The project, involving wetland fill for road crossings and dam construction_ as a part of subdivision development, is located on a tributary of Lick Creek near Durham in Durham County. During the course of the review, five of the cooperating agencies submitted written comments, two of which initially included objections. As the review continued during the past several months, a mitigation proposal was submitted by the applicant. . One key agency, i.e., the Wildlife Resources Commission has agreed to the mitigation proposal subject to conditions provi ded in that agency IS 1 etters of March 27 and Apri 1 21. Based on the acceptance of the proposed mitigation by the Wildl ife Resources Commission, the state, through this coordinated viewpoint position, interposes no objection. The following recommendations and general information is submitted for your records: 1) The Division of Archives and History recommends that the proposed earthen dam construction and lake site be surveyed to determine the presence and National Register significance of any archaeological sites. Further, fill sites for roadways (Nos. 2, 4 and 5) should be surveyed and assessed; 2) The Division of Land Resources has determined that the project will require a plan for approval under the Dam Safety Law of 1967 and the Sedimentation Pollution Control Act. The applicant has been in contact with Land Resources on this matt~r, however, it is requested that the applicant be additionally advised of state requirements in your final correspondence; 3) The Division of Environmental Management issued Water Quality Certification No. 2041 for the proposed project on March 16, 1987. Box 1890 Wilmington, North Carolina 28402 Dear Colonel Woodbury: I have reviewed comments by the U.S. Fish & Wildlife Service and N.C. Wildlife Resources Commission on the 404 permit application of Mr. Phillip L. Stanley. Subsequently I met with FWS and WRC, and informed the N.C. Division of Environmental Management of the plan to be presented in this letter. I will address the comments of the N.C. Division of Archives and History separately. The purpose of this letter is to provide background information for the proposed 404 permit application amendment being filed with your office by Robinson-Sorensen & Associates, P.A. and Hudgins & Associates, P.E., and enclosed in this package. Briefly, FWS and WRC have agreed to withdraw certain recommendations and request others. A summary of our conversations is as follows. The agencies agreed that the applicant cannot grade new wetland entirely around the proposed lake because steep slopes would rapidly erode. They will not object to the lake contours and lake levels planned. FWS was informed that the upstream site may be unsuitable for creation of new wetland because of soil characteristics and size constraints. FWS agreed that the downstream site would satisfy its requirement for new wetlands. The developer proposes to emplace a clay dike within the ground at the downstream portion of the property, to extend laterally to the 283-foot contour, and downward to hardpan or clay. This dike should cause water to back up ..4 , Goldstein, p. 2 and saturate approximately 9.8 acres of forested soils adjacent to jurisdictional wetlands. A rock wier in the center of the dike would keep the stream within its current bed, raise its average depth and result in some temporary ponding which should benefit amphibian populations. No forest clearing or widespread disruption of topsoil would occur. Existing soils would saturate. Wetland intolerant trees, such as pines, would die and provide high-profile dead tree nesting habitat. Obligate and facultative wetland trees and understory would replace wetland intolerant species. The rate of conversion to wetland and the likelihood of conversion success would be high. Water quality would be protected by filtration through wetlands even more than in the original plan. Initial oral responses from FWS, WRC and OEM were favorable. We are providing copies of this plan and correspondence to all parties. We believe that FWS and WRC will modify their suggestions for conditions to the permit. We will also provide a copy to the N.C. Division of Archives and History, in anticipation of that agency's probab 1 e wi sh to add the di ke site to its recommended areas for cultural resources field investigations. State Clearinghouse ..~ Amendment to 404 Permit Application: Re: File No. SAWC087-N-032-0116 Springwood PUD, Durham County, NC Proposed Dike to Create New Wetlands Description: As a result of discussions with Fish and .Wildlife Service to create a wetland zone at 1:1 ratio to wetland lost through the creation of a lake and agreement with Fish and Wildlife Service to create the wetlands through the construction of a dike, the applicant is requesting the submitted 404 permit be amended to include the construction of a dike as shown on the attached exhibits. This dike would be constructed by removing unsuitable soil to an acceptable clay material as a foundation and then back fill with a clay material suitable to provide a barrier to limit ground water flow. The height of the dike will be a maximum of one (1) foot above existing f}rade. The total length of the dike is approximately 500 feet and will terminate at the 283.0 EL. MSL contour on either side of the existing creek. The top of the dike will not exceed 283.0 EL. MSL. Where the dike. intersects the creek, stone for erosion control, Class "B", (N.C. DOT Standards) will be used to provide a wier. The creek channel will not be altered, except as shown on the exhibits, nor will the dike and wier be designed to impound water resulting from a storm event. During construction, the creek will be