The following checklist outlines design requirements per the Stormwater Best Management Practices manual
(N.C. Department of Environment, Health and Natural Resources, November 1995) and Administrative Code
Section: 15 A NCAC 2H. 1008.
Initial in the space provided to indicate the following design requirements have been met and supporting
documentation is attached. If the applicant has designated an agent in the Stormwater Management Permit
Application Form, the agent may initial below. If a requirement has not been met, attach justification.

a. The temporary pool controls runoff from the 1 inch storm event.
b. The basin length to width ratio is greater than 3:1.
The basin side slopes above the permanent pool are no steeper than 3:1.
j. A submerged and vegetated perimeter shelf at less than 6:1 is provided (show detail).
Vegetation above the permanent pool elevation is specified.
An emergency drain is provided to empty the basin.
;. The permanent pool depth is between 3 and 6 feet (required minimum of 3 feet).
i. The temporary pool draws down in 2 to 5 days.
A trash rack is provided for both the overflow and orifice.
The forebay volume is approximately equal to 20% of the total basin volume.
:. Sediment storage is provided in the permanent pool.

a. Recorded drainage easement for each basin including access to nearest right-of-way.

Semi-annual inspections are specified in the O&M plan.
A debris check to be performed after every storm event is specified in the O&M plan.
Specific clean-out benchmarks are specified in the O&M plan (elevation or depth).
A legally responsible party is designated in the O&M plan3 (include name and title).
If the basin is used for sediment and erosion control during construction, clean out of the
basin is specified to be performed prior to use as a wet detention basin.
Footnotes:
1 when using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
2 The requirement for a vegetative filter may be waived if the wet detention basin is designed to meet 90% TSS removal.
3 The legally responsible party should not be a homeowners association unless more than 50% of the lots have been sold and a
resident of the subdivision has been named the president.
III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, forebay, non-integrated pretreatment
systems (pretreatment other than forebays), and the vegetated filter if one is provided.

a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, grass
cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days.
2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
I Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth. Removed sediment shall be disposed of in an appropriate
manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a
wet detention basin or stream, etc.).

5. Remove cattails and other indigenous wetland plants when they cover 75% of the basin surface. These
plants shall be encouraged to grow along the basin perimeter.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.
7. All components of the wet detention basin system shall be maintained in good working order.

mechanism. Repairs/cleaning will be done as necessary.
II. Quarterly (Four times a year):
A. Inspect the collection system (ie. catch basins, piping, grassed, swales) for proper
functioning. Accumulated trash will be cleared from basin grates, basin bottoms, and piping
will be checked for obstructions and cleared as required.
B. Pond inlet pipes will be checked for undercutting. Riprap or other energy dissipation
structures will be replaced, and broken pipes will be repaired.
III. semi-annually (twice a year):
A. Accumulated sediment from the bottom of the outlet structure will be removed.
B. '.Theforebay depth will be checked at various points. Sediment removal is required when the
;depth :is reduced to 75 % of the original forebay design depth of ' 4 ' .
C. Grassed swales, including the-vegetab d filter if applicable, will be reseeded twice a year as
necessary.

IV. -Annually (Once -a year):
A. The pond depth will be checked at various points. Sediment removal is required when the
depth is reduced to 75 % of the ori&al design depth or 3', whichever is greater. Design
depth is a ', measured vertically from the orifice down to the pond's bottom.
Sediment must be removed to at least the original design depth.
V. General:
A_ Mowing of the side slopes will be 4-6complisbcd according to the season. Maximum grass
height will be 6". i
B. Gattaiis are encouraged along the pond.perimeter, however they will be removed when they
cover mom tl=1/2 the surface area of the pond. The best time to cut them is at the end of
the growing season, in November. Environmentally sensitive chemicals for use in killing
cattails can also be used. Contact your nearest Agricultural Extension Agent.
C. The orifice/pump is designed to draw down the pond in 2-5 days. ;If drawdown is not
accomplished in that time, the orifice will be replaced with a larger or smaller orifice. Slow
drawdown may be attributed to a clogged system. The source of the clogging will be found
and eliminated.
D. All components of the detention pond system will-be kept in good worldng order. Repair
or replacement components will meet the original design specifications as per the approved
stormwater plan. If previously approved components are determined to be ineffective, the
component must be redesigned and/or replaced.

