Dear Mr. Parks:
You have our approval, in accordance with the attached conditions, to place fill material in 1 acre of wetlands or
waters for the purpose of constructing a bulkhead, pier, platform and boathouse, as you described in your application dated
July 15, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation
may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

8. PROJECT SUMMARY: The applicant would like to construct 169 linear feet of bulkhead a maximum
of 18' waterward of normal water level and grade and slope the property within 75 feet of Normal
Water Level. The applicant also proposes a 4'x 180' pier, a 500 square foot platform and a 14'x 26'
(364 square foot) open sided boathouse with boat lift.

PROJECT SETTING
The applicant's property is located on the Pasquotank River off Small Drive, Newbegun
Land, Pasquotank County, three lots southeast of Margret Road (See Enclosed Map). Located
to the north and south of the applicant's property are developed residential lots. The property
is bounded to the east by the Pasquotank River and to the west by Smalls Drive. Total area of
the lot is 34,023 square feet, of which approximately 972 square feet are coastal wetlands.
Wetland vegetation is located approximately center of the 169' of shoreline and along the
northeast corner and includes cattail (Typha angustifolia), soft rush (Juncus effusus), royal fern
(Osmunda regalis), bald cypress (Taxodium distichum), and pennywort (Hydrocotyle
umbellata). Upland vegetation includes, but is not limited to, a variety of yard grasses, Red
Maple (Acer rubrum), Wild Carrot: Queen Anne's Lace ( Daucus carota), Wooley Mullein
(Verbascum thapsus), Virginia Creeper (Parthenocissus quinquefolia), Sow Thistle (Sonchus
asper), and Pin Oak ( Quercus palustris).
Erosion is evident on the applicant's property and has resulted in subsidence along an
eight-foot high bank on the southwest end of the shoreline. Several trees have fallen into the
river as a result of the subsidence that has occurred over the last year. An existing wetland
fringe slowed erosion in the center of the property, while deep pockets have formed to the
north and south of the wetland fringe.
A two-story brick dwelling is under construction on the applicant's property and was 80
feet landward of normal water level at the time constructed began. Due to excessive erosion
the shoreline now falls within 68' of the dwelling.
The Pasquotank River adjacent the property is classified as joint waters by agreement
between the Marine Fisheries Commission and Wildlife Resource Commission. The Division
of Environmental Management's water quality classification for the Pasquotank in the project
area is SC (fish propagation) and is closed to shellfishing.
A large number of pottery shards, with a variety of designs, have been found along the
shoreline and in the water adjacent to the applicant's property.
PROJECT DESCRIPTION
The applicant proposes to construct a 169' bulkhead along an irregularly shaped
shoreline. The bulkhead will be placed landward of all wetlands on the applicant's property,
backfilled and graded. The bulkhead will be constructed a maximum distance of 14' and
average distance is 10' waterward of normal water. Total area of fill in Estuarine Water will
be 927 square feet and high ground fill will be approximately 962 square feet. It is estimated
that 32 cubic yards of fill material will be required to back fill the proposed bulkhead. While
submerged aquatic vegetation is present in the shallow water adjacent the property, there is
none present within the proposed bulkhead alignment.

Included in the proposal is a 4'x 180' (720 square foot) pier, a 20'x 25' (500 square
foot) "T" head platform and a 14'x 26' (364 square foot) open sided boat house with a boat
lift. The overhang of the boat house on the north side will be over the proposed four foot
wide pier. The proposed pier will cross approximately 10' of feet of coastal wetlands and be
located approximately center of the applicant's lot.
ANTICIPATED IMPACTS
Loss of 972 square feet of Estuarine Water and Shallow Water Habitat.
• Shading of 1,518 square feet of Estuarine Water by the pier, platform and
boathouse.
• Shading of 40 square feet of coastal wetlands by the pier.
• Temporary localized turbidity will result from the construction of the bulkhead,
pier and boat house.
