pennittee to a fine, imprisonment or civil action; or may cause the pennit to be null and void.

(1) The bu 1 khead must be constructed in stri ct comp 1 i ance wi th the project plans.

(2) All backfill material must be obtained from an upland source and confined
behind the authorized bulkhead.

(3) The act i vi ty must be conducted in such a manner as to prevent s i gni fi cant
increases in turbidity outside the area of construction or construction-related
discharge (increases of 25 NTUs or less are not ,considered significant).

This pennit action may be appealed by the pennittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This pennit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
- All work must cease when the pennit expires on
December 31, 1990 .

. bulkhead with a new bulkhead.

Environmental setting

The applicant owns a 100' x 140' lot on the Pam1ico River in Beaufort County.
Located on the lot is a single family dwelling whicll is served by a septic tank
sewage disposal system. The lot is bordered on the south by the Pam1ico River
and on the west by a manmade canal and boat basin. The portion of the property
which borders the Pamlico River is bulkheaded, however, the bulkhead has deter-
iorated to the point where replacement is necessary. No wetland vegetation is
present at the project site.

The applicant is proposing to replace the deteriorated bulkhead with a new bulkhead.
The new bulkhead will be 85' in length, will average 2.5' beyond the NWL and will
be + 3' beyond the NWL at the furthest point. When completed, the bulkhead will
be oackfi11ed with materials from an upland source.

Environmental impact
The project as proposed will have a minimal environmental impact.
