Reference your application for Department of the Anny
authorization to maintain a basin area on Moccasin Creek, off the
Pasquotank River, near South Mills, Camden County, North Carolina.
Your propo8al has been reviewed and found consistent with the
provisions and 0bjectives of general permit No. SAHC080-N-OOO-
0291. Therefon!, you may commence construction activity in strict
accordance with applicable State authorization and the enclosed
plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal. Hanagement prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Pasquotank River) at S. Mills offas requested in the pennittee's application dated 11/6/87 including
attached plat dated 9/18/87.
This pennit, issued on I /~/ 758 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these tenns may subject (
pennittee to a fine, imprisonment or civil action; or may cause the pennit to be null and void.
(1) In order to protect juvenile fin fish populations, no excavation or filling
wi 11 be permi tted between March 1 and September 30 of any year wi thout the
prior approval of the Division of Coastal Management.
(2) All excavated materials will be confined landward of the normal water elevation
contour and any irregularly flooded vegetated wetlands.
(3) Excavation will not exceed 9 feet below the elevation of normal water.
(4) . The temporary placement or double 'handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
(5) . Silt fences will be erected between the spoil site and the barge basin to
prevent reentry of sediments into Moccasin Creek.
(6) The spoi 1 area wi 11 be proper ly graded and provi ded a ground cover suffi ci ent
to restrain erosion within thirty (30) days of project completion.

This pennit action may be appealed by the pennittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This pennit must be accessible on.site to Department
personnel when the project is inspected for compiJ..nce.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
, All work must cease when the pennit expires on
December 31, 1991 ..

Dear Mr. Parker:
Reference the application of Union Camp CorporatioH,
represented by Mr. R. B. Stutzman, for Department of the Army
authorizatiorl to maintain a basin area on Moccasin Creek, off the
Pasquotank River, near South Mills, Camden County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field iIlvestigation report.
We recommend that the following conditions be included in the
State authorization:
a. All excavated materials will be confined landward of the
Hormal water elevation contour and any irregularly flooded
vegetated wetlands.
b. Excavation will not exceed 9 feet below the elevation of
Hormal water.
c. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlaHds is not
authorized.
d. The activity will be conducted in such a manner as to
prevent a significant irlcrease in turbidity outside the area of
construction or construction-related discharge. Increases such

On February 6, 1986, we renewed general penuit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorizatIon from the State
of North Carolina.
A review of your application received November 25, 1987, for a
Department of the Army permit to maintain a basin area on Moccasin
Creek, off the Pasquotank River, near South Mills, Camden County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further managemeut. If there are no unresolved differences of
State-Federal positions or policy, the fiual action taken on your
application by the State will result in your receiving ,.;ritten
notice from us that your application has been successfully
processed uuder our general permit. Only after receiving such
confirmation should you begin work.

SITE DESCRIPTION
The applicant's property is located in Camden County in South 1,1ills on old
U.S. 17 on Moccasin Creek. The shoreline is bulkheaded at the loading area. The
site is currently used to load trees onto barges. The area directly in front of
the loading dock has filled in due to accumulated materials (bark, etc.) fallin~
, into the water.
The applicant proposes to perform maintenance excavation of the 300' X 50' X
_91.. area to allow for the barges to come in and out vlitholJt hitting bottom. The
area was originally dredged to a depth of 9 ft., and the applicant wishes to regain
this depth. A spoil site is on adjacent high ground.

The proposed project will result in the excavation of 15000 square feet of
creek botto~, resulting in 1200 cubic yards of spoil material. The project will
result in increased 1 evel s of turbi dity duri n~ cons tructi on, however, these effects
will be short termed and localized.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 1/2 X 11 white paper. (Refer to Coastal
Resources Commission Rule 7) .0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners, These
individuals have 30 days in which to submit com-
