Office SUBJECT: NOTICE OF VIOLATION: INC NOV-2019-TX-0016, NC NOV-2019-TX-0017, NC NOV-2019-TX-0018 Whole Effluent Toxicity (WET) Testing NPDES Permit No. NCO081736 Melinda K. Knoerzer Adaptive Ecosystem Wastewater Treatment Facility Fender County Dear Mr. Woodruff: This is to inform you that the Aquatic Toxicity Branch, ATB, has not received your toxicity self -monitoring report form for the months of December 2018, January 2019 nor February 2019. This is in violation of Title 15A of the North Carolina Administrative Code, Chapter 2, Subchapter 213, Section .OS06 (a)(1)(A) which states that "monthly monitoring reports shall be filed no later than 30 days.after the end of the reporting period for which the report was made." Information contained on your eDMR and gathered through correspondence with the Wilmington Regional Office indicates that a toxicity test was not conducted during the months of December 2018, January and February 2019. Please remember that reporting of toxicity self -monitoring data is a dual requirement. Toxicity test results must be entered on your Discharge Monitoring Report and the Toxicity Reporting Form (AT Report Form) must be submitted to: DWQ/ESS, 1621 Mail Service Center, Raleigh NC 27699-1621 within the required time frame. This information and the following statement can be found in section A. (3.) of your permit: "Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed." Due to the multiple failures to monitor a Civil Penalty Assessment, CPA, will be issued accordingly in a separate letter. The reverse side of this Notice contains important information concerning your Whole Effluent Toxicity Monitoring and Reporting Requirements.
