PROJECT SUMMARY: The applicant proposes to construct a community dock with mooring for 10 boats. Also proposed is a bulkhead/retaining wall landward of the federal wetland line. Avila Subdivision Community Dock Page 2 9. PROTECT DESCRIPTION Avila Subdivision is a project that has been in the works for a number of years. One phase has been recorded for some time and a house has been built on Lot #4. The existing Avila Drive is a gravel road. The applicants propose to pave Avila Drive, offer lots for sale, bulkhead the line between the federal wetlands and high ground, and convert an existing private pier/dock into a community dock with a total of 10 slips. The property is a 36-acre tract located off of Country Club Road, behind Olde Point and north of Hideaway Shores Subdivision near Hampstead, Pender County. The configuration of the property is long and narrow (approximately 250' wide by about 6,000' long). Common Area for the subdivision borders the Atlantic Intracoastal Waterway. The property has significant elevation which is shown on Addendum Sheet # 5, the topo map submitted with the permit package. There is a wide, stable, marsh/wetland fringe that separates the high ground from the waters of the AIWW. This is depicted on the drawings submitted. The waters of the AIWW in this area have been designated as Primary Nursery Area by the Division of Marine Fisheries and are open to the taking of shellfish. The Division of Water Quality has classified these waters as SA. The water in the immediate area of the existing floating docks is approximately 1 1/2'-2' deep at low tide. No dredging is being proposed with this project. Federal wetlands along the waterfront have been delineated and their location verified by the Army Corps of Engineers. A wooden bulkhead/retaining wall is proposed landward of the wetland alignment. This bulkhead would be approximately 160' long and would be located on high ground along the top edge of the bluff. The purpose of the wall would be to retain fill material on the upland side. The land begins to fall off quickly where the federal wetlands commence along the edge of the bluff. A small parking area is proposed within the common area landward of the bulkhead, near the beginning of the pier. The subdivision project is currently under review by the Division of Water Quality for compliance with the stormwater regulations. The proposal meets the 30 % impervious surface limitation within the 75' AEC as is outlined in T15A: 07H.0209 (e) (2). Currently some of the lots have been cleared and others still have tree cover. No individual lots border the water; only the common area fronts the waterway. The ten slips that are proposed will be offered for sale on a first come-first serve basis. The Major Permit Application states that conveyance of the slips are limited to the property owners of this subdivision. A CAMA General Permit was issued on July 29, 1996 for the construction of a 4-slip, private pier with a gazebo and floating docks. The applicants are proposing to add on to the existing structure and change the use from private to community dockage. A total of six additional slips are proposed, bringing the total number of slips to 10. The applicant is applying for a boathouse, 20' x 25' in size. The roof of the boathouse would be flat, allowing it to double as a sun deck. The location of the proposed boathouse is shown on Addendum Sheet #6, entitled Avila Yacht Basin. The proposed layout for mooring 10 boats is best depicted on Sheet V. This community docking facility requires review through the Major CAMA Permit process. The proposal meets all CAMA regulations relative to the 1/3rd rule, distance from a federally-maintained channel and 15' setbacks off of the adjacent riparian corridor lines. ANTICIPATED IMPACTS No significant impacts should be associated with the proposed bulkhead/retaining wall. No wetlands, waters or marsh will be filled in conjunction with this proposal. Sedimentation control devices must be employed to prevent loose soil from eroding into wetlands during rain storm events while under construction. Any other impacts resulting from the bulkhead construction will be to high ground, previously disturbed. Development of the individual lots will result in more impervious surface coverage over the tract, less cover and food for wildlife and birds. Approximately 7000 square feet of public trust, estuarine waters will be covered by the gazebo, boathouse, floating docks and slips should this proposal be built as proposed. Temporary impacts to water quality will likely result from the jetting-in of mooring pilings. These impacts could be reduced by driving the pilings in without the use of a jet pump. Janet M. "D D AUG 111997 DIVISION OF COASTAL MANAGEMENT Avila subdivision is a thirty six acre tract on the intracoastal waterway located on Country Club road between Olde Point development and Belvedere Plantation; just north of Hampstead Village. Avila subdivision is comprised of twenty six recorded lots of which the first eighteen lots are considered as Phase L Avila would like to propose ten deeded condominium boat slips to complement our private development The use of these slips would be for the enjoyment of property owners. All property owners will share the common area, pier, and gazebo. Phase II are the remaining lots naturally separated by a three acre pond. It is the intention to reconfigure and reduce the size of the lots in Phase IL Using the natural landscape and 302 feet of shoreline, we propose a well landscaped retention wall with a gentle incline and vegetation to detain erosion. Under a general permit issued in 1996, a handrail six foot pier extends out three hundred twenty six feet (326) and twenty two feet to the south of the northern riparian corridor. A sixteen by sixteen T-Head gazebo is centered seventeen feet from the northern riparian corridor. To the south marks an existing twenty five by twenty foot (25 x 20) wet slip and three (3), forty foot wet slips. Two (2), six by twenty foot floating docks (6 x 20), are adjoined to the aft of the slips. Avila would like to extend an additional ninety feet (90), to the south of the fourth slip and add six wet slips; four (4), forty foot slips and two (2), eighteen foot slips. Access to each slip would have a shared finger pier of twenty four feet as well as a walk way to the aft of five (5), six by eighteen foot floating docks (6 x 18). In addition, we propose a boathouse in which we would build a flat roof above the existing 25' x 20' slip. At present the A.LW.W. is ninety four (94), feet from the waterward side of the outer mooring pilings and would remain constant with permitted addition.