temporarily diverted. The intent of the dike is to create new wetlands of approximately 9.8 acres by raising the groundwater table. The eXisting wetland, outlined and submitted to the Corps of Engineers under the original 404 permit application, is not included as part of the newly created wetland. . It is important to note that under this concept no other clearing, grading or earth disturbing activity will occur, other than to create the wier and dike. Changes in the environment will be expected to occur naturally. PHILLIP L. STANLEY, Post Office Box 1006, Cary, North Carolina 27511, has applied for a Department of the Army permit TO PLACE l"f.LL MATERIAL IN AN UNNAMED TRIBUTARY TO LITTLE LICK CREEK AND ITS ADJACENT WETLANDS TO EFFECT CONSTRUCTION OF AN EARTHEN DAM AND ROAD CROSSINGS (3) FOR A PROPOSED SUBDIVISION NEAR DURHAM, Durham County, North Caroli na. The following description of the work ls taken from Jata provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of an earthen dam across an unnamed tributary to Little Lick Creek to provide for construction of a 28-acre lake (Site No. 1 on plans). The dam site consists of high ground with the exception of the creek channel, approximately 20 feet wide along this work area. The construction will require relocation of approximately 180 linear feet of stream into 7-foot by 9-foot culverts (2) through the dam fill. In addition, the stream is to be relocated into a 20- to 25-foot-wide channel upstream of the dam, until the structure becomes functional, and into a spillway for approximately 150 feet downstream of the dam. A 30-foot-wide road is to be constructed on top of the dam to serve the planned subdivision. The proposed crossing at Site No.2, providing for a major residential connector between N,C. 98 and S.R. 1191, will involve construction through approximately 240 linear feet of wooded wetlands with a bottom width of 90 feet. This crossing will require the placement of approximately 652 cubic yards of upland fill material into wetlands and include installation of two culverts to carry flows through the fill. (Please note that Site No.3 on the attached plans does not contain waters or wetlands subject to Department of the Army permit authority.) Site No.4, located at the head of the proposed lake, will result in fill placement into a 310-foot by 130-foot area of ~etlands during road construction. Approximately 400 linear feet of stream will be filled and relocated into a laO-foot long culvert. Plans show the rlacement of 2985 cubic yards of upland fill into wetlands during constructIon of this crossing. The last crossing, Site No.5, will require a discharge of fill lnto a wetland area approximately 120 feet long and 90 feet wide. A single culvert will be installed through the 310 cubic yards of fill to maintain flows. -2- ~ The purpose of the proposed work is to provide a lake and access roads for Springwood Subdivision, a proposed community. The roads, as now proposed, have been designed with regards to existing property lines, required buffers and minimum radius requirements of the City of Durham. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). STANLEY, Post Office Box 1006, Cary, North Carolina 27511, has applied for a Department of the Army permit TO PLAC~: F'(LL MATERIAL IN AN UNNAMED TRIBUTARY TO LITTLE LICK CREEK AND ITS ADJACENT WETLANDS TO EFFECT CONSTRUCTION OF AN EARTHEN DAM AND ROAD CROSSINGS (3) FOR A PROPOSED SUBDIVISION NEAR DURHAM, Durham County, North Carolina. The following description of the work is taken from (lata provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of an earthen dam across an unnamed tributary to Little Lick Creek to provide for construction of a 28-acre lake (Site No. 1 on plans). The dam site consists of high ground with the exception of the creek channel, approximately 20 feet wide along this work area. The construction will require relocation of approximately 180 linear feet of stream into 7-foot by 9-foot culverts (2) through the dam fill. In addition, the stream is to be relocated into a 20- to 25-foot-wide channel upstream of the dam, until the structure becomes functional, and into a spillway for approximately 150 feet downstream of the dam. A 30-foot-wide road is to be constructed on top of the dam to serve the planned subdivision. The proposed crossing at Site No.2, providing for a major residential connector between N.C. 98 and S.R. 1191, will involve construction through approximately 240 linear feet of wooded wetlands with a bottom width of 90 feet. This crossing will require the placement of approximately 652 cubic yards of upland fill material into wetlands and include installation of two culverts to carry flows through the fill. (Please note that Site No.3 on the attached plans does not contain waters or wetlands subject to Department of the Army permit authority.) Site No.4, located at the head of the proposed lake, will result in fill placement into a 310-foot by 130-foot area of watlands during road construction. Approximately 400 linear feet of stream will be filled and relocated into a laO-foot long culvert. Among those are conservation, economics, aestheticR, general environmental concerns, wetlands, cultural valueR, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(I) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the OEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after January 20, 1987. All persons desiring to make comments regarding the application for Clean Water Act certification should do so in writing delivered to the North Carolina Division of Environmental Management, Post Office Box 27687, Raleigh, North Carolina 27611-7687, on or before January 14, 1987, Attention: Mr. William Mills.
