Dear Mr. Tatum:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 4.0 acres of
streams and/or wetlands located near Kelly in Bladen County for construction of a shallow water pond for water fowl.
Based on this review, we have identified significant uses, which would be removed or degraded by this project.
These uses are water storage and pollutant removal. Furthermore, insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H
.0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward
denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as
incomplete until we receive this additional information. Until we receive additional information, we are requesting
(by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be constructed as
planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can
you construct your pond on one acre or less of wetlands to avoid the need for mitigation? Any documentation such as
maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of
your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H
.0506(h). Your mitigation proposal is insufficient because none was approved.
Please respond within two weeks of the date of this letter by sending a copy of this information to me and one
copy to Ken Averitte, Fayetteville Regional Office at Wachovia Building Suite 714, Fayetteville NC 28301. If we do
not hear from you in two weeks, we will assume that you no longer want to pursue this project and we will consider
the project as withdrawn. I can be reached at 919-733-1786 if you have any questions.

I visited Mr. Tatum at his site this morning in the absolute
backside of nowhere in lower Bladen County. You will probably hear
from him in the next few days.
His duck habitat project is between 600-700 feet from the nearest run
of Colly creek, judging from the aerial photograph, which is much
clearer than the photocopy in his application.
He originally proposed to make a shallow excavation for wood ducks,
etc, and maintain some level of water all year, if possible. (As much
rain as we have had, and as little water as was on this place, I
don't know if that is realistic.) Anyway, the size of his project at
3-4 acres apparently throws him into a mitigation situation. We
talked about this and some possible options. He clearly does not want
to put restrictions or easements on a deed, although he indicates
this land will probably remain with his family forever.(He has
about 15-20 more acres of WL.) He did consider
doing his project on a smaller scale, i.e. one acre or less. He plans
to call you to discuss other mitigation options. In all likelihood,
this application will be withdrawn, unless you have some really
simple and cheap mitigation options. Then, he will build a pond equal
to or less than one acre and greater than 500 feet from the stream.
In the real world, with our rules aside,
this project as proposed would probably have little or no lasting
impact on water quality.
