Holland to pipe 280 linear feet of an unnamed tributary to Third Creek for development of a new commercial park along I-77 and US 70, Iredell County. Mr. W. D. Holland is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality (DWQ). The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). We are concerned about impacts that this project might have to the headwaters of the unnamed tributary. However, we will not object to the project as proposed provided that any mitigation required for stream impacts be subject to DWQ and US Army Crops of Engineers guidelines and that a 25 foot natural buffer zone (along each bank) be maintained along the stream through the applicants property below the piped section. Based on this review, we have identified significant uses, which would be removed or degraded by this project. These uses are aquatic life uses in the stream Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your commercial development without additional stream culverting? Also any additional fill will requir6 construction and maintenance of a wet detention pond to protect downstream uses. Any documentation such as maps and narrative that you can supply to address altemative designs for your project may be helpful in our review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H .0506(h) since aquatic life uses are present in the stream. Your mitigation proposal is insufficient because none was proposed. Any additional stream culverting will require mitigation since more than 150 linear feet were culverted in the past. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to Todd St. John, Mooresville Regional Office at 919 North Main Street Mooresville, NC 27107. If we do not hear from you in two weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. Please be advised that the Division of Water Quality (the Division) requires that approval be obtained prior to disturbing more than 150 linear feet of stream under either Nationwide Permits 14 or 26, regardless of whether the Army Corps of Engineers (ALOE) considers the stream as "subject to the 500 linear foot limitation" established for their permitting purposes. It will be the responsibility of the ACOE to determine whether or not the channel being impacted is indeed a stream for which they will claim jurisdiction. It should also be noted that compensatory mitigation may be required to replace unavoidable lost or degraded aquatic life uses of these streams, either through instream measures and/or riparian techniques-such as buffer establishment or vegetative planting for temperature control. In determining whether a stream mitigation will be necessary, the Division will need to determine whether the stream has positive 7Q10/30Q2 flow and whether or not aquatic vertebrates are present. When compensatory mitigation is required on streams that are to be culverted, or otherwise buried, the mitigation ratio is currently 1:1 (the Division may be raising this ratio to 2:1 in the near future).
