Devine CP&L PO Box 1551 Raleigh NC 27602 Dear Mr. Devine: You have our approval, in accordance with the attached conditions and those listed below, for the purpose of installing a gas line in Buncombe County, as you described in your application dated July 30, 1998. After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Baker and Dorney: July 24, 1998 Carolina Power & Light Company (CP&L) is constructing a gas-powered combustion turbine (CT) facility at the existing Asheville Steam Electric Plant near Arden, NC. The CT facility itself is being constructed entirely on high ground, and will not impact waters or wetlands. The associated construction of a pipeline used to supply natural gas for the CT facility will involve crossing two small streams and a portion of Lake Julian (enclosed Figure 1). CP&L believes that the proposed construction techniques described below are consistent with the "no notification„ conditions of Corps Nationwide Permit No. 12 and NCDWQ Water Quality Certification #3101. However, because the pipeline is being constructed in a fairly developed area, CP&L believes it is prudent to notify both the Corps and NCDWQ of the proposed work in the event that questions are directed to either agency by the public. Similar questions may be directed toward CP&L; thus we are also requesting written concurrence from the Corps and the NCDWQ that the proposed project is consistent with the conditions of the NWP and WQC. Project Description The planned pipeline will extend from an existing PSNC pipeline located just east of US Highway 25 to the Asheville Plant along the route shown on Figure 1. This route was chosen to minimize impact on existing streams, roads, and structures. No wetlands areas were observed Messrs. Baker and Dorney 2 the crossings of two small streams and one arm of Lake Julian. The streams, both unnamed, are shown on Figure I at locations 11+60 and 77+80. CP&L proposes to cross the two small streams by installing the pipeline in a trench dug into the streambeds. While directional boring under the streams is an option, we believe that direct trenching will disturb a minimal amount of streambed and a considerably smaller area adjacent to the stream than would the equipment needed for directional boring. Additionally, the time required to complete the crossings is minimal (likely less than one day each). Crossings will be made as close to right angles with the channels as possible. Where required to access these streams for pipeline installation, streambanks may need to be graded slightly, and temporary equipment crossings may be required. If required, such crossings will be constructed of riprap to minimize instream turbidity as shown in Figure 2. All material removed from the streambed or streambanks will be contained within silt fences away from the stream. Any disturbances of the streambank or adjacent areas will incorporate silt fences or other measures necessary to minimize erosion into the stream. Upon completion of pipeline installation at each crossing, each site will be restored to original contours, and disturbed areas stabilized with temporary and permanent ground covers. For the lake crossing, the pipeline will be directionally bored under the lake bed, without disturbing the lake shore or lake bottom. Where needed as a result of disturbance of any property adjacent to shoreline areas, silt fences will be installed prior to beginning work. Construction for the pipeline is anticipated to begin in early fall of 1998, after acquisition of rights-of-way, with completion scheduled by year's end.
