Dear Mr. Cawthome:
You have our approval, in accordance with the attached conditions, for the purpose of a residential development, as
you described in your application dated August 31, 1998. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit
Number 14 when the Corps of Engineers issues it. This permit is also covered by Neuse River buffer rules (NBR). In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing, You must
act within 60 days of the date that you receive this letter, To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear John,
The purpose of this letter is to request NCDEHNR, Division of Water Quality Certification and Neuse
River Buffer Certification for two creek crossings located in Waterfall Plantation Subdivision, Phase 4.
Mr. James M. Adams (909 S. Main St., Wake Forest, NC 27587) owns this 79.5 ac. tract and plans to
develop 39 residential lots. The project is located near Wake Forest in Wake County. The site is shown
on the attached plans and USGS Topo Quad vicinity map.
A US Corps of Engineers Nationwide Permit 14 has been applied for at site 1 for the impact 0.0172 ac.
of jurisdictional waters for the proposed road crossing of the stream. This stream appears as a blue line
on the Quad vicinity map. The approximate channel width is 2-5 ft. wide.
Site 1 road crossing is proposed to gain access to approximately 26 ac. of land for the development of
11 residential lots. The proposed road is the only way to access this tract due to topographic constraints
and the configuration of the property lines for this tract of land. This road location is the only practical
location to access this property. We are requesting Water Quality Certification and Neuse River Basin
Buffer Rule Exemption for this stream crossing by a road.
Site 2 road crossing is located just above the intermittent stream. This storm drain road crossing
should be exempt from US Corps of Engineers, NCDEHNR Water Quality Certification and the Neuse
River Basin Buffer Rules.
