The site is located on the southern side of Clinton Road (SR 1006), Eastover Township, Cumberland County, North Carolina. The owner wishes to obtain a Jurisdictional Determination for .the additional 4.26-acre tract and to modify the existing wetland permits for the Cape Fear Crossing subdivision to include an additional 0.03 acre of wetland impact and to reflect change of ownership. A wetland delineation was conducted for the 4.26-acre tract on 4 December 2006. All wetland determinations were made in accordance with the 1987 US Army Corps of Engineers Wetland Delineation Manual The property perimeter was walked and several traverses were conducted across the interior of the subject site. Areas that meet the required criteria for wetlands were observed and delineated, as shown on the attached map. A jurisdictional determination for the origina141.5-acre tract was made by Lillette Granade of the US Army Corps of Engineers (USACE) on June 20, 2005 (Action Id 200500246). Permanent impacts to 0.28 acre of wetlands and 701inear feet of stream were authorized by USACE on June 20, 2005 and by NC Division of Water Quality on June 29, 2005 (DWQ Project # OS-0345). Mitigation for these impacts was prescribed as payment to the Ecosystem Enhancement Program for 0.58 acre of wetland and 1401inear feet of stream (2:1 mitigation ratio). The 41.5-acre tract of the subdivision connects to Clinton Road by a narrow strip of land, which forced the subdivision road width to be undersized. With the addition of the 4.26-acre tract to the site, the owner is able to adequately widen the entrance at Clinton Road to conform to DOT standards. This modification will cause an additional 0.03 acre of wetlands to be filled (see attached map). The owner requests that the existing USACE and DWQ permits be revised to reflect this modification and to indicate that total permanent wetland impacts for the subdivision is 0.31 acre. This would increase the total amount of required wetland mitigation to 0.62 acre, which is less than the 0.75 acre of wetland credit that EEP would charge for. Therefore, additional mitigation is not necessary. The original owner of the property and permit recipient was Neill P. Guy, III. Mr. Guy sold the property to Floyd Properties and Development Inc on 3 May 2006. Anew invoice will be issued by EEP to Floyd Properties and Development Inc. for the permitted impacts. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Pernnit1401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In .Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies Iisted at www.nceep.net.
