Dear Mr. Hughes:
You have our approval, in accordance with the attached conditions and those listed below, to impact 0.01
acres of wetlands or waters for the purpose of installing a sewer line, as you described in your application
dated May 4, 1998. After reviewing your application, we have decided that this impact is covered by General
Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12
when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

1. Five (5) copies of the 26a Application executed by the Town of Murphy.
2. Five (5) copies of the location map.
3. Five (5) copies of engineering drawings, including plan and profile with
related miscellaneous details.
4. One (1) check in the amount of $500.00.
In general, this project will consist of approximately 7,000 LF 12-inch gravity
sewer line, 22,000± LF 8-inch gravity sewer line, 11,000± LF 6-inch sewer force main
and two (2) sewer pump stations. The project will begin at Sta. 16+32.53 Line "B" of
the recently completed Hiwassee River Trunk Sewer Line. The portion of the proposed
sewer improvements that relates to the 26a application is approximately 260 LF (Sta.
10+13.92 - Sta. 12+91.64) of 12-inch gravity sewer line located east of Hiwassee
Street (US 64 Business) at the beginning of the project. This section of sewer line will
be located primarily within the existing utility easements for the Town of Murphy and
will also be a replacement of existing sewer lines that have a history of maintenance
problems. Manhole Nos. Al and A2 will be located where existing grade is below the
top of gate (1526.50') and the maximum surface contour (1532.00') for Hiwassee Lake.
These manholes will have watertight lids and a top elevation of 1528.50'. A subaqueous
crossing of an unnamed tributary of the Hiawassee River (Sta. 15+40), located west of
Hiwassee Street near the No Name Deli, will also be required. The stream will be
temporarily diverted through a corrugated metal pipe during construction to provide a

completion of construction. All manholes will be precast concrete and the proposed
sewer line will be Class 50 ductile iron pipe.

Please find enclosed, for your review, the following:
1. Five (5) copies of the 26a Application executed by the Town of Murphy.
2. Five (5) copies of the location map.
3. Five (5) copies of engineering drawings, including plan and profile with
related miscellaneous details.
4. One (1) check in the amount of $500.00.
In general, this project will consist of approximately 7,000 LF 12-inch gravity
sewer line, 22,000± LF 8-inch gravity sewer line, 11,000± LF 6-inch sewer force main
and two (2) sewer pump stations. The project will begin at Sta. 16+32.53 Line "B" of
the recently completed Hiwassee River Trunk Sewer Line. The portion of the proposed
sewer improvements that relates to the 26a application is approximately 260 LF (Sta.
10+13.92 - Sta. 12+91.64) of 12-inch gravity sewer line located east of Hiwassee
Street (US 64 Business) at the beginning of the project. This section of sewer line will
be located primarily within the existing utility easements for the Town of Murphy and
will also be a replacement of existing sewer lines that have a history of maintenance
problems. Manhole Nos. Al and A2 will be located where existing grade is below the
top of gate (1526.50') and the maximum surface contour (1532.00') for Hiwassee Lake.
These manholes will have watertight lids and a top elevation of 1528.50'. A subaqueous
crossing of an unnamed tributary of the Hiawassee River (Sta. 15+40), located west of
Hiwassee Street near the No Name Deli, will also be required. The stream will be
temporarily diverted through a corrugated metal pipe during construction to provide a

stream. The streambed and stream banks will be restored to original contours upon
completion of construction. All manholes will be precast concrete and the proposed
sewer line will be Class 50 ductile iron pipe.
