Dear Mr. Sarder,
Staff of the NC Division of Water Resources(DWR),Water Quality Regional Operations Section
inspected the subject wastewater spray irrigation system on October 16, 2019 to conduct an inspection of
the system as part of a major permit modification. We wish to thank Austen Burk and Scott Jones with
Agri Waste Technology(AWT) for their help during the inspection.
This facility was inspected in December of 2018. The December inspection noted that efforts to
repair the sand filter when it ponded were not working. DWR staff also noted in December 2018 inspection
that the system typically receives about 30,000 gallons of wastewater a month,but that freeboard typically
stays around 4 feet even though irrigation rarely occurs. This suggests there is a leak someplace in the
wastewater system, most likely in the unlined pond. The previous operator and the current operator have
not been able to find signs of leakage in the form of lush growth or wet areas, despite searching.
Raleigh Regional office(RRO) staff of DWR reviewed the plan to install a new recirculation tank
and an Advantex pod and to abandon the sand filter in place and to use the existing recirculation tank and
a top-connected flow-through tank. AWT and Louisiana-Pacific are weighing options on how to stop
wastewater flow to the system during crucial steps of construction including pumping out the lift station,
installing porta johns, and pumping down the existing recirculation tank to allow for installation of a new
outlet. RRO recommends the project be completed as currently planned.

The following items specify permit conditions and limitations that were in violation of the
permit during the time of the inspection. (Also please refer to the attached inspection report):
H. PERFORMANCE STANDARDS
Condition 1,which states,"In the event the facilities fail to perform satisfactorily, ...the permittee shall
take immediate corrective actions..."
On the day of the inspection, the sandfilter had ponded water that was overflowing and running down into
the treated water holding pond. There was lush vegetation growing indicating that this condition has been
ongoing for some time. The sandfdter must be repaired or replaced immediately.
The irrigation pond receives roughly 1000 gallons per day of treated water, but no irrigation has occurred
since June 2018 and the freeboard has remained between 4 and 5 feet. This system is losing water. The
source of the leak must be determined and corrected.
You are required to take any necessary action to correct the above violations and to provide a written
response to this Notice within 30 days of receipt. Please include in your response all corrective actions
already taken and a schedule for completion of any corrective actions not addressed. Failure to comply
with the State's rules,in the manner and time specified,may result in the assessment of civil penalties and/or
the use of other enforcement mechanisms available to the State.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action,to the
Director of the Division of Water Resources, who may issue a civil penalty assessment of not more that
twenty-five thousand($25,000)dollars against any"person'who violates or fails to act in accordance with
the terms, conditions,or requirements of a permit under authority of G.S. 143-215.6A.