Enclosed is one copy of the revised site plan and grading plan for the above referenced
project along with a copy of the revised calculations. This project was approved by your
office on September 22, 1998, but the owner has asked for some revisions to the site plan
as you and I have previously discussed. These changes only slightly affected the
calculations. The previously approved plan had 64.6% impervious area, and this plan has
65.6% impervious coverage. Our calculations had used a conservative 70%, so even
without modifications, we would be in compliance.
Please let me know if anything further must be done in order for us to receive approval for
these plan changes. Thank you for your time.

Thank you for your November 18, 1998 letter concerning the 401 Water Quality
Certification issued for the project on September 22, 1998. DWQ has no objections to
extending the payment deadline for compensatory mitigation until March 1, 1999.
However deed notification will need to be placed on all deeds as outlined in our
Certification within 30 days of the date of this letter. These notifications can mention the
proposed Town of Kernersville road crossing so as not to preclude this development.

Wyatt Development Company - Kernersville Project

Dear Mr. Dorney:
On behalf of Wyatt Development Company, we would like to request an extension on
implementing the conditions associated with compensatory mitigation for the above referenced project.
Wyatt Development Company is not expected to take ownership of the property until February 1999. The
proposed stream impacts would not occur until after the property is purchased. Hence, Wyatt
Development Company would request to delay the $61,750 payment to the DEHNR Wetland Restoration
Program until the end of February 1999. Additionally, placing deed restrictions on the remaining section
of the stream is pre-mature as the Town of Kernersville intends to construct a road crossing in that area.
The plans for the road crossing have not been finalized and the downstream limit of the stream
preservation area can not be determined. Therefore, Wyatt Development requests that placing deed
restrictions on the remnant stream area be delayed until the Town of Kernersville implements the road-
crossing project.

Dear Mr. Dorney:
On behalf of Wyatt Development Company, we would like to request an extension on
implementing the conditions associated with compensatory mitigation for the above referenced project.
Wyatt Development Company is not expected to take ownership of the property until February 1999. The
proposed stream impacts would not occur until after the property is purchased. Hence, Wyatt
Development Company would request to delay the $61,750 payment to the DEHNR Wetland Restoration
Program until the end of February 1999. Additionally, placing deed restrictions on the remaining section
of the stream is pre-mature as the Town of Kernersville intends to construct a road crossing in that area.
The plans for the road crossing have not been finalized and the downstream limit of the stream
preservation area can not be determined. Therefore, Wyatt Development requests that placing deed
restrictions on the remnant stream area be delayed until the Town of Kernersville implements the road-
crossing project.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS, WRP

Dear Mr. Murphy:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 494 linear feet of waters for the purpose of constructing a commercial development at I-40 and S. Main
Street in Kernersville in Forsyth County, as you described in your application dated August 14, 1998. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In
addition, you should get any other federal, state or local permits before you go ahead with your project including
(but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this Certification
and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional
wetlands and waters to notify the state in order to assure compliance for future wetland and/or water
impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of
the 404 Permit (whichever is later).
2. An additional condition is that a final, written stormwater plan including wet detention basins must be
approved by DWQ before wetland (or stream) impacts occur.
We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate
for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0500, this contribution will
satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H
.0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check
(made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell
should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration
Program. You have one month from the date of this Certification to make this payment. For accounting purposes,
this Certification authorizes the rill of 494 feet of streams, in 030704 river and subbasin and 494 feet of
stream restoration are required. Please be aware that the Wetland Restoration Program (WRP) rules
require rounding of acreage amounts to one-quarter acre increments (15A 2R .0503(b)).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final
and binding unless you ask for a hearing.

Enclosed please find a Pre-Construction Notice for the referenced commercial development
project located in Kernersville, Forsyth County, North Carolina. A vicinity map, waterways map, grading
and development plan and cross-section drawings are included with the application form. Seven copies of
the application along with applicable information from the wetland delineation report have been
forwarded to NCDENR.
A total of 494 linear feet (0.068 acre) of waterway is proposed to be impacted from the
commercial development. An additional 0.05 acre intermittent ditch will also be impacted. A retaining
wall has been incorporated into the project in an effort to minimize the linear footage of impacts. Storm
water controls include two wet detention ponds and associated piping.

