Greene to slope and stabilize eroding stream- banks along Beaver Creek, Wilkes County. Mr. Ralph Bowers, 384 Hayes Welborn Rd, Deep Gap, NC 28618, in cooperation with Mr. Barry Greer, Wilkes Soil and Water Conservation District (WSWCD), is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and site visit was conducted on January 12, 1998 with WSWCD personnel. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to stabilize eroding streambanks on his property along Beaver Creek. Methods used will include a low riprap wall up to bankful stage and/or root wads. Stream banks will be resloped and vegetated. The project is being done in cooperation with the WSWCD. The project will impact Beaver Creek which is not NCWRC Designated Public Mountain Trout Water, nor does it support trout. This project has the potential to improve water quality and aquatic habitat through stabilization of eroding streambanks. We have no objection to the project as proposed provided the following recommendations are implemented. 1. Bank stabilization should follow guidelines outlined in Chapter 16, Streambank and Shoreline Protection, of the NRCS Engineering Field Handbook, 12/96. Preference should be given to streambank toe protection using riprap, tree revetments and root wads or a Mr. Thomas 2 2/9/98 Greene Project combination of these methods. If available, we prefer the use of root wads because of the additional instream habitat they provide for fish and aquatic macroinvertebrates. Banks should be sloped and revegetated using plantings and/or soil bioengineering techniques as outlined in Chapter 16 of the handbook. 3. The following shrubs and small trees, hazel alder (Alnus serrulata), silky dogwood (Cornus amonum), and silky willow (Salix sericea), should be planted as individual species or in combination with each along the toe and up the slope of the bank on 3-foot centers to provide stream shading and a more permanent solution to bank erosion problems. 4. A minimum set-back of 20 feet of undisturbed native vegetation or restored riparian area adjacent to the installed practice is mandatory (NCASP Manual - Streambank Stabilization, page V-76, Policy 5, July 1997). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3102. This Certification allows you to use Nationwide Permit Number 13 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
