Dear Mr. Furness:
You have our approval, in accordance with the attached conditions, to place fill material in 3.76 acres of ditches for
the purpose of restoring 324 acres of wetlands at Section I of Parker Farm tract, as you described in your application dated
November 6, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3109. This Certification allows you to use Nationwide Permit Number 27 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h). For this approval to be valid, you must follow the -conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Jeff and I felt the meeting with you last Tuesday was very informative and beneficial. We
appreciate the material you provided and will evaluate the banking process and its applicability to PCS,
and will present it to PCS management. We both believe it is the way to go.
On another matter, attached is the Pre-construction Notification Application for a Nationwide
27 for the restoration and enhancement of Section I. The original and one copy are enclosed, and
seven copies have been sent to the NC Division of Water Quality. We've included figures and
drawings, and wetland data forms for the area. I believe the process is very straight-forward. Also
enclosed is the letter of authorization from PCS Phosphate for me to act as agent on this project.
Please call me if you have any questions, or if you require any further information. The restoration of
Section H is underway, and we are prepared to begin the restoration/enhancement of Section I upon
your approval.
By the way, I got a nice 160-pound seven-point buck Saturday evening. I hope you and Ken
Jolly had good luck!

* The areas to be filled are 22,824 feet of man-made ditches which will be plugged and refilled with adjacent
spoil originally excavated when the ditches were dug. Blockage of these ditches by a logging road adjacent
to the canal along the northeastern side of Section I has contributed to making a portion of Section I
jurisdictional wetland. If the logging road plugs were removed, the 170 acres of wetland shown in Figure 1
would likely not be jurisdictional, based on other nearby ditched systems.

Plugs will _be_installed in ditches and canals to increase water storage capacity (see Figures 1 through 4). In
addition, the ditches will be filled with spoil left on-site from the original ditch excavation. Equipment to be
used includes bulldozers, backhoes, loaders and dump trucks. Other equipment may be used if necessary.
13. PURPOSE OF PROPOSED WORK: As a portion of the PCS Phosphate Company. Inc.'s wetland
mitigation on the 2.800 acre Parker Farm, the non-wetland acreage of Section 1 (154 acres) will be restored
to wetland, and the wetland acreage (170 acres) will be enhanced with additional water storage capacity by
plugging and filling the ditches and plugging the canals.

WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS):
Due to the nature of this proiect (restoration and enhancement of wetlands) the construction of ditch and
canal plugs and filling of ditches must occur partly in wetlands. If plugs are not installed and ditches not filled
in the wetlands then the water storage capacity will not be enhanced or restored to the site's natural state
prior to being ditched and drained.

* The areas to be filled are 22,824 feet of man-made ditches which will be plugged and refilled with adjacent
spoil originally excavated when the ditches were dug. Blockage of these ditches by a logging road adjacent
to the canal along the northeastern side of Section I has contributed to making a portion of Section I
jurisdictional wetland. If the logging road plugs were removed, the 170 acres of wetland shown in Figure 1
would likely not be iurisdictional, based on other nearby ditched svstems.

Plugs will be installed in ditches and canals to increase water storage capacity (see Figures 1 through 4) In

13. PURPOSE OF PROPOSED WORK: As a portion of the PCS Phosphate Company. Inc.'s wetland
mitigation on the 2.800 acre Parker Farm, the non-wetland acreage of Section I (154 acres) will be restored
to wetland, and the wetland acreage (170 acres) will be enhanced with additional water storage capacity by
plugging and filling the ditches and plugging the canals.

Due to the nature of this project (restoration and enhancement of wetlands) the construction of ditch and
canal plugs and filling of ditches must occur partly in wetlands. If plugs are not installed and ditches not filled
in the wetlands then the water storage capacity will not be enhanced or restored to the site's natural state
prior to being ditched and drained.