Conventional clearing and grading equipment will be used to prepare sites for building
pads, parking areas and associated facilities. Sediment and erosion control measures have been
incorporated into the design plans to prevent degradation of downstream water quality. Vegetated
buffer zones and erosion control devices will also be used to protect waterways on the property.
Approximately 494 linear feet (0.07 acre) of stream bed will be piped and filled. A 0.05 acre
intermittent ditch will also be filled as part of the development project. The upstream portion of the
intermittent stream will be piped approximately 450 feet and allowed to discharge into the storm
water detention system. The site waterway map and grading plan are included as Figures 2 and 3,
respectively.

On September 22, 1998 you were issued a 401 Water Quality Certification authorizing
you to impact wetlands and or waters of the State. As part of this Certification you were required
to make a payment to the N.C. Wetland Restoration Program for impacts to 494 feet of stream.
As of this date, no payment for these activities has been received.
You are hereby notified that the wetland and or water impacts approved by your 401
Certification must not be initiated PRIOR to payment into the WRP. Failure to make payment
for wetland or stream impacts as required by your 401 Water Quality Certification may result in
an enforcement action being initiated against you. Additionally, a Civil Penalty assessment not to
exceed $10,000 per day may also be levied against you.
Please submit your payment and return the enclosed form to the WRP (address listed on
the form) within 21 days upon your receipt. If this matter is not resolved by this time, NCDWQ
will proceed to revoke your Certification and initiate an enforcement action you for this matter.

Stormwater Management Report, and water quality calculations for the
above referenced project. The site is located on the north side of South
Main Street approximately one-half mile south of its intersection with US
Highway 421. It sits directly behind the existing K-Mart Shopping
Center.
Also enclosed are all of the application forms and the $385 application
fee. The Town of Kernersville requires only that we control the runoff
from the first one 0 ") inch of rainfall, but we have designed the facility to
control the quantity of the 2, 10, and 25 year storm events.

1. Monthly, or aver every runoff producing rainfall event, whichever comes first:
A. Inspect the trash rack; remove accumulated debris, repair/replace if it is not functioning.
B. Inspect and clear -the orifice of any obstructions. If a pump is used as the drawdown
mechanism, pump operation will be checked. A log of test runs of the pump will be kept
on site and made available to DWQ personnel upon request.
C. Inspect the pond side slopes and grassed inlet swales; remove trash, and repair eroded areas
before -the next rainfall event.
D. If the pond is operated with a vegetated filter, the filter will be checked for sediment
accumulation, trash accumulation, _ erosion and proper operation of the flow spreader
mechanism. Repairs/cleaning will be done as necessary.
II. Quarterly (Four times a year):
A. Inspect the collection system (ie. catch basins, piping, grassed swales) for proper
functioning. Accumulated trash will be cleared from basin grates, basin bottoms, and piping
will be checked for obstructions and cleared as required.
B. Pond inlet pipes will be checked for undercutting. Riprap or other energy dissipation
.structures will be replaced, and broken pipes will be repaired.
III. Semi-annually (twice a year):

A. Accumulated sediment from the bottom of the outlet structure will be removed.
B. .The forebay depth will be checked at various points. Sediment removal is required when the
;depth is reduced to 75 % of the original forebay design depth of ' 4 '
C. Grassed swales, including the-vegetated filter if applicable, will be reseeded twice a year as
necessary. >

W. -Annually (Once a year):
A. 16 pond depth will be checked at various points. Sediment removal is required when the
depth is reduced to 75% of the original design depth or 3', whichever is greater. Design
depth is 4 measured vertically from the orifice down to the pond's bottom.
Sediment must be removed to at least the original design depth.
V. General:
A. Mowing of the side slopes will be 4-6complished according to the season. Maximum grass
height will be 6".
B. Cattails are encouraged along the pond perimeter, however they will be removed wbcn they
cover more than 1 /2 the surface area of the pond. The best time to cut them is at the end of
the growing season, in November. Environmentally sensitive chemicals for use in killing
cattails can also be used. Contact your nearest Agricultural Extension Agent.
C. The orifice/pump is designed to draw down the pond in 2-5 days. If drawdown is not
accomplished in that time, the orifice will be replaced with a larger or smaller orifice. Slow
drawdown may be attributed to a clogged system. The source of the clogging will be found
and eliminated.
D. All components of the detention pond system will-be kept in good working order. Repair
or replacement components will meet the original design specifications as per the approved
stormwater plan. If previously approved components are determined to be ineffective, the
component must be redesigned and/or replaced.

