Based on a recent conversation with the US Army Corps of Engineers, they stated that the U.S. Army Corps of Engineers had decided that this activity was exempt from the requirements of the 404 Permit Program. As long as no federal permit is required for this activity, no 401 Water Quality Certification is required either. However, we recommend that spoil be placed on uplands. Also an undisturbed 50 feet wide buffer must be maintained adjacent to all intermittent and perennial streams with forest vegetation. DEM ID: 981040. The North Carolina Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. A site visit was made on December 10, 1998. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U. S. C. 661 et seq. ), Section 401 of the Clean Water Act (as amended), and North Carolina General Statutes (G. S. 113-131 et seq. ). Most of the jurisdictional wetlands at the site have recently been logged. Some mature trees remain on the north side of the site around an existing irrigation pond. The subject wetlands are connected by a ditch to riparian wetlands associated with a tributary of Black Creek in the Neuse River Basin. The applicant proposes to fill 1.5 acres of wetlands and excavate 8.5 acres of wetlands for a total of 10 acres of wetland impact. If left alone to regenerate, the site would eventually become wooded wetlands providing high quality wildlife habitat and water quality protection functions. We consider the proposed 10 acres of wetland impacts to be excessive, especially in light of the presence of an existing irrigation pond. Therefore, we recommend that either 1) the scope of the project will be reduced so that no more than 3 acres of wetlands are impacted, or 2) wetland impacts will be fully mitigated for.
