On September 4, 1998 the Division of Water Quality sent a letter stating your
project was on hold since the approval we issued on August 13, 1998 was for a sewer line
and the Corps permit was for additional fill for a parking lot, building pads, detention
pond and road access. DWQ needs seven copies of the PCN application for a Nationwide
Permit 26 and 14 before we can issue the 401 Certification. To date, we have not
received the mentioned information regarding this project.
If we do not hear anything from you within two weeks of the date of this letter, we
will be forced to withdraw the project.

The Division of Water Quality has reviewed your submittal for a 404/401
permit and the recently issued COE permit for River Landing at Sandy Ridge in Guilford
County. Your application was not complete since the approval we issued on August 13,
1998 was for a sewer line as requested in your July 28, 1998 request. However the Corps
permit was for additional fill for a parking lot, building pads detention pond and road
access. Without a 401 Certification from the Division, wetland and water impact cannot
occur. Please provide information regarding the location of your project. This
information is needed by DWQ in order for us to decide whether this project is
approvable.
I can be reached at 919-733-1786 if you have any questions. Until this
information is received, I will request (by copy of this letter) that the Corps of Engineers
place this project on hold. Also, the project will be placed on hold for our processing due
to incomplete information (15A NCAC 2H.0507(a)(4)).

APPROVAL of 401 Water Quality Certification

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, for the
purpose of installing a sewer line on Sandy Ridge Road in Guilford County, as you described in your
application dated July 30, 1998. After reviewing your application, we have decided that this impact is covered
by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit
Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will.
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Domey at 919-733-1786.

INSTRUCTION SHEET - This sheet provides
instructions on how to locate the number and title of
the Nationwide permit being applied for and which
agencies require notification. Each of the
Nationwide permits includes terms and conditions
which are not summarized in this document. Before
deciding if a particular Nationwide permit covers your
proposed work, you should consult either the Code of
Federal Regulations 33 CFR Part 330 or the local
Corps of Engineers Regulatory Field Office.
2. NATIONWIDE PERMIT REQUIREMENTS TABLE -
This table lists the numbers and titles of available
Nationwide permits and agencies to be notified.
3. AGENCY ADDRESSES - The PCN process requires
that the applicant contact certain agencies regarding
project activities. Therefore, addresses and
telephone numbers of these agencies are
provided.
4. PRE-CONSTRUCTION NOTIFICATION FORM -,
This form requests information from the applicant with
regard, to the proposed work to occur in wetlands. ~'

1. Locate Permit Requirements Table.
2. Locate top, far left column designated as "Nationwide
Permits (NWT) Numbers and Titles." Follow the
column down to determine the number and title of the
Nationwide permit for which you are applying
(example : 18 Minor Discharges).
3. Follow the row across for the specific
Nationwide permit in which you are interested to
determine the requirements for notification to each
agency listed in the six columns.
4. Use addresses included on AGENCY ADDRESSES
sheet to send number of copies specified on
PRE-CONSTRUCTION NOTIFICATION form to
each agency. Telephone numbers are provided for any
questions you may have concerning instructions or
procedures.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place
fill material for the purpose of constructing road crossings and ponds at River Landing at sandy Ridge
near High Point, NC, as you described in your revised application dated April 3, 1998. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification
Numbers 3127, 3103, and 3108. These certifications allow you to use Nationwide Permit Numbers 3,
14, and 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and to send us a new
application. If the property is sold, the new owner must b-_ given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Deed notifications or similar mechanisms shall be placed in all lots with remaining jurisdictional
wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place
within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
A 30 foot wide vegetated buffer must be maintained around the new pond.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The purpose of this memo is to advise you that you have confueed two
different applications. This previously happened before in a 9/4/98
letter from you (copy attached). At that time our clients advised you of
the mistake and you confirmed it had been corrected. Apparently no one
at your office documented the correction so the mistake has surfaced
again.
You refer to DWQ #980752 and COE # 199820423 in your letters. While
this is the correct Corps ID # it is not the correct DWQ #.' DWQ #
980049 (copy attached) is the correct # for our project for roads, parking
lots and buildings pads. Apparently DWQ #980752 is for a sewer line
with which our firm had nothing to do. I have no idea what the Corps ID
# is for that job.
Bottom line: Contrary to your letters, our client's project does have a
valid 401 Certification and 444 Permit for impacts related to
roads, parking lots, detention ponds and building pads.
Please provide written correspondence that your letters were in error and
than no further authorization from your office is necdcd unlcss our
client's plans/impacts change. Thank you in advance for your prompt
attention to this matter.

The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.53 acres of
streams and/or wetlands located at River Landing at Sandy Ridge near High Point based on an application dated
January 21, 1998 in Guilford County for a commercial development (Senior Living Community) Based on this
review, we have identified significant uses, which would be removed or degraded by this project. These uses are
aquatic life in the streams, which are classified as WS IV. Furthermore, insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H
.0506. However, we understand that you are revising the site plans to further minimize impacts. Until we receive
these revised plans, we will place the project on hold. Until we receive additional information, we are requesting (by
copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place
your project on administrative hold.
Please respond within two weeks of the date of this letter by sending a copy of this information to me and one
copy to Mr. Ron Linville Winston-Salem Regional Office at 585 Waughtown Street NC 28115. If we do not hear
from you in two weeks, we will assume that you no longer want to pursue this project and we will consider the
project as withdrawn. I can be reached at 919-733-1786 if you have any questions.
