PO Drawer 9 Sanford, NC 27331-0009 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.224 acres of wetlands and/or 3465 linear feet of streams for the purpose of constructing irrigation ponds and a golf course at Panther Creek Resort, as you described in your application dated October 8, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your new application except as modified below. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H 00506(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall not be allowed to flow directly into streams from this golf course. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. The project is located near Cary, NC (Chatham County). The site is shovvn on the attached plans and USGS'Topo Quad vicinity map. A Nationwide Permit 26 will be necessary to temporarily impact 0.224 acres (see map) of jurisdictional waters and wetlands above headwaters for the construction of irrigation lakes to serve a proposed golf course. The project is not feasible without these lakes. 'I'll(, potential buyer desires to know if the lakes can be permitted prior to proceeding further. Tile remaining project will contain little or no residential development and can be constructed with few other impacts except possible road crossings. The area is in the Triassic basin and has little base flow in the Stream, so adequate irrigation is not possible without the lakes. The streams are currently dry and the southern most channel may not even be jurisdictional. The lakes that are proposed will offer some increased wetland functional values in comparison to the existing on-site jurisdictional areas. The proposed lakes will be capable of holding more stormflow and will better allow for suspended solids to settle out. In light of the proposed development of the tract into a golf course, an increased stormwater flow holding time will assist in maintaining water quality downstream. Some areas of wetland and waters will be inadvertently created when the lake is constructed. Also DWQ usually requires lakes to be constructed on golf course projects. Wetland impacts are to intermittent channels. 'T'ile subsequent conversion of the headwaters of the lake and some margins of the lake to wetlands will more than off-set adverse impacts. Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste "Treatment Systems, Evaluation and Design Practical Altel'?liitlves/Mllllmlziltloll In my opinion, the information below should be adequate without further information. 1) The site is in the Triassic Basin (i.e. little base flow in streams mostly stormflow or winter flow when irrigation isn't needed). 2) 't'hese streams are dry in summer months when irrigation (about 300,000gpd) is needed so maximizing storage is of utmost importance. Pumping from a dry stream is not practical. 3) Depth to rock and common sense prohibits excavating a pond on hilltops or side slopes off natural drainageways. 4) It is not practical to obtain groundwater of sufficient volume alone in the 'T'riassic Basin to support a golf course's irrigation needs. 5) Placing the ponds on small tributaries rather than the large one will not maximize runoff collection, in filet it nlininlizes it by allowing most available runoff to bypass the irrigation ponds and the site. 6) The client has gone to great lengths to locate a site with minimal wetlands and jurisdictional waters in hopes of avoiding a complex permitting process. The attached Schematic Lake Plan contains Information regarding the sizes of the channels that are to be impacted. An agent authorization form is enclosed. Total impacts to significant "streams" due to dam construction will be 0'. DWQ does not require mitigation for impacts to streams due to pond construction and since total wetland impacts are less than one acre, no DWQ wetland or stream mitigation should be required. A Nationwide Permit 26 will be necessary to temporarily impact 0.224 acres (see map) of jurisdictional waters and wetlands above headwaters for the construction of irrigation lakes to serve a proposed golf course. The project is not feasible without these lakes. The potential buyer desires to know if the lakes can be permitted prior to proceeding further. The remaining project will contain little or no residential development and can be constructed with few other impacts except possible road crossings. The area is in the Triassic basin and has little base flow in the stream, so adequate irrigation is not possible without the lakes. The streams are currently dry and the southern most channel may not even be jurisdictional. The lakes that are proposed will offer some increased wetland functional values in comparison to the existing on-site jurisdictional areas. The proposed lakes will be capable of holding more stormflow and will better allow for suspended solids to settle out. In light of the proposed development of the tract into a golf course, an increased stormwater flow holding time will assist in maintaining water quality downstream. Some areas of wetland and waters will be inadvertently created when the lake is constructed. Also DWQ usually requires lakes to be constructed on golf course projects. Wetland impacts are to intermittent channels. The subsequent conversion of the headwaters of the lake and some margins of the lake to wetlands will more than off-set adverse impacts. Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design Practical Alternatives/Minimization In my opinion, the information below should be adequate without further information. 1) The site is in the Triassic Basin (i.e. little base flow in streams mostly stormflow or winter flow when irrigation isn't needed). 2) These streams are dry in summer months when irrigation (about 300,000gpd) is needed so maximizing storage is of utmost importance. Pumping from a dry stream is not practical. 3) Depth to rock and common sense prohibits excavating a pond on hilltops or side slopes off natural drainageways• 4) It is not practical to obtain groundwater of sufficient volume alone in the Triassic Basin to support a golf course's irrigation needs. 5) Placing the ponds on small tributaries rather than the large one will not maximize runoff collection, in fact it minimizes it by allowing most available runoff to bypass the irrigation ponds and the site. 6) The client has gone to great lengths to locate a site with minimal wetlands and jurisdictional waters in hopes of avoiding a complex permitting process. The attached Schematic Lake Plan contains information regarding the sizes of the channels that are to be impacted. An agent authorization form is enclosed. Total impacts to significant "streams" due to dam construction will be 0'. DWQ does not require mitigation for impacts to streams due to pond construction and since total wetland impacts are less than one acre, no DWQ wetland or stream mitigation should be required.
