)( l) guidelines. Subiect to the preceding sentpnce and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines tnBt it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of EnvironmentRI
Management (OEM) issues, denies, or waives St<lte certificBtion required by

Section 401 of the Clean Water Act. The nEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, Nortll
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reprorlllction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 1, 1987.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before December 29, 1987, Attention:

Office Box 31388, Raleigh, North Carolina 27622-1388, has applied for a
Department of the Army permit TO PLACE FILL MATERIAL IN WETLANDS ADJACENT TO
WALNUT CREEK, EAST OF ROCK QUARRY ROAD, AND NORTH OF 1-40, IN RALEIGH, WAKE
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show that three wetland areas will be affected by the proposed
project. The first area is isolated and appears to be the remnants of an old
borrow pit. It is an area approximately 22,000 square feet and will be
completely filled for the proposed gravel service yard, the equipment shed,
and the parking area around the operations building. The wetlands here are
characterized by steep slopes in a fairly straight line, with high ground
"berms" running parallel to wetland areas. Vegetation present in the wetlands
and along the borders include Carex sp., willow (Salix sp.), alder (Alnus
sp.), river birch (Betula nigra), red maple (Acer rubrum), and cattails (Typha
latifolia). The two other areas are in the flood plain of Walnut Creek, and
appear to get a fresh supply of water every time the Creek overflows. As the
creek recedes, water is left in these areas, and a mature wetland has
resulted. Approximately 115,000 square feet of wetlands will be affected in
these areas, impacted by the gravel service yard. The soil is pure organic
muck, gradually changing to mottled clay/silt with some sand. Vegetation
present in both areas includes the above species as well as Pontederia sp.,
Peltandra sp., lizard's tail (Saururus cernuus), green ash (Fraxinus
pennsylvanica), and water tupelo (Nyssa aquatica). The purpose of the work is
to construct a new Wake County School System Central Services complex. Plans
showing the work are included with this public notice.
The State of North Carol ina wi 11 review this public notice to determine
the neerl for the applicant to ohtain any required State authorization. No
Department of the Army permit will he issuerl until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has cietermined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within

the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulat i ve impacts, of the proposed act i vi ty
and its intended use on the public interest. Evaluation of the probable
Impacts which the proposed activity may have on the Pllblic interest requires a
careful weighing of all those factors which become relevant in each particul~r
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize i1 proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the olltcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the rroposal must he considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownershir, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denil~d if the discharge that would he
authorized by such permit wOllld not comply with the Environmental Protection
Agencies' 404(b)(I) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by

Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will he furnished
to any rerson requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 1, 1987.
