This Office would also like to point out that the applicant would unlikely be allowed to obtain a
dredging permit for this area (either now or in the future) due to the potential removal of this
area's function as a Primary Nursery Area. This removal of the area's function as a PNA would
be inconsistent with the antidegradation policy (15A NCAC 2B.201).
That the project is done in such a manner so as to not cause turbidity outside the immediate
construction area to exceed 25 NTU.

9. Project Description
The project site is a shoreline area, approximately five to sixteen feet above mean high water located
adjacent to the Atlantic Intracoastal Waterway near Sunset Beach in Brunswick County. The site is
bordered on the south side by Park Road which extends from Hwy 179 to the AIWW with a community
boat ramp at the waterward end. The portions of Park Road and boat ramp adjacent to the project site
are actually owned by the applicant (Sea Trails Corporation). On the north side, the property is bordered
by a private property owner. The size of the entire tract is 3.82 acres and there are no structures presently
existing on the tract. Existing vegetation on the tract includes live oaks, yaupons, wax myrtles and pine
trees on the upland portion. A fifty to sixty foot wide fringe consisting of Spartin alterniflora and Juncus
roemerianu with a mixture of sea oxeye and Limonium 5M exists along the waterward boundary of the
property. An approximately ten foot wide span of Spartin }patens extends landward of that fringe which
also contains a sparse mixing of sea oxeye. Portions of the proposed buildings are partially situated in the
estuarine shoreline area of environmental concern (AEC). The linear shoreline length is approximately
480 feet. Proposed development will impact adjacent estuarine waters, coastal wetlands and public trust
waters.
The land use classification for the tract from the Sunset Beach Land Use Plan is Developed and zoned
MB-1. The estuarine waters adjacent to the site are classified as SA waters by the Division of Water
Quality and are closed to shellfishing. The estuarine waters are designated Primary Nursery Area by the
Division of Marine Fisheries.
The applicant proposes to construct three 12-unit residential buildings, one 18-unit residential building,
clubhouse, swimming pool, parking lots, six foot wide pier, 12' X 12' gazebo, 12' X 32' T-head and two
8'X 20' floating docks with four boat slips. The applicant also proposes a concrete walkway on the upland
portion of the tract with an elevated walkway extending over the wetlands to the proposed pier. All
portions of the pier related structure that are wider than six feet are proposed over open water and will
not cover any vegetated marsh. Two of the residential buildings and the north side parking lot are partially
located within the 75 foot estuarine shoreline AEC. The applicant has calculated 14.67 % impervious
coverage within the estuarine shoreline AEC. The proposed buildings and parking lots are all located
landward of all coastal and federal wetlands. The applicant plans to utilize the Town of Sunset Beach
water system for potable water supply and the existing Sea Trails sewer system for sewage disposal. All
pier related construction is proposed to be at least 80 feet from the nearshore edge of the AIWW channel
and at least fifteen feet from either adjacent riparian corridor line. The applicant reports a water depth
at the waterward end of the pier as 2.0 ft at mean low water.
10. Anticipated Impacts
The proposed development will disturb approximately 3.82 acres of sparsely covered high ground area.
The applicant has submitted a stormwater plan to the Division of Water Quality, but as of this date, a
permit has not been issued. Since the proposed area of disturbance exceeds one acre, the applicant was
also required to submit a sedimentation and erosion plan to the Division of Land Quality. The applicant
proposes no fill nor excavation of federal or coastal wetlands. The project as proposed will incorporate
approximately 1556 sq. ft. of estuarine and public trust waters. The pier is consistent with the 1/4 rule
and greater than 80 feet from the near bottom edge of the AIWW. All pier related construction is
proposed to be at least fifteen feet inside of each riparian corridor line. Since there is no proposed
excavation associated with the construction of the pier, turbidity should be limited to that which results
from the placement of pilings.
It should be noted that the northside neighbor has submitted a letter which opposes the project in it's
entirety, but did not present sufficient documentation as to why the project should be denied. The
applicant appears to have either addressed all of the issues that were raised by the neighbor or is within
the bounds of the Division's current rules and regulations.

Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

9. Project Description
The project site is a shoreline area, approximately five to sixteen feet above mean high water located
adjacent to the Atlantic Intracoastal Waterway near Sunset Beach in Brunswick County. The site is
bordered on the south side by Park Road which extends from Hwy 179 to the AIWW with a community
boat ramp at the waterward end. The portions of Park Road and boat ramp adjacent to the project site
are actually owned by the applicant (Sea Trails Corporation). On the north side, the property is bordered
by a private property owner. The size of the entire tract is 3.82 acres and there are no structures presently
existing on the tract. Existing vegetation on the tract includes live oaks, yaupons, wax myrtles and pine
trees on the upland portion. A fifty to sixty foot wide fringe consisting of a altee iflora and Juncus
with a mixture of sea oxeye and Limonium sM exists along the waterward boundary of the
property. An approximately ten foot wide span of Spartin patens extends landward of that fringe which
also contains a sparse mixing of sea oxeye. Portions of the proposed buildings are partially situated in the
estuarine shoreline area of environmental concern (AEC). The linear shoreline length is approximately
480 feet. Proposed development will impact adjacent estuarine waters, coastal wetlands and public trust
waters.
The land use classification for the tract from the Sunset Beach Land Use Plan is Developed and zoned
M13-1. The estuarine waters adjacent to the site are classified as SA waters by the Division of Water
Quality and are closed to shellfishing. The estuarine waters are designated Primary Nursery Area by the
Division of Marine Fisheries.
The applicant proposes to construct three 12-unit residential buildings, one 18-unit residential building,
clubhouse, swimming pool, parking lots, six foot wide pier, 12' X 12' gazebo, 12' X 32' T-head and two
8'X 20' floating docks with four boat slips. The applicant also proposes a concrete walkway on the upland
portion of the tract with an elevated walkway extending over the wetlands to the proposed pier. All
portions of the pier related structure that are wider than six feet are proposed over open water and will
not cover any vegetated marsh. Two of the residential buildings and the north side parking lot are partially
located within the 75 foot estuarine shoreline AEC. The applicant has calculated 14.67 % impervious
coverage within the estuarine shoreline AEC. The proposed buildings and parking lots are all located
landward of all coastal and federal wetlands. The applicant plans to utilize the Town of Sunset Beach
water system for potable water supply and the existing Sea Trails sewer system for sewage disposal. All
pier related construction is proposed to be at least 80 feet from the nearshore edge of the AIWW channel
and at least fifteen feet from either adjacent riparian corridor line. The applicant reports a water depth
at the waterward end of the pier as 2.0 ft at mean low water.
10. Anticipated Impacts
The proposed development will disturb approximately 3.82 acres of sparsely covered high ground area.
The applicant has submitted a stormwater plan to the Division of Water Quality, but as of this date, a
permit has not been issued. Since the proposed area of disturbance exceeds one acre, the applicant was
also required to submit a sedimentation and erosion plan to the Division of Land Quality. The applicant
proposes no fill nor excavation of federal or coastal wetlands. The project as proposed will incorporate
approximately 1556 sq. ft. of estuarine and public trust waters. The pier is consistent with the 1/4 rule
and greater than 80 feet from the near bottom edge of the AIWW. All pier related construction is
proposed to be at least fifteen feet inside of each riparian corridor line. Since there is no proposed
excavation associated with the construction of the pier, turbidity should be limited to that which results
from the placement of pilings.
It should be noted that the northside neighbor has submitted a letter which opposes the project in it's
entirety, but did not present sufficient documentation as to why the project should be denied. The
applicant appears to have either addressed all of the issues that were raised by the neighbor or is within
the bounds of the Division's current rules and regulations.