Urine the Table I.1 How to find the Surface Area of the Per„iMenr Pool
The numbers in the Table I.1 represent surface area (SA) to drainage area (DA) percentages. SA= the wet detention
pond permanent pool surface area required to provide an expected 85% Total Suspended Solids removal. The chartis
based on the amount of impervious cover as a percentage of the area draining to the pond and the depth of the
permanent pool. Impervious percentages are in the left hand column of the chart and depths are given across the table
from 3 feet to 9 feet in one foot increments. If needed, one can interpolate to find the SA/DA ratio that is needed in a
particular case.
To determine the required permanent pool size, use the following steps:
1. Calculate the percent impervious cover of the site draining to the pond
[amount of impervious area / total site area]
2. Determine the average permanent pool depth (or select a depth for comparison purposes).
3. Go to Table I.1 and find the number corresponding to the impervious percentage found above and the depth
assumed This number, taken from the body of the table, represents the permanent pool surface area as a
percentage of the drainage area.

STORMWATER MANAGEMENT REPORT
The following is the stormwater management report for the new Shopping Center to be
built adjacent to South Main Street approximately one-half of one mile south of its
intersection with US Highway 421. The site will be developed to contain a +/-203,500 sf
Anchor store, a +/-27,500 sf Second Anchor, +/-54,500 sf of retail shops, accompanying
parking and landscape areas, and three (3) outparcels. All of the development has been
accounted for in the stormwater calculations. (We have assumed 85% impervious
coverage on the outparcels because this is the maximum impervious area allowed by the
zoning.) The stormwater system will be a combination of catch basins and pipes which
will convey all runoff from this development to the stormwater management (SWM)
facility.
The SWM facility appears on the drawings to be two ponds,-but they will act together as
one as they will be tied together with a 48" RCP and the runoff will be controlled through
one outlet structure. This SWM facility is only required to control the first one (1 ") inch of
runoff from the site, but it has been sized to control the 2 year, 10 year, and 25 year
storm events, and will have staged outlets to manage each storm. All release will be
restricted to be less than or equal to pre-developed rates. The calculations indicate a
decrease in the rate of runoff into the ditch which currently runs through the property. All
runoff will be directed to the existing ditch at the southwest of the property. The 100 year
storm event will pass through the top of the riser in the pond.
This SWM facility will also serve as a sediment basin during the construction phase.
Please also note that the pond will be a wet detention pond in order to satisfy the
requirements of the Division of Water Quality of NCDENR. Those calculations are also
included with this report. The first one (1 ") inch of rainfall volume will be released over a
period of between two and five days.

Existing Conditions:
In the pre-development condition, approximately 34.1 acres drains to the existing ditch
which runs through the center of the property. The site is currently comprised of a large
field containing few structures. The field is well grassed with some wooded areas, but it
has recently been timbered. The terrain can be characterized as severely sloping with most
of its runoff being sheet flow to the well defined ditch mentioned above.
The remainder of the property, (+/- 6.5 AC), currently drains to the southeast of the
property to a 24" RCP which runs under South Main Street to the south. This runoff will
0 be diverted to the SWM facility in the post-developed condition.
The site is not located within the 100 year flood zone as defined by FEMA.
Runoff calculations; Existing conditions:
The following runoff calculations will analyze the area of the site that will drain to a point
just downstream of the future SWM facility at the southwest side of the site. The existing
drainage area to this point includes a total of 34.1 acres. The entire area can be classified
as brush, weed, grass mix with a soil classified as type B.
The runoff for both the existing and developed conditions will be calculated using the
TR-55 method. This method considers land use, time of travel for runoff, rainfall events
as prescribed by the US National Weather Service and TR-55 for this particular area, and
the size of the area to determine the stormwater runoff.
The rainfall amounts will vary based on the design storm. The area is also analyzed to
determine its current land use and a runoff curve number is then generated for the site.
Next, the time of concentration, travel time in minutes, of the runoff from the most
remote point of the drainage basin to the outlet point is determined and these items are
used in the calculations to determine the runoff, Q.
Runoff Curve Number:
The runoff curve number is based on land use for the area and percent of the area with
that type of use. For example, pavement has a runoff curve number of 98 as it is almost
entirely made up of impervious area. This number also takes into account the soil type as
determined by the Soil Conservation Service. The soils are then classified as type A, B, C,
or D with each having varying rates of runoff. This site is comprised of entirely type B
soils. The curve number for this site with type B soils in good condition will be 68.

Time of Concentration:
The time of concentration is based on three types of travel path: sheet flow for up to 150
feet, shallow concentrated flow after 150 feet and/or open channel flow in ditches or
pipes. For this site, the time of concentration is comprised of sheet flow for the first 150
feet at a 4.67% slope. The runoff then becomes shallow concentrated flow for another
720 feet at a slope of 5.69%. The remainder of the travel path is open channel flow for
980 feet and we have assumed a conservative flow velocity of 3 ft/s for this ditch. From
the TR-55 calculations, we determined the time of concentration to be as follows:
150' sheet flow at 4.0%, 600' shallowconcentrated flow at 7.1 %, and
970' open channel flow at a conservative flow velocity of 3 ft/s.
Tc, = 0.30 hours = 18 minutes
Runoff Calculatlons - Tabular Hydrodraph Method
Per the TR-55 program, the runoff will be calculated for the area and a hydrograph will be
generated for it. This will be done for the 2 year, 10 year, 25 year, and 100 year storm
events based on the curve number and time of concentration. The results are as follows:

Runoff Calculations; Developed conditions:
In the developed state, the drainage area to the front SWM facility will increase by 6.5
acres for a total drainage area of 40.6 acres. Of this area, 12.2 acres will remain as open
space, pervious area, and 28.4 acres will be impervious. This assumes a very conservative
85% impervious area on all of the outparcels.
Runoff Curve Number:
The developed condition will consist of 8.94 acres of grassed area in good condition, type
B soils, with a curve number of 61, and 28.4 acres of impervious area with a curve
b number of 98. This results in a weighted curve number of 87 for the developed area
draining to the SWM facility.
Time of Concentration:
The time of concentration in the developed condition is calculated using the same start
point as the pre-developed condition. The flow path consists of 150 feet of sheet flow at a
slope of 1.5%, and 374 feet of shallow concentrated flow at 0.50%. From this point, the
runoff will enter a catch basin at the rear of the retail shops and travel 2200 feet at an
assumed 8 fps into the front SWM facility. From the TR-55 calculations, we determined
the time of concentration to be as follows:
150' sheet flow at 1.5%, and 374' shallow concentrated flow at 0.50%
Tc = 0.18 hours = 10.8 minutes
Graphical Peak Discharge:
The runoff for the developed condition is calculated using the TR-55. The calculations are
performed for the 2, 10, 25, and 100 year storm events. The results are as follows:

SWM FACILITY SIZING AND ROUTING:
The SWM facility, as can be seen on the grading plan, will be comprised of two surface
ponds connected with a 48" reinforced concrete pipe. The facility will have a bottom
elevation of 900.0 and the top of the berm will be 910.75. The side slopes will be 3:1
horizontal to vertical. The total volume of the SWM facility at elevation 910.75 is
+/-321,620 cf. TR-55 is then used to estimate the required storage for the 2, 10, 25, and
100 year storm events. From these estimates we determined the following:

Once the required volumes are known, the volumes are interpolated on the volume chart
to determine the elevation at which these volumes are achieved. Using these elevations
we determine the head on the outlet structure for each storm event and size the outlet
based on the pre-developed release rates and the head. The outlet structure must be
designed to limit the rate of release from the SWM facility to a pre-determined amount
and is designed to limit flow in stages, limiting the 2 year storm event to the pre-
developed 2 year rate, etc. The outlet structure will consist of a 60" riser with an orifice to
control the first one (1 ") inch rainfall and a weir to control the 2 year, 10 year, and 25
year storm events. The 100 year storm will be controlled through the top of the riser.
The outlets will be sized as follows:

It should be noted that to provide a more conservative design, the orifice calculations are
have been done using the bottom of the orifice to calculate head in lieu of the standard
calculation using the center of the orifice.
From these equations, (refer to calculations), it is determined that 1 - 3" orifice at
elevation 904.0 will control the one (1 ") inch rainfall and a 7.5' weir at elevation 906.17
will control the 2 year, 10 year, and 25 year storm events. The top of the riser will at
elevation 908.98. The results are on the following page.
